The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Winding River POA Clubhouse on January 30, 2007. Staff review of the plans
and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No.
SW8 990453 dated January 30, 2007, for the construction of the subject project.
This permit shall be effective from the date of issuance until January 30, 2017, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result In
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

FOR THE
construction, operation and maintenance of an onsite wet detention pond and the for
the construction of impervious areas to be treated in an offsite wet detention pond,
permitted under SW8 970936, in compliance with the provisions of 15A NCAC 2H
.1000 (hereafter referred to as the "stormwater rules') and the approved stormwater
management plans and specifications and other supporting data as attached and on file
with and approved by the Division of Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until January 30, 2017, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. The onsite stormwater system has been approved for the management of
stormwater runoff as described in Section 1.7 on page 3 of this permit. The
stormwater control has been designed to handle the runoff from 50,712 square
feet of impervious area.
3. The offsite stormwater system, which was approved under SW8 970936, has
been approved for the management of stormwater runoff as described in Section
1.8 on page 3 of this permit. The stormwater control has been designed to handle
the runoff from a total of 237,576 square feet of impervious area. A total of
40,000 square feet of built -upon area has been allocated under the offsite facility
permit for the treatment of a portion of the runoff from this project. This project
proposes to direct the runoff from a total of 39,438 square feet to the offsite wet
detention pond.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. The built -upon area for the future
development is limited to 562 square feet.

5. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
The onsite and offsite stormwater management systems shall be constructed in
their entirety, vegetated and operational for their intended use prior to the
construction of any built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted onsite stormwater system functions at
optimum efficiency. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the scheduled intervals
including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
q. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The offsite stormwater facility shall be maintained at design condition by J. Mark
Caldwell and Clearwater Capital, LLC, under the terms and conditions of the
latest version of permit number SW8 970936.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is listed in Section
1.6 (1) of this permit.

9. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
10. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
11. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
12. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
13. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
14. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change.form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.

3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, out parcels and future development prior to sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built upon area for each lot must be provided as an attachment.
The following covenants are intended to ensure ongoing compliance with state management permit
number as issued by the Division of Rater Quality. These
covenants my not be changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or
impervious materials. Impervious materials include asphalt, gravel, concrete, brick; stone, slate or
similar material but do not include wood decking or the water surface of swimming pools.
3. Swales shall not be filled in, pipecl or altered except as necessary to piovide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit
modification prior to construction.
5. All permitted runoff f •om out parcels or f ture development shall be directed into the permitted
stormwater control system. These connections to the stormwater control system shall be performed
in a manner that maintains the integrity and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable item required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted

Overall, I agree with your plan of action. My comments regarding the information
needed for each of the submittals is outlined below each of your reponses:

Based on your recommendation in a letter dated January 3, 2007 to William Dorn,
registered agent of Stonebridge Carolina Homes, LLC, an agreed plan of action
with all parties involved has been determined.
1. ESP will apply for a modification to the existing stormwater permit no.
SW8 970936 with Clearwater Capital, LLC as the applicant and true owner of the
Clearwater Townhomes pond. The total impervious surface area allowed will remain
at the previously permitted area of 222,330 square feet. As you already know the
existing pond has not been certified by the design registered engineer and is
now requiring a modification. ESP conducted an as -built on the existing pond.
After review of the as -built, we found that the pond surface area exceeds the
required area, but is not the same as the permitted surface area. Same is true
for the storage volume required and provided. Therefore, triggering the
modification requirement. At the same time the permittee will be changed from
Clear Water Place, Inc. to Clearwater Capital, LLC.
The application for Clearwater Capital, LLC, will be a modification to 970936 and
will need to list the individual BUA's for Phase I, Phase II and the Clubhouse
separately (i.e., one column for each on the application). These are considered
"offsite" projects since they are under different ownership. A revised, signed,
dated and notarized wet pond supplement form is required. The previously permitted
222,330 sq. ft. will need to be revised to account for the mailbox area that was
added without approval and the BUA from the clubhouse that is draining to this
pond. The total BUA (the total of the 3 separate columns) to be listed on the
application , should be 237,576.
2. ESP will apply for an off -site stormwater permit for the existing Phase I
of Clearwater Townhomes with Clearwater Place Condominium Neighborhood
Association, Inc. as the applicant/owner.
Please indicate on the application that it is a new offsite permit, not a
modification to 970936, since that number will remain with the pond and be
permitted to Clearwater Capital, LLC. Please reference the 970936 permit as being
the "offsite" system that will serve Phase I and provide a completed application
and offsite supplement. The application should list the BUA associated with Phase I
only.

This application has already been received and is waiting on the permit ownership
issues at Clearwater to be resolved before issuing.
4. James W. Huggins will apply for an off -site stormwater permit for Phase II
of Clearwater Townhomes with Stonebridge Carolina Homes, LLC as the
applicant/owner.
Again, please indicate this as a new permit and not a modification, but referencing
the 970936 permit as the offsite treatment system that will serve Phase II. Please
provide a completed application and offsite supplement. The application should list
the BUA associated with Phase II only.

acceptable resolution to this complicated project. we anticipate submitting
items 1 and 2 to you Friday, January 19"th if this is a satisfactory solution.

Essentially, I cannot knowingly write a permit for Clearwater Place
Townhomes to Bluegreen Carolina since they do NOT own the pond.
Apparently, Stonebridge Homes, which is the developer for Phase 2 of
Clearwater Townhomes, bought the Phase 2 property AND the pond property.
They were completely unaware of the existing stormwater permit for
Clearwater. So, I advise that Stonebridge Homes continue with their
application for Phase 2 of Clearwater showing Phase 1 of Clearwater and
the POA Clubhouse as "Offsite" projects.
Bluegreen will need to amend their current application to an offsite
project to cover Phase 1 of Clearwater.
The POA Clubhouse doesn't have to do anything until the mess at
Clearwater is resolved.
Hard copies of the attached letter will be sent out today.

Dear Linda:
This letter is in response to your comment letter dated September 25, 2006 (copy attached). I
appreciate your timely comments and hope I have answered all questions in this letter. My
responses are numbered the same as your comments for your reference.
Additional storm inlet and piping has been added to transport the runoff from the
existing impervious area within drainage basin "B" and "C" to the detention pond
for treatment. The pond calculations, the post developed basin map, page 2 of
the permit application and page 1 of the wet detention basin supplement has
been revised to reflect the addition of the existing impervious area and are
attached for your review.
2. Basin "C" and the portion of Goley Hewett Road you referrer to does not drain to
the proposed onsite pond.
3. Storm drainage structure #2 is a Manhole and does not collect run-off, I have
revised the plan to indicate that this is a Manhole.
4. 1 have revised the detail on the plan to indicate that the pond's outlet orifice is to
be 1.2".
5. 1 have revised the wet detention pond calculations, to use the correct SA/DA
number of 3.8, the results reduced the ponds required surface area to 3443 sq.ft.,
but this has no effect on our design because we are providing a surface area of

The Wilmington Regional Office received a modified Stormwater Management Permit
Application for Winding River HOA Clubhouse on August 23, 2006. A preliminary review of that
information has determined that the application is not complete. The following Information is
needed to continue the stormwater review:
1. The application indicates that drainage area B/C contains concrete area that is
not being picked up and directed to the onsite pond. All existing and proposed
built -upon area must be picked up and directed to a pond.
2. The runoff from that portion of Goley Hewett Road within drainage area "C" is not
required to be picked up and treated by the onsite pond. I believe the Master
Permit indicated that this is being treated via a curb outlet swale.
3. The structure labeled as SD Inlet #2 appears to be a Manhole. If this is labeled
correctly as an inlet, then runoff from Goley Hewett Road will be entering the
piped collection system to the onsite pond. Please correct if labeled incorrectly.
4. The calculations and supplement report a 1.2" 0 orifice, but the pond outlet detail
shows only a 1" orifice to be drilled into the plug. Please revise the detail and
submit 2 copies of the revised plan sheet.
5. Please check the SA/DA tables you are using. The SA/DA ratio for a 53%
impervious site, 5.0 deep pond, no vegetated filter (90% TSS), is 3.8%, not 5.4%.
1 have enclosed the SA/DA tables that the Division uses for your convenience.
6. The offsite facility, Clearwater Place, has not yet submitted their permit
modification. Unfortunately, I will have to hold off on issuing this permit until -the
modified Clearwater Place permit has been issued and the pond has been
certified.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to October 25, 2006, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.

This letter is response to your comment letter dated June 16, 2006 (copy attached) and to
address recent changes on the project.
Your June 16, 2006 letter requested the Form SWU-106 be signed and notarized. This is
attached.
Based on some recent site changes dictated by the client we are also sending two sets of
modified plans, stormwater calculations and narrative. These changes only slightly affect the
original documents that were submitted. We have modified the application to reflect site
changes and are submitting the affected pages of the application.
The off -site SWM pond is modifications associated with Clearwater Place are being handled
by ESP Company (Larry Sneedon). They will make a submittal soon.
Hopefully, the on -site plans and calculations will provide you with everything you need to
permit this project (sans off -site permit modifications).

DESIGN NARRATIVE
Existing Site
The proposed project site is 4.49 acres of land, located in Brunswick County at 1640 Goley
Hewett Road SE. The site is located on the northwest comer of Goley Hewett Road SE (SR
1251) and Zion Hill Road (SR 1114). The property has approximately 660' feet of frontage on
Goley Hewett Road SE and 130 feet of frontage on Zion Hill Road
The existing site is made up of one tract of land that is currently developed with a home owner's
association clubhouse facility complete with a clubhouse, parking area, tennis courts and a
swimming pool facility. The total existing impervious area is 46,566sf. The site is accessed from
Goley Hewett Road by an existing improved driveway. The site is bounded on the north
eastern side by
Sandy Branch
Creek.

The remainder of the site is planted grass and landscaping shrubbery.
The Brunswick County SCS Soil Survey indicates that the property's soil is made up primarily of
two soils types. The western portion of the site consists Blanton (BnB) and the eastern portion
of the site consists of Kureb (KrB) soils. A small sliver of Muckalee occurs along the
northeastern portion of the site but is excluded from the scope of this project. Blanton series
consists of moderately well drained soils on uplands. Water tables in this soil type typically
occur at approximately 4 — 5 feet. Kureb series soils consists of excessively drained soils on
uplands. Water tables in this soil type typically occur at greater than 6 feet.
Wetlands were discovered on site during due dliegence. The wetlands were delineated by ECS,
Ltd and verified by Jennifer Frye of the US Army Corps of Engineers. A copy of the
Jurisdictional Determination is included with this report.
Proposed Improvements
The proposed development will consist of 14,040sf building addition, an additional 27,171sf
asphalt paved road and parking areas, and 8,559sf of concrete walks and patios. The Club
house, Concrete walks, tennis courts and pool deck and the existing asphalt driveway and
parking will remain and be incorporated into the proposed design. The total of these existing
impervious areas is 46,500sf, with the proposed 27,171sf of impervious; the sites total
impervious area is 96,270, which is 49% of the 4.49 acre site. The project is high density and
will require an engineered stormwater manage system. The stormwater management system
will provide attenuation for the pre/post 10 year storm and treat the 1 inch runoff before
discharging offsite. Attenuation and treatment of the 1 inch runoff will be done in a wet
detention pond.

The Wilmington Regional Office received some of the previously requested information
regarding the pending modified Stormwater Management Permit Application for Winding River
HOA Clubhouse on June 6, 2006, late in the afternoon. A preliminary review of that information
has determined that the application is not complete. The following information is needed to
continue the stormwater review:
Please revise the pond section detail to show the forebay wall at elevation 22.75
with a weir cut at elevation 22.
2. A signed offsite supplement form, SWU-106, is required for this project. The old
one was signed by David Edwards as the previous permittee for this project, and
can no longer be used.
3. 1 may have missed this in the first review, but the outlet structure detail shows
that there is no outlet at elevation 22.75, which is the specified design pool
elevation. Additionally, the calculations show that the average head being used
to size the orifice is one-half of .62'. This is not correct. The average head should
be based on''/z the distance between the permanent pool and the design pool.
The supplement indicates that the design pool is 22.75 however, the outlet
structure detail does not provide an outlet at elevation 22.75. It goes all the way
up to elevation 23.50. Since there is no outlet at 22.75, the design pool elevation
should be reported on the supplement as 23.50, and the average head to be
used for sizing the orifice would be '/z of the distance between 22 and 23.50. If
you provide an outlet at elevation 22.75, then the design pool to be reported on
the supplement is 22.75, and the average head is 'h the distance between 22
and 22.75. If you keep the design pool at elevation 23.50, the 1" orifice will drain
the pond in just over 2 days, still within the allowable range. Please advise as to
which direction you will take.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to June 30, 2006, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The

This letter is response to your comment letter dated June 2, 2006 (copy attached). I
appreciate your timely comments and hope I have answered all questions in this letter. My
responses are numbered the same as your comments for your reference.
1. The necessary letter of authorization from the HOA vice president authorizing Mr.
Stonestreet will be forwarded under separate cover.
2. A section detail of the pond has been added to the plan; the forebay is
indicated in this detail.
3. The pond has been revised, the wall between the forebay and the pond has
been reconfigured, the overflow portion of this wall is now located toward the
eastern side, increasing the flow path to 3:1.
4. The as -built survey reviled that the tennis courts were constructed to drain toward
the north, the spot elevation picked up by the survey are included on the revised
plan.
5. The calculation's labeling on the basin has been revised to read "Onsite Basin"
which is consistent with the application and plan labeling.
6. The area that drains to the pond is only 2.16 acres, where are 2 onsite sub -basins
that do not make it to the pond and drain to the wetland then offsite toward the
northeast, these areas should not have been included in the Onsite column of
the application form. The application form has been revised; an additional
column has been added to account for these 2 sub -basins. The drainage map
has been revised in the some manner.
7. An updated supplement form should not be necessary now that the letter of
authorization from the HOA vice president authorizing Mr. Stonestreet will be
provided and our response to comment 6 indicates that the numbers used on the
supplement are correct.

8. The vicinity map has been revised to insure that major roads are indicated.
9. We understand that resolution of the Clearwater Place certification will have to
be addressed prior to you issuing the permit for Winding River HOA Clubhouse

The Wilmington Regional Office received a modified Stormwater Management Permit
Application for Winding River HOA Clubhouse on June 1, 2006, late in the afternoon. The
scheduled Express Review date was June 1, 2006, however, due to the late arrival of the
application, it was not reviewed until June 2, 2006. A preliminary review of that information
has determined that the application is not complete. The following information is needed to
continue the stormwater review:
For corporations, per Section .1003(e) of the stormwater rules, the signature of a
principal executive officer of at least the level of vice president is required. Your
signature as an authorized representative of the HOA can be accepted only if a
letter of authorization from the vice president of the HOA is submitted.
Please include the forebay in the onsite pond section detail.
In the onsite pond's current configuration, the flow path from forebay to outlet
structure needs to be lengthened to achieve a 3:1 length to width ratio. Please
raise the forebay wall to the temporary pool elevation, leaving an opening at the
permanent pool elevation for the runoff to exit the forebay on the eastern most
end.
4. Please provide the existing elevations for the tennis courts. In the previous
permit, one-half of the tennis court area was supposed to be draining into the
offsite pond, however, this modification has the entire tennis court area draining
to the new pond.
5. The calculations are labeled as being for Basin #1, which I am assuming is the
column marked "On Site" in Section 111.6 of the application. Please maintain
consistent labeling throughout the plans, calculations and application.
The application indicates that the onsite pond drainage area is 3.49 acres and
the onsite built -upon area is 55,934 square feet, or 1.28 acres. The pond sizing
calculations, however, use a drainage area of only 2.16 acres, and a built -upon
area of only 1.08 acres. The supplement also uses these same numbers. These
differences may result in a deficient pond volume. Please account for these
discrepancies.

pop up during the certification process, which will be addressed via a
permit modification to be submitted later. Unfortunately, I will have to hold
off on issuing this permit until the modified Clearwater Place permit has
been issued and the pond has been certified.

I figured out that somehow the offsite BUA for the clubhouse got incorporated into
the totals for Clearwater Place. So, I went back into the files and applications
and separated out the numbers. I've attached a revised "Data Sheet" for Clearwater
with the offsite BUA and DA's split out.
In the Clubhouse permit, the actual BUA's dont' break down the same way, but the
total is below what was permitted.

Bluegreen Carolina Land, LLC is in receipt of the subject Compliance
Inspection Report and has requested that I respond to you. We received the
letter of violation on June 11, 2003. This project is dependent on the
Clearwater Place Condominium project, SW8 970936, and will be done
concurrently with that project. The plan for addressing the compliance issues
is detailed below with the expected completion date in parentheses.
(1) Repair the side slopes (August 8)
(2) Stabilize with the appropriate grass. (August 8)
(3) Construct the outlet structure with trash rack according to the
approved plans (August 15)
(4) Revise the stormwater plan and calculations, if necessary, to include
the mailbox area and submit to DENR (August 15)
(5) Submit the designer's certification (August 29)
