Everything in the pkg. looks pretty good, with a few exceptions. First, the application needs to be signed and notarized. I assume that would be Arthur J. Kepes, Member of the LLC. Secondly, the Wet Detention Basin Operation and Maintenance Agreement needs to be signed and notarized, Kepes' name is typed in. The best way to handle these and expedite our review, would be to get them signed and notarized and send me a .pdf of these documents on email, and then mail the originals to me. The site plan set and supporting documents are fine, with the exception of, Thirdly, there needs to be an access easement drawn around the bmp, in general providing a ten foot easement, around the bmp for maintenance and access, and labelled as such on the plan sheet, and this easement needs to be drawn back to the public r-o-w. You have a water and sewer easement shown on Sheet C-3, I assume you could piggy -back onto that easement, just so it is drawn back to the public r-o-w. Some preferjust to do a blanket easement on a separate full size plan sheet just showing the easement. I will need two copies of this changed or new sheet. See Chapter 7 of our BMP Design Manual, BMP Maintenance, found here http://portal.ncdenr.org/web/Ir/bmp-manual. Again, the package and plan set looks good and once 1 have the above items, we can proceed with the final review and issuance of this stormwater permit. SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application instruction sheet and BMP checklists are available from http://portal.ncdenr.org/web/wq/ws/su/statesw/fornis_docs. The complete application package should be submitted to the appropriate DEMLR Office. (The appropriate office may be found by locating project on the interactive online map athttp://portil.iicdenr.org/web/­wqZwsZsu/maps.) Please indicate that the following; required information have been provided by initialing in the space provided for each item. All original documents MUST be signed and initialed in blue ink. DEED RESTRICTIONS AND PROTECTIVE COVENANTS For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and protective covenants forms can be downloaded from http://12ortii.ncdenr.org/web/Ir/state-stormwater- forms dots. Download the latest versions for each submittal. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and protective covenants for this project, if required, shall include all the items required in the permit and listed on the forms available on the website, that the covenants will be binding on all parties and persons claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted without concurrence from the NC DEMLR, and that they will be recorded prior to the sale of any lot. AY 1 1 2015 Ed Buchli: I have finished a preliminary review of this state stormwater application for the Spout Springs Shops including a Walmart Supercenter in Cameron, Harnett County. Everything in the pkg. looks pretty good, with a few exceptions. First, the application needs to be signed and notarized. I assume that would be Arthur J. Kepes, Member of the LLC. Secondly, the Wet Detention Basin Operation and Maintenance Agreement needs to be signed and notarized, Kepes' name is typed in. The best way to handle these and expedite our review, would be to get them signed and notarized and send me a .pdf of these documents on email, and then mail the originals to me. The site plan set and supporting documents are fine, with the exception of, Thirdly, there needs to be an access easement drawn around the bmp, in general providing a ten foot easement, around the bmp for maintenance and access and labelled as such on the plan sheet, and this easement needs to be drawn back to the public r-o-w. You have a water and sewer easement shown on Sheet C-3, I assume you could piggy -back onto that easement, just so it is drawn back to the public r-o-w. Some prefer just to do a blanket easement on a separate full size plan sheet just showing the easement. I will need two copies of this changed or new sheet. See Chapter 7 of our BMP Design Manual, BMP Maintenance, found here http://portal.ncdenr.org/web/Ir/bmp-manual. Again, the package and plan set looks good and once I have the above items, we can proceed with the final review and issuance of this stormwater permit. Drainage flows via overland flow from the eastern property boundary into a shallow open channel that feeds into a wetland area where a former pond and associated dam (breached) were located. The wetlands were observed to be in an area located in the northern -central portion of the Walmart building. Limits of the wetlands have been delineated and confirmed by the USACE. The limits of wetlands and the proposed impacts are shown on site and grading plans. Storm water discharge from the wetlands area flows west southwest into an unnamed tributary which flows into the Muddy Creek Tributary 2. The proposer) development will consist of buildings, parking, driveways, associated utilities, and two above ground stormwater management ponds (forebay and wet detention pond). The forchav and wet pond have been designed in accordance with the North Carolina Department of Environment and Natural Resources (NCDENR) Stormwater Best Management Practices Manual. The NCDENR design guidelines require that a wet detention pond be sized to provide a temporary pool having the capacity to capture the first 1-inch of Stormwater and release it over 2 to 5 days.
