Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 071210MOD, dated June 16, 2010, for the construction of the subject project. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within sixty (60) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. The stormwater runoff from the site will be routed to a wet detention pond operated and maintained by Brunswick STU and Associates, LLC, under the terms and conditions set forth in the latest version of Permit No. SW8 070333MOD. This permit shall be effective from the date of issuance until rescinded, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The runoff associated with this project has been approved to be discharged into Pond #8 of the stormwater management system permitted under SW8 070333MOD. 3. The built -upon area allotted to this development by Stormwater Management Permit No. SW8 070333MOD, is 246,395 square feet. This project proposes 246,395 square feet. There is no built -upon area left for future development. 4. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 5. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. Page 2 of 6 State Stormwater Management Systems Permit Number SW8071210MOD 6. The runoff from the permitted built -upon area must be directed into the permitted stormwater system. II. SCHEDULE OF COMPLIANCE This permit is issued contingent on the construction of the permitted offsite stormwater treatment facility being complete and in compliance with the conditions of permit number SW8 070333 MOD, issued to Brunswick STU and Associates, LLC on June 16, 2010, and as subsequently revised, modified, or renewed. Prior to the construction of any built -upon area associated with this permit, the offsite permittee shall have constructed, operated, maintained, and certified the offsite stormwater management system in compliance with SW8 070333MOD. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee is responsible for keeping the stormwater collection system on the Town Creek Elementary School property clear of debris, and keeping the site stabilized in accordance with the requirements of the NC Erosion and Sediment Control Design Manual. 4. Brunswick STU and Associates, LLC, shall, at all times, provide the operation and maintenance necessary to assure the permitted stormwater management system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 5. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the maximum approved amount of built -upon area. e. Further subdivision, acquisition or selling of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Fiiling in, altering, or piping of any vegetative conveyance shown on the approved plan_ 6. The Director may determine that other revisions to the project should require a modification to the permit. 7. A plan revision with layout and grading plans must be submitted to and approved by the Division prior to the construction of any future development areas on the lot. This permit shall be voided unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 9. The permittee is responsible for providing, prior to issuance of a Certificate of Occupancy„ a certification that the facility permitted under this permit has been constructed in accordance with the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 11. This lot is limited to the amount of built -upon area indicated in this permit, the supporting calculations and per the approved plans. The project must have a built - upon area less than or equal to the amount permitted under Stormwater Permit No. SW8 070333MOD. 12. Brunswick STU and Associates, LLC, must record any deed restrictions as required by their permit, and they must verify that the proposed built -upon area does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from Brunswick STU and Associates, LLC, and the Division of Water Quality. 13. The drainage features shown as a part of the stormwater management system on the approved plan shall not be filled in, altered, or piped by any party without first submitting a revision to the permit and receiving approval from the Division. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the Permittee or of the projectr, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change form to the Division of Water Quality accompanied by documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all terms and conditions of this permit until such time as the Director approves the permit transfer. Neither the sale of the project area nor the conveyance of common area to a third party constitutes an approved permit transfer. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of water Quality, in accordance with North Carolina %eneral Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. In the event that the offsite stormwater facilities fail to perform satisfactorily, including the creation of nuisance conditions, Brunswick STU and Associates, LLC, is responsible for taking immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants permission for DENR Staff to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 16th day of June, 2010. SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ). A complete package includes all of the items listed below. The complete application package should be submitted to the appropriate DWQ Office. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. As the property owner, it is my responsibility to notify DWQ immediately and submit a completed Name/Ownership Change Form within 30 days; otherwise I will be operating a stormwater treatment facility without a valid permit. I understand that the operation of a stormwater treatment facility without a valid permit is a violation of NC General Statue 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $25,000 per day, pursuant to NCGS 143-215.6. There was indeed an obstruction in the storm drain about 200 feet downstream from the catch basin in question beside the pond. The contractor was not able to identify what the obstruction was since he was using a vacuum instead of a flush truck. However, it was enough to cause refusal in the line and had to be rodded out. The pipes now drain freely. I am not sure where we go from here. Hopefully, the blockage was the reason that the system did not function properly and there will be no more flooding of the roadway. However, in those instances where there is in excess of a 10-year storm, we still would not want to create a traffic hazard. I would love to meet with you and Linda, if she is the one who will make the final decision, to review our options. We obviously would prefer to leave the emergency outlet where it is, though we would definitely stabilize the surface to prevent any erosion into the pond. There is also the option of cutting an emergency spillway behind the catch basin on the other side of the road and routing the overflow back into an existing ditch located approximately 150' from the catch basin. We could possibly even cut out these last two catch basins from the existing permit and convert the flow to low density, although that would mean once again revising three permits, as well as requiring the catch basins and pipes to be blocked or removed. I honestly believe that there are several common sense solutions that will serve to protect the waters of the state. Let me know what our next step needs to be. The first one inch of rainfall runs into the pond through the piped stormwater collection system and is stored in the pond up to a temporary pool of 24.08 feet. In order to meet Brunswick County's stormwater ordinance, the additional volume produced by the increase in post development runoff over predevelopment runoff is also piped to the stormwater pond and stored at an elevation up to 24.21 feet. The reason for the cut through the shoulder is that there have been several storms over the past year that exceeded the 10 year storm intensity, causing water to pond in the roadway. Without some type of emergency relief, stormwater could pond at least a foot deep in the roadway, making travel extremely dangerous, especially during peak traffic from the adjacent school. Please note that this is not a curb cut, but a cut in the shoulder acting as an emergency outlet. The elevation of the top of curb at this overflow is 24.83 feet, more than seven inches above the temporary pool elevation required by Brunswick County, and nine inches above the temporary pool elevation required by the Division of Water Quality. I believe that allowing this emergency overflow through the shoulder allows us to meet both state and local stormwater runoff requirements, while avoiding a condition that seriously floods the roadway. 2. I agree that there are a few eroded areas along the slope of the pond that are in need of repair, though all of those areas appear to have been eroded earlier in the construction process and do not show signs of fresh erosion. The owner will have his landscaper go in and repair the worst areas, but in most cases the areas in question now have vegetation growing. As noted on the certification, modifications to the sidewalk and parking layouts during construction resulted in 1,728 sf of additional BUA (1,043 sf of sidewalks and 685 sf of asphalt parking), an increase of approximately 0.3% in total impervious area (40.5%). To account for this change during construction, enclosed for your review and approval is a plan revision package for Town Creek Elementary School. The package includes a revised Site Plan, revised Grading Plan, and calculations confirming that the existing pond is capable of managing the increase in stormwater runoff Additionally, included are revised copies of the Stormwater Application and Pond Supplement.
