Shotwell Facility, Certificate of Coverage-NCG120110 NPDES Stormwater General Permit-NCG120000 Wake County Mr. Daher: On March 18, 2022 a site inspection was conducted for the Shotwell Landfill Inc. facility located at the 4724 Smithfield Road, Wake County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG120000, Certificate of Coverage-NCG120110. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Marks Creek, a Class C;NSW waterbody in the Neuse River Basin. As a result of the inspection, the facility was found to be not in compliance with the conditions of the NCG120000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Provide a list of significat spills, or lack there of, for the last three years Provide an evaluation of feasible alternatives. Be sure to include any improvements made Provide a summery of site specific BMP's Provide a detailed spill prevention and response plan for all areas that have the potential for spills. That would include the fueling area Provide training for all employees for stormwater pollution prevention for any employees that may come in contact with site operations on a yearly basis Be sure to review and update the plan yearly. Re -date the plans when the review is done Provide a facility inspection plan that has a checklist,date and sign off areas Conduct the sampling required by the permit for both analytical and qualitative samples Be sure all the outfalls are stable and functioning correctly with no encrouchments on surrounding stream, wetlands or other waters of teh state.
