It has been the policy of the Division that if future area was accounted for in the design of the stormwater facility, a modification to construct the future area is not needed. For projects where the future area is accounted for in the original permit, and ownership has not changed, the Division will require a cover letter, 2 sets of plans and a calculation sheet showing that the proposed BUA is less than or equal to what was accounted for in the original permit. No fee is required. The original permit, dated September 14, 1998, allotted 21,700 ft2 for the pool and clubhouse construction, to drain to Pond 42.. The plans submitted propose 15,484 ft2, leaving 6,216 ft2 available for additional future construction. All terms and conditions of the original permit remain in full force and effect. Therefore, we are having to submit for a modification to the above -mentioned project to accurately inform you of the amount of impervious area that is proposed for the pool/club house area. After designing the pool/clubhouse area, the amount of impervious area is less than what was originally permitted. In the previous approval we had allocated 21,700 square feet of impervious area. The plans provided show 15,484 square feet of impervious area. Thus, the pond currently designed is still sufficiently sized for this drainage area. DEED RESTRICTIONS AND PROTECTIVE COVENANTS The following italicized deed restrictions and protective covenants are required to be recorded for all subdi risions, out parcels, and fature development prior to the sale of any lot. If lot sizes vary significantly, a table listing each lot number, size, and the allowable built -upon area for each lot must be provided as an attachment. 1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number as issued by the Division of Water Quality. These covenants may not be changed or deleted without the consent of the State. 2. No more than square feet of any lot shall be covered by structures or impervious materials. Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but not include wood decking or the water surface of swimming pools. `See previous restrictions.) 3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. 4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from the outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted.
