The Wilmington Regional Office received a copy of your Sedimentation and Erosion Control application
for the clearing and grading of the project known as Erosion Repairs-TLZKite, TLZ Dodo, TLZ Hawk. Staff of the
Wilmington Regional Office has reviewed the application for the applicability of the Stormwater Management rules
to the proposed activity at this project. Based on our review, you do not appear to be proposing a development
activity on this site at this point in time that would be subject to the stormwater requirements as provided for in 15A
NCAC 2H.1000. Please be advised that other regulations will potentially apply to your proposed activities.
If your project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria.
This exemption applies only to the Coastal Stormwater Management Permit for the currently proposed
clearing and grading activity. If at any time in the future, development of any part of this site is planned, as defined
in NCAC 2H.1000, or if the proposed activities differ in any manner from what is shown on the plans on file with
the Division, then you must submit the project for review of the applicability of the stormwater management rules. If

NOTICE OF RECEIPT OF EROSION & SEDIMENTATION CONTROL PLAN

Dear Cmdr. Pina:
This office has received a soil erosion and sedimentation control plan for the project listed below which was
submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57(4)).
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must
obtain approval of a soil erosion control plan prior to the commencement of said land -disturbing activity (NCGS 113A-
54(d)(4)). The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the
approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan
if the submitted plan is complete. Commencement or continuation of a land -disturbing activity under the jurisdiction
of this Act prior to the approval of an erosion & sediment control plan is a violation of the Act.
A copy of any erosion and sediment control plan which could involve the utilization of ditches for the purpose
of dewatering or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ). It is
suggested that you contact the Division of Water Quality at (910) 395-3900 if the ditches shown on your plan will
lower the water table.
We have performed a preliminary review of your submitted plan and have determined that additional information
will be necessary before a final review can be completed. Enclosed is a checklist of items that must be submitted
before we can complete the review process. Failure to provide the additional information may result in disapproval
of your plan.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal
and State water quality laws, regulations and rules.
If you have questions or need additional information, please do not hesitate to contact this office. Your

Pollution Control Act as a one -use borrow site or through the
Mining Act.

COMMENTS
1. Page 1 is missing from the Project Narrative (all copies).
2. The narrative states that bare areas that are to be seeded & mulched only are not
included in the area to be disturbed. However, proper seedbed preparation is necessary
prior to seeding, lime, fertilizer, mulch & discing process. Please clarify why this is not
considered a land disturbance.
3. If Corps of Engineers permits are required for the pond construction at TLZ Kite, please
provide a copy for our files. The note says: "No Section 404 wetlands exist...".
However, the plans show a wetland symbol described as "existed flooded area".
4. 30' gravel construction entrances are not long enough. The minimum acceptable length
is 50'.
5. The legend on the plans does not list any erosion control measures. The only measures
shown on the plans are inlet/outlet stabilization at culverts and gravel entrances.
6. Section 5.7 of the Narrative describes silt fence use at the top of the slopes to protect
adjacent drainage ways. Is this proposed where slopes are already stabilized by existing
vegetation and are not to be disturbed?

Dear Ms. Lewis:
Enclosed please find one copy of project plans associated with the proposed erosion control
repairs at TLZ Kite, TLZ Dodo and TLZ Hawk, Temporary Landing Zones located on Marine
Corps Base, Camp Lejeune. The project includes the grading of the dirt landing zone areas to
repair grading irregularities, such as ravines and washouts. All disturbed areas will be
revegetated. No new impermeable surface will be created by the project at any of these sites.
The proposed project will create a usable temporary landing zone where none presently exists.
It is our thought, that the proposed activity would not be subject to stormwater requirements
specified in 15A NCAC 2H.1000. We are requesting an exemption to the Coastal Stormwater
regulations for this project. Please review this project and issue a stormwater permit exemption
if you deem it appropriate.
