As agreed on August 24, 2009, a solution to this non compliance would be your letter of explanation as well as the additional mitigation for the unauthorized mechanized land clearing in the permitted bridge corridor. During our onsite meeting, it was my understanding that the clearing noted was not only the area repaired where equipment was stuck but also all from stump removal in advance of the bridge construction. Both of these factors weighed into the decision to require mitigation for the bridge corridor area. Once the items outlined in your August 28, 2009 correspondence have been successfully completed the site should be back in compliance. I went by there the other day and noticed that the ground is bare on the top and back side of the berm at the back of the pond. You would need to write up an attachment to the Name/Ownership Change Form stating that the new Owner agrees to accept the pond conditions on "as is" basis, and have them sign it. Also, we will require that the pond banks are repaired, seeded, and stabilized within 15 calender days from the renewal / transfer date. I am currently working on the renewal permit and should have that ready to be sent out within the next couple days. Therefore, please try to get the paperwork to me by Friday morning. At this point, we have received quotes for bringing the storm water system into compliance and believe we will be able to authorize work to begin the week of March 1 subject to weather conditions. Remove, clean, add as necessary and reset rip -rap while removing sedimentation from the forebay holding areas in both ponds 2. Per the requirements of the permit, a copy of the Engineer/Designers certificate for the stormwater pond must be forwarded to our office upon completion of the site. A review of our files indicates that we have not received a copy of the certificate yet. This is the third notice you have been sent regarding this matter.
