On July 16, 2010, Steve Pusey of the Wilmington Regional Office of the Division of Water
Quality (DWQ) inspected Surf City Community Park and Recreation Center in Pender County to
determine compliance with Stormwater Management Permit Number SW8 050518 issued on
September 13, 2005. D'0JQ file review and site inspection revealed that the site is compliant
with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including operation and maintenance of
your permitted stormwater system.
If the project has changed name, ownership or mailing address, a formal change of
name/ownership form must be submitted to DWQ within 30 calendar days detailin.9 the change.
Please provide the name, mailing address and phone number of the person or entity that is now
responsible for this permit.
Please be advised that violations of your Stormwater Management Permit may be subject to the

addressed each item below. For your convenience, we have repeated DWQ's comments in
bold, and the responses and corrections follow in italicized font:
1. The swale at front of property exiting into road swale (JH Batts Rd.) needs to be
stabilized with grass.
Over the past month, the swale has seen significant growth of grass, which has
stabilized the swale.
2. There Is some construction debris at various locations around the fields that needs to
be removed.
The construction debris has been removed.
3. There is some erosion damage in the woods next to the waste transfer station that
needs repair by bringing in fill dirt and seeding. It appears that this area was eroded
during construction from runoff at the exit of a downslope pipe from the fields. The
runoff went down the dirt road about 20' and into these woods. Trash also needs to
be removed in this area.
The Town has contacted the contractor for the project and is requiring them to return to
the site to make the necessary repairs under the existing contractor warranty, which will
be completed within the next 30 ways.

On May 13, 2010, Steve Pusey of the Wilmington Regional Office of the Division of Water
Quality (DWQ) performed a follow-up inspection at Surf City Community Park in Pender County
to determine compliance with Stormwater Management Permit Number SW8 050518 issued on
September 13, 2005. DWQ file review and site inspection revealed that the site is not compliant
with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
It appears that progress has been made since the last inspection. However, as indicated in the
attached inspection report, the following deficiencies must be resolved:
1. The swale at front of property exiting into road swale (JH Batts Rd.) needs to be
stabilized with grass.
2. There is some construction debris at various locations around the fields that needs to be
removed.
3. There is some erosion damage in the woods next to the waste transfer station that
needs repair by bringing in fill dirt and seeding. It appears that this area was eroded
during construction from runoff at the exit of a downslope pipe from the fields. The
runoff went down the dirt road about 20' and into these woods. Trash also needs to be
removed in this area.
Please inform this Office in writing before June 18, 2010, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the
assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by June 18, 2010, then DWQ staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.

On March 17, 2010, Steve Pusey.of the Wilmington Regional Office of the Division of
Water Quality (DWQ) inspected Surf City Community Park and Recreation Center in
Pender County to determine compliance with Stormwater Management. Permit Number
SW8 050518 issued on September 13, 2005. DWQ file review and site inspection
revealed that the site is not compliant with the terms and conditions of this permit.
Please find a copy of the completed form entitled "Compliance Inspection Report"
attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be
resolved:
1. Swale shown on plans (near entrance of Community Center Drive) to inlet
channel of level spreader needs to be constructed and stabilized.
2. Large drainage pipe under west side of front parking area is not shown on plans
and needs to be removed per conditions of the low density section of this permit.
This area should be stabilized and vegetated after pipe removal.
3. A pipe inlet on the northeast side of the wet detention pond, receiving runoff from
the stormwater forebay needs to be shown and labeled on the plans.
4. Several areas of erosion need repair, stabilization, and vegetation as follows:
1) Erosion and sedimentation in vegetated filter at front of property.
2) Sedimentation in inlet channel to level spreader.
3) Sedimentation around level lip of spreader.
4) Erosion on wet pond banks in several areas.
5) Erosion in several areas at drainage pipe outlets from fields.
6) Excessive trash in erosion path (in woods) from drainage pipe outlet (at edge
of woods near front parking area) needs to be removed. Erosion path needs
to be stabilized.
7) Sedimentation next to silt fence at road crossings over drainage ditch (west
side) to be removed and area stabilized to prevent further erosion.

5. There is some erosion on the west bank of the fields, and some sedimentation in
the large drainage ditch (west side): Erosion should be repaired and excessive
trash should be cleaned out of the ditch.
Please inform this Office in writing before April 19, 2010 of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, when required, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written
