Scanlan: Onslow County _ The Wilmington Regional Office received a complete Stormwater Management Permit Application for BEQ French$ Creek on August 8, 2002. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 020612 dated August 16, 2002, for the construction of BEQ Frerichs Creek. This permit shall be effective from the date of issuance until August 16, 2012, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 4 State Stormwater Management Systems Permit No. SW8 020612 10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 11. The permittee shall keep records of the total project boundary permitted with this project. Prior to the use of any of portion of the property as project area for another project, the permittee shall submit a modification to the permit. 12. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. M. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to, enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. Linear interpolation should be employed to determine the correct value for non- standard table entries. In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide 90% TSS removal. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the vegetated filter if one is provided. Inspect the. wet detention basin systema for sediment accumulation, erosion, trash accumulation, vegetated: cover, and general condition. b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2 to 5 days as designed. 2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. If Caddell proposes to construct temporary roads or embankments and excavations for plant and/or work areas not to receive final grading and/or landscaping under this contract, we will submit a layout of all temporary roads, excavations, and embankments to be constructed within the work area and plans and cross sections of proposed embankments and their foundations, including a description of proposed materials for approval prior to a scheduled start of such work. All temporary buildings and signs will be removed from the construction site when they are no longer needed. All haul roads, access roads, work areas, etc. will be restored to their original condition. Stream Crossings General grading and drainage will direct runoff away from excavations, stockpiles, and spoil areas. Areas will be protected from erosion as required. Natural water flows other than surface runoff and drainage, will not be altered by Caddell. Wash and wastewater will be processed as necessary prior to disposal. Working discharge water from well points will be performed in such a manner so as to maintain the quality.of surface and ground waters immediately downstream from the construction site. Discharges of water from dewatering will be in channels, which will not overflow or erode. Channels will be maintained and repaired as needed. Fish and Wildlife Resources Caddell will avoid interference or disturbance to fish and wildlife. We will not alter water flows or otherwise significantly disturb a native habitat adjacent to the project and critical to the survival of fish and wildlife, except as indicated or specified. For a list and details regarding the Endangered Species of Onslow County, refer to TAB I. Wetland Area Preservation Wetlands shall not be disturbed beyond the limits of construction. CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM PROTECTION OF HISTORICAL AND ARCHAEOLOGICAL RESOURCES Objectives Caddell will carefully protect in -place and report immediately to the Contracting Officer historical and archaeological items or human skeletal remains discovered in the course of work. Methods Upon discovery, Caddell will immediately notify the Contracting Officer. Work in the area will stop immediately until directed by the Contracting Officer to resume work. Caddell acknowledges that the Government retains ownership and control over historical and archaeological resources. CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM STORM WATER MANAGEMENT AND CONTROL Ground Cover All pollution prevention measures will be inspected by the Contractor's quality control organization at least once every seven days and within twenty-four hours following any storm event 12mm (0.47 inches) or more, and submit an "Erosion and Sediment Control Inspection Report" to the Contracting Officer. The Contracting Officer at the pre - construction conference will provide for this form. The various control measures along with any revisions or modifications to the plan will regularly be maintained in proper working order as designed and such that contaminants and pollutants do not enter the storm water runoff leaving the site. The inspector shall thoroughly understand the requirements of the detailed Storm Water Pollution Prevention Plan (SWPPP) developed by the contractor and have a basic knowledge of engineering aspects on controlling storm water and reducing run off pollution. 1. Erosion and Sediment Controls to be used on this project. A. Stabilization Practices • Stabilized Construction Access Points. • Mulch, Netting, Matting, Fabric, Seeding or Sod • Landscaping completed on disturbed areas that'are not paved, upon termination of construction. B. Structural Practices • Staked Silt Fence, Sandbag Dams, and Rock Check Dams may be utilized for structural control. 2. To maintain the above practices, the following will be done: A. Maintenance and repair will be conducted after an inspection report. B. Sediment will be removed from behind the reinforced filter fabric barriers or other sediment control devices when needed. C. Sediment will be removed from the sediment trap periodically. D. Temporary controls will be removed after the disturbed areas have been stabilized. Water runoff, surface water, and subsurface water will be controlled so that it does not affect the work, the site, or the adjoining properties. Control fill, grading, and ditching shall direct water away from excavations, pits, and tunnels and direct it toward the proper runoff course. Drainage water will be properly disposed of so that it does not cause flooding or erosion. The sediments collected will be disposed of off site. Erodible Soils See attached Soil Boring information (TAB J). CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM Temnorary Measures Mechanical Retardation and Control of Runoff The contractor or subcontractor responsible for each major activity will implement controls and measures at the site. During the construction process the following controls and measures will be installed prior to and maintained during each activity implemented according to standard practices, the construction plans, and the specifications. Locations of these controls will be determined on site prior to starting an activity and maintained during the activity until completion: Erosion and Sediment Control Structural Practices • Filter Fabric Fences • Sandbags • Stabilized Construction Exits • Berms, Dikes, and Drains • Coconut Fiber Lined Ditch • Geotextile Fabric • Rock Riprap Vegetation and Mulch Stabilization Practices • Areas of the site that will not be redisturbed for 21 days or more must be stabilized by the 14th day after last disturbance. • Stabilized construction exits will be provided. Geotextile fabric will be utilized when needed to prevent soil erosion. • Existing vegetation will be allowed to remain undisturbed as long as possible. Remaining disturbed areas, which require seeding, will be seeded. • Permanent grass cover will be provided to disturbed soil areas once construction is completed not later than 15 working days or 90 calendar days which ever is shorter. • Stabilization of trees • There is approximately 15 acres that must have stabilized vegetation. CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM Temporary grading shall be inspected for erosion and soil loss from the site. Temporary.mulch and permanent. planting will be inspected for bare. spots and washouts on permanent. planting, and healthy growth. Discharge points shall.. be inspected'fo:r Signs of erosion or sediment associated With the discharge. Locations where vehicles enter and Leave the site shall be checked for signs of off -site sediment tracking. Best Management Practices and pollution control maintenance procedures shall be inspected for adequacy. Any deficiencies shall be noted in the inspection report and correction implemented within seven calendar days. The revisions shall be reviewed with the Owner. After final stabilization has been achieved, the Contractor shall inspect the site once a month until final inspection and project acceptance. 1. A qualified person or persons will be designated to perform the following inspections: • Disturbed areas and areas used for the storage of materials that are exposed to precipitation will be inspected for evidence of, or the potential for, pollutants entering the drainage system. Erosion and sediment control measures identified in the plan will be observed to ensure that they are operating correctly. • Where discharge locations or points are accessible, they will be inspected to ascertain whether erosion control measures are effective in preventing significant impacts to receiving waters. Locations where vehicles enter or exit the site will be inspected'for evidence of off site sediment tracking. ® Remove eroded and settled products when silt reaches a depth one- third the height of the control or 6 inches, whichever is less. The inspection will be conducted by the responsible person at least once every 7 calendar days and within 24 hours after a rainfall of 0.5 inch or greater. Damaged of deficient control measures are to be corrected as soon as practicable (in most cases commence within 24 hours) but no later than 7 days after the inspection. 2. Based on the results of the inspection, the site description and control measures of this plan may need to be reevaluated and revised as appropriate, but in no case later than 7 calendar days 'following the inspection. 3. A report summarizing the scope of the inspection, name(s) of personnel making the inspection, the date(s) of the inspection, major observations relating to the implementation of the Environmental Protection Program, and actions taken in accordance with Federal and State Regulations will be made and retained as part of the Storm Water Pollution Prevention Plan for at least three years from the date the site is finally stabilized. Copies of the forms to be used for the Inspection and Maintenance report are included in the following pages as a part of this pollution prevention plan CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM SWPPP Measures and Notice of Intent (40 CFR 122.26, EPA 832-R-92-005) The Storm Water Pollution Prevention Plan (SWPPP) for this project shall meet the requirements of the State of North Carolina general permit for storm water discharges from construction sites. Submit permits for erosion and sediment control; stormwater management system, and Pollution Discharges Elimination System Storm Waterr as specified in section, "DESIGN/BUILD CRITERIA (BACHELOR QUARTERS)." Potential Sources of Pollution Potential sources of pollution which may be reasonably expected to affect the quality of storm water discharge from the site. The following substances listed below are expected to be present on site during construction and will be properly labeled: 1. Steel Reinforcing Bars 2. Concrete 3. Cleaning solvents 4. Detergents 5. Asphalt 6. Paints 7. Fuels 8. Fertilizers 9. Wood 10. Lubricants 11. Asphalt 12. Tar 13. Sealant Implementation Good Housekeeping practices that will be used to reduce the pollutants in storm water discharge associated with industrial activity at the construction site. • An effort will be made to store only enough products required to do the job. • All materials stored on site will be stored in a neat, orderly manner in their appropriate container. • Whenever possible, products will be kept in their original containers with the original manufacturer's label. • Substances will not be mixed with one another unless recommended by the manufacturer. • Whenever possible, all of a product will be used up before disposing of the container. • Manufacturer's recommendations for proper use and disposal will be followed in so far as the methods are in accordance with state and local laws. • The site superintendent or his representative will inspect daily to ensure proper use of materials on site. • Offsite Vehicle Tracking:: Stabilized construction exits will be provided at each location where trucks and vehicles are leaving the project site. The pavement at a construction exit will be cleaned as needed to remove any excess mud, dirt or rock tracked from the site. Dump trucks hauling material from the construction site will be checked for large amounts of soil accumulation on the wheel and chassis. There will be a Vehicle/Equipment washing area adjacent to the construction exit to prevent mud and dirt run off. CADDELL CONSTRUCTION CO., INC. Personnel will be made aware of the procedures and the location of the information and cleanup supplies. • Materials and equipment necessary for spill cleanups will be kept in the material storage area on site. Equipment and materials will include but not limited to brooms, dustpans, mops, rags, gloves, goggles, cat litter, sand, sawdust and plastic and metal trash containers specifically for this purpose. • Spills will be cleaned up immediately after discovery. • Spills will be kept well ventilated and personnel will wear appropriate protective clothing to prevent injury from contact with a hazardous substance. • Spills of toxic or hazardous material will be reported to the appropriate State or local government agency, regardless of the size. • The Storm Water Pollution Prevention Plan will be adjusted to include measures to prevent spill from reoccurring and how to clean up the spill if there is another one. A description of the spill, what caused it, and the cleanup measures will also be included. Subcontractors bringing more than 20 gallons or 150 lbs. of a spillage substance must also designate a cleanup coordinator. The primary cleanup coordinator is ; he will be responsible for the day-to-day site operations. He will designate other site personnel who will receive spill prevention and cleanup training. These individuals will each become responsible for a particular phase of prevention and cleanup. The names of responsible spill personnel will be posted in the material storage areas and in the office trailer on site. CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM Notifications in the Event of a Release to the Environment Construction activities may handle certain hazardous substances over the .course of the project. Spills of these substances in amounts that equal or exceed Reportable Quantity (RQ) levels (10 gallons or more). are a possibility. -EPA has issued regulations -to define reportable, quantity levels for oil and other hazardous substances. The regulations are found in 40 CFR Part 110, 40 CFR Part 117, or 40 CFR Part 302. A Material Safety Data Sheet (MSDS) will be maintained on site for any hazardous material used or stored on the site, • Report releases of reportable quantities of oil or hazardous materials to National Response Center immediately at 800-424-8802. All work conducted within the boundaries of this project must meet regulatory requirements of the generator designation. Management will comply with all provisions of Federal, State and local regulatory requirements applicable to this generator status regarding training and storage, handling, and disposal of all construction derived wastes. Each Hazardous Material will receive approval prior to bringing it onto the job site or prior to any other use in connection with this contract. A minimum of 10 working days for processing of the request, for use of a Hazardous Material, is required. Any work or storage involving hazardous chemicals or materials must be done in a manner that will not expose government employees to any unsafe or unhealthful conditions. Adequate protective measures must be taken to prevent government employees from being exposed to any hazardous condition that could result from the work or storage. Approval by the Contracting Officer of protective measures and storage area is required prior to the start of work. Control and Disposal of Solid and Sanitary Waste. Management will submit one copy of a State permit or license showing approval of the disposal plan before transporting wastes off Government property. . Solid Waste We will pick up solid wastes, and place in covered containers that will be regularly emptied. Caddell will not prepare or cook food on the project site. We will prevent the contamination of the site or other areas when handling and disposing of wastes. At project completion, we will leave areas clean. Recycling will be encouraged and. can be coordinated with the Contracting Officer and the activity recycling coordinator. An approved off -site landfill will be used to remove all solid waste from Government property. Off -site solid waste disposal will comply with the most stringent local, State, Federal requirements including Title 40 Code of Federal Regulations Sections 241, 243, and 258. The Contractor according to. EPA standard practices or according to Manufacturers recommendations will dispose of all fertilizer, hydrocarbons or other chemical containers. No construction waste will be buried on site. Water runoff will be prevented from flowing into and out of waste collection areas. Sanitary Waste A licensed sanitary waste management contractor will regularly collect sanitary waste from the portable units. All collection practices will be in accordance with local regulations. After construction is complete, temporary sanitary facilities will be removed from the site. CADDELL CONSTRUCTION CO., INC. ENVIRONMENTAL PROTECTION PROGRAM Control and Disposal of Hazardous Waste This section consists of the management procedures for all hazardous waste to he generated. The elements of these procedures shall coincide with the Activity Hazardous . Waste Management Plan, provided by the .Contracting Officer.. -Management wilt submit a copy of the applicable EPA and State permits, manifest, or licenses for transportation, treatment, storage, and disposal of hazardous and regulated waste by permitted facilities. As a minimum, the following are included: Waste Determination Management will complete a Waste Determination form, provided at the pre - construction conference, for all contractor derived wastes to be generated. The waste determination will be based upon either a constituent listing from the manufacturer used in conjunction with consideration of process by which wastes are generated, EPA approved analytical data, or laboratory analysis. Material Safety Data Sheets (MSDS) by themselves are not adequate. All support documentation will be attached to the Waste Determination form. As as minimum, a Waste Determination form must be provided for the following wastes: • Adhesives • Aerosols • Latex Based Paint & Caulking Products • Oil • Petroleum Products • Solvents • All containers of the original materials Sampling / Analysis Plan Caddell will identify all construction activities which will generate hazardous waste/debris. We will provide a documented waste determination for all resultant waste streams. Caddell will provide to the Contracting Office a copy of waste determination documentation for any solid waste streams that have any potential to be hazardous waste or contain any chemical constituents listed in 40 CFR 372.D. Hazardous waste shall also be managed in accordance with the approved Hazardous Waste Management Section of the Environmental Protection Plan. Hazardous waste will be stored in approved containers in accordance with 49 Code of Federal Regulations Section 173 and 178. Hazardous waste generated within the confines of Government facilities will be identified as being generated by the Government. Prior to the removal of any hazardous waste from Government property, activity personnel from the Station Environmental Office must sign all hazardous waste manifests. No hazardous waste shall be brought onto Government property. Land Disposal Restrictions (40 CFR 268) If a surplus product must be disposed of, manufacturer's or local and state recommended methods for proper disposal will be followed. The Product Specific Practices and the Spill prevention Practices to be followed are listed in Table 1. Hazardous debris must be treated prior to land disposal unless EPA determines under 261.3(f)(2) of the 40 CFR chapter that the debris is no longer contaminated with hazardous waste or the debris is treated to the waste -specific treatment standard. CFR 279 states that used oil is to be recycled unless a used oil handler:disposes of used oil, or sends used oil'for disposal. Mixtures of used oil and hazardous waste are subject to regulation as hazardous waste rather than as used oil. Used oil containing more than 1,000 ppm total halogens is presumed to be a hazardous waste. Used oils that are identified as a hazardous waste and cannot be recycled must be managed in accordance with the hazardous waste management requirements of parts 260 through 266, 268, 270 and 124 of the 40 CFR. The use of used oil as a dust suppressant is prohibited. ENVIRONMENTAL PROTECTION PROGRAM TABLE 1 Product Specific Practices The. following product specific practices will be followed onsite: Chemical Waste: All chemical waste shall be disposed of in accordance with Camp Lejeune's Waste Analysis Plan. Sampling of suspected hazardous waste is required to determine the hazardous waste characterization of the material. The contractor will notify the contracting officer 1 day before the samples are taken. Petroleum Products: All onsite vehicles will be monitored for leaks and receive regular preventive maintenance to reduce the chance of leakage. Petroleum products will be stored in clearly labeled containers recommended by the manufacturer of the material. Any asphalt substances used onsite will be applied according to the manufacturer's recommendations. Fertilizers: Fertilizers used will be applied only in the minimum amounts recommended by the .manufacturer. Once applied, fertilizer will be worked in the soil to limit exposure to storm water. A covered shed will be used for storage. The contents of any partially used bags of fertilizer will be transferred to a container recommended by the manufacturer of the material to avoid spills. Paints: Containers will be tightly sealed and stored when not required for use. Excess paint will not be discharged to the storm sewer system but will be properly disposed of according to manufacturers' instructions or State and local regulations and the Base Waste Analysis Plan. Concrete Trucks: Concrete trucks will be allowed to was_ h out or discharge surplus concrete or drum wash on the site in a designated controlled area. Upon job completion, soil contaminated by concrete wash water will be removed from the site and taken to an approved disposal area. Recycling: The Contractor will make every effort to recycle metal and paper waste material through the Defense Reutilization and Marketing Office, Camp Lejeune. Pesticides: The Contractor shall apply all pesticides in accordance with the requirements of the Federal Insecticide, Fungicide, and Rodenticide Act, using pesticide approved by the EPA and following the instructions on the manufacturer's label.
