This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which grants an extra year for a total of four (4) years extension. On July 25, 2011 Masonboro, Woods Amenities Association Inc, Inc. submitted a request and application for a 10-year permit Renewal request. The Division is hereby notifying you that permit SW8 931105 has been transferred and renewed on August 11, 2011, and shall be effective until September 14, 2022, which includes the 4-year extension, issued on May 19, 2011. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. (CCRG) agree to the following terms & conditions regarding the monthly maintenance of two NCDENR permitted wet detention pond located in Masonboro Woods Subdivision. CCRG services will be provided as follows: 1. CCRG will provide monthly pond maintenance services for an indefinite period beginning on June 1 st, 2011. The cost of this maintenance service will be $400.00 per month, to be billed at the beginning of each month and due upon receipt. A late fee of 18% per annum will be charged on all 30 day past due amounts. The monthly fee will be increased 3% each succeeding year on January 1 gt. This agreement may be canceled at any time upon written 30 days notice to each party. 2. Owner will provide CCRG copies of the current DWQ stonmwater permit and associated plans and operation and maintenance agreements for the ponds. If unavailable, CCRG will work with Owner to obtain copies. Maintenance activities will be conducted in accordance with the permit documentation. 3. One maintenance visit per month that includes labor, dye, and aquatic herbicides necessary to control algae and aquatic vegetation. During this visit trash and debris will be removed from the pond banks and outlet structure. 4, Sediment load in ponds will be measured annually. Documentation of findings will be provided. 5. F,xcluded from this agreement are: the mowing of grass on banks, removal of trees that have fallen into the ponds, cost of labor and product to stock biological controls (fish), repair of damaged pipes, repair eroded banks, repair of damaged draw down devices, and removal of any debris from ponds after a hurricane, tropical storm, or other disasters. 6. CCRG personnel will be available upon request to meet with o-vNmer's representative to discuss status of pond maintenance and outstanding issues related to ponds. CCRG requests a meeting at the site with Owner and party responsible for mowing pond banks prior to start of this contract. 7. CCRG will issue a monthly report for each pond stating maintenance tasks performed, dyes and herbicides used, and maintenance issues beyond the scope of this agreement. The maintenance reports should be filed and accessible to State DWQ personnel. 8. This agreement constitutes the entire agreement between both parties. No oral or written alterations can be made to this contract, unless made in writing to the authorized agents of both parties, and the terms and conditions are accepted.
