The subject permit was issued on May 28, 2010 and expired on May 31, 2015. Federal [40 CFR
122.41(b)] and state [15A NCAC 02H .0105(e)] regulations require that permit renewal
applications be filed at least 180 days prior to expiration of the current permit. The renewal
application was due to the Division no later than December 2, 2014.
Correspondence concerning this was previously sent in a letter dated February 15, 2018. Per
information available online, the subject facility was sold to Wilson Biofuels, LLC in May 2019,
however, a change of ownership form was never received by the Division. To date, the Division
has not received an ownership change request or renewal application and supplemental
information.
Accordingly, this office intends to move forward with rescission of this permit. To keep the
current permit active, you must: 1) respond to the Division within 15 days of receipt of this
notification and 2) submit a renewal application for this NPDES permit. The renewal application
forms can be found online at hgps:Hdeq.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-pro rg am/npdes-industrial-program/individual-industrial-
ep rmits.
Please note that discharge of stormwater without coverage under a valid stormwater NPDES
permit constitutes a violation of NC General Statute 143-215.1 and may result in the assessment
of civil penalties up to $25,000 per day.
