SW8 971229 & SW8 000305 Shallotte Business Park & Ready Mix Concrete Plant, Shallotte, NC Dear Mr. Loftin: It is the understanding of this office that Ready Mix Concrete Plant, Shallotte, North Carolina is developed on lots 19, 20 and 21 of Shallotte Business Park. Therefore, the Master Shallotte Business Park Permit is applicable to Ready Mix Concrete Plant. The Master Shallotte Business Park Permit limits the amount of built -upon area for lots 19, 20 and 21 to a total of approximately 66, 211 square feet (lot 19- 0.38 acres, lot 20 — 0.37 acres and lot 21 — 0.77 acres). The Master Plan for Shallotte Business Park is permitted under State Stormwater Management Permit Number SW8 971229. This permit covers all 22 of the lots associated with Shallotte Business Park inclusive of lots 19, 20 and 21. The built -upon area limitation stipulated in State Stormwater Management Permit Number SW8 971229, which is the Master Shallotte Business Park Permit, cannot be exceeded in the individual State Stormwater Management Permit Number SW8000305 written for Ready Mix Concrete Plant - Shallotte, NC. Currently the'individual State Stormwater Management Permit Number SW8 000305, written for Ready Mix Concrete Plant — Shallotte, NC, limits the amount of built -upon area for lots 19, 20 and 21 to 56,628 square feet. This is more restrictive than the 66,211 square feet that is allowed by the Master Shallotte Business Park Permit. This office has no objection to your company modifying their individual State Stormwater Management Permit. However any modification made to the permit cannot exceed the built -upon area limitation stipulated in the Master Shallotte Business Park Permit, which is 66,211 square feet. This office has reviewed the amendment to the deed restrictions being proposed by Shallotte Business Park. This office has determined that the proposed amendment to the deed restrictions are consistent with the built -upon area limitations stipulated in the Master Shallotte Business Park Permit. The amending and recording of the proposed deed restrictions will not affect your company's ability to modify their individual permit. The only restrictions will be that your facility cannot exceed 66,211 square feet of built -upon area and that your facility cannot create an area within the project site that is of such high density that stormwater runoff threatens water quality. Post Office Box 27326 Raleigh, NC 27611 Subject: Request for Additional Information Stormwater Project No. SW8 000305 Modification Ready Mix Concrete Plant, Shallotte, NC Brunswick County Dear Mr. Spence: The Wilmington Regional Office received a Stormwater Management Permit Application for Ready Mix Concrete Plant, Shallotte, NC on October 18, 2004 with additional information being received on April 29, 2005. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. I searched the North Carolina Department of the Secretary of State's Corporations Database and could not find Ready Mix Concrete Plant. Please provide documentation that your corporation is a registered entity with the North Carolina Department of the Secretary of State. 2. It appears that Ready Mix Concrete Plant is a corporation. In the case of a corporation, State Stormwater Regulations require that permit applications and supplement forms be signed by a principal executive officer of at least the level of vice-president or his authorized representative. Your signature on a application and IVFr. Ronald Webel's signature on the sand filter operation and maintenance plan can be accepted only if you provide a signed and notarized letter of authorization. The original application and the original sand filter operation and maintenance plan is enclosed for your review and completion. Please either have a principal executive officer of at least the level of vice-president sign these documents or provide a signed and notarized letter of authorization. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to August 8, 2005, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. If you need additional time to submit the information, please mail or fax your request for a time extension to the Division at the address and fax number at the bottom of this letter. The total drainage area at the site is approximately 1.3 acres. The intent of this project is to provide a NCDENR SMP (Sand Filter System) to treat for water quality as per the N.O.V letter dated 08/01/03 for this site. STORM WATER DESIGN APPROACH: Storm water treatment will be implemented through drainage swales and Sand Filter System. Storm water is drained through swales on east (new swales) and west side (existing swales) of the site. See attached drawings for detail. Mr. Tatum will be submitting a revised drawing showing the wetlands, the contour lines, dimensions, and swales. Upon receipt of the revised plans, and the completion of the work to remove the excess Built -upon area, to establish grassed swales, and to relocate the berm, I can make the determination that the project is in compliance with the permit, and initiate the transfer of the permit to you . The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 000305, issued to you on April 3, 2000. The project has been found in violation of Stormwater Permit Number SW8 000305, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: 1. Section L2- The overall tract built -upon area percentage for the project must be maintained at 30%, as required by Section .1005 of the stormwater rules. Section 11.2- The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. The projecfs built -upon area has been increased to the point that the 30% limit hhas been exceeded and a pocket of high density has been created. 2. Section 1.4- This project proposes a curb outlet system. Each designated curb outlet swale shown on the approved plan must be maintained at a minimum of 100' long with 5.1 (H: V) side slopes or flatter, have a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non -erosive manner, and maintain a dense vegetated cover. The curb outlet swales are non-existent. The ditches that run along the north and west property lines are not vegetated. N. C. Section 11.8- The following items will require a modification to the permit. Revised plans, specifications and calculations must be permitted prior to the permittee beginning construction on the modification: a. Any revision to the approved plans, regardless of size. d. Redesign or addition to the approved amount of built -upon area. Redesign of and addition to the approved amount of built -upon area have taken place without a permit modification. 4. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. The required certification has not been received. To correct these violations you must: 1. Provide a written 'Plan of Action" which outlines the actions you will take to correct the violations and a time frame for completion of those actions, on or before September 1, 2003. 2. Restore the project to the original approved low density design with the swales, or submit a modification for the project to high density. 3. Certify that the project is built as approved upon completion of the work. Failure to provide the 'Plan of Action" by September 1, 2003, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil and criminal penalties, pursuant to NCOS 143-215.6A. By copy of this letter to the Brunswick County`Building Inspector, this Office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved.
