The Wilmington Regional Office received a modification to the Stormwater Management Permit Application for
Carolina National @Winding River on September 10, 2001. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000. We are forwarding this modification to Permit No. SW8 961109 Modification, dated October 30, 2001,
for the construction of the project, Carolina National @Winding River.
This permit shall be effective from the date of issuance until October 30, 2011, and shall be subject to the conditions
and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements
in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management
system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page
3 of this permit, the Project Data Sheet. This low density subdivision is permitted for the following built -
upon area limits: 425 lots with 5,000 ftz; 341 lots with 8,000 ft2; 264 lots with 6,500 ft2; 6.32 acres for multi-
family; 70.99 acres in commercial development, Tract H with 13 lots @3,400 square feet each, roads,
clubhouse, amenities, maintenance and W WTP facility. See the development data tables on the 10-30-2001
approved Master Plan for specifics.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts
of the permit.

II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's
intended use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
3. The permittee grants permission to DENR Staff to enter the property for the purposes of inspecting the
project for compliance with the conditions of this permit.
4. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature or curb outlet swale
shown on the approved plans as part of the stormwater management system without submitting a revision
to the permit and receiving approval from the Division. Curb outlet swales must be maintained at a
minimum of 100' long, with vigorous grass cover, and 5:1 side slopes.
5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval
from the permittee, and responsibility for meeting the built -upon area limit is transferred to the individual
property owner.
The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
7. The Director may determine that other revisions to the project should require a modification to the permit.
The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.
9. All stormwater collection and treatment systems must be located in either dedicated common areas or
recorded easements. The final plats for the project will be recorded showing all such required easements,
in accordance with the approved plans.
10. If an Architectural Review Committee (ARC) is required to review plans for compliance with the BUA
limit, the plans reviewed must include sidewalks and driveways. Any approvals given by the ARC do not
relieve the homeowner of the responsibility to maintain compliance with the permitted BUA limit.
11. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of
this permitted facility, the attached completed certification must be received from an appropriate designer
for the system installed certifying that the permitted facility has been installed in accordance with this
permit, the approved plans and specifications, and other supporting documentation. Any deviations from
the approved plans and specifications must be noted on the Certification.

12. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
13. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of
recording the plat, and prior to selling any lots. The recorded copy must be signed by the permittee, dated,
stamped with the deed book number and page, and bear the stamp/signature of the Register of Deeds.
14. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
of ten years from the date of the completion of construction.
15. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited
to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, swales, catch basins and piping.
g. Access to the outlet structure must be available at all times.
16. The permittee shall keep written records of maintenance activities and make them available upon request
to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing
the work and what actions were taken.
17. Prior to the sale of any lot' the deed restriction statements below must be recorded. The built -upon area per
lot must be limited to the amount as shown in Section I, Part 2. The recorded statements for each Tract as
shown on Attachment 1 must follow this form. The blank in statement (a) must be filled in with the
appropriate BUA limit as shown on Attachment 1 and on the approved plans.
a. The maximum built -upon area per lot is , inclusive of that portion of the right-of-way between
the lot line and the edge of pavement. Built -upon area includes, but is not limited to, structures,
pavement, parking areas, concrete, gravel, brick, stone, slate, and coquina, but does not include open
wood decking or the water surface of swimming pools.
b. The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State.
C. Alteration of the drainage as shown on the approved plan may not take place without the concurrence
of the State.
d. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their
allowable built -upon area due to CAMA regulations.
e. All areas within the drainage area of a wet detention pond must be graded to drain into the
appropriate permitted stormwater treatment system. Drainage from outside of the approved drainage
area will require a•permit modification.
18. Unless specified on the approved plans, the seeding requirements for this project shall conform to the latest
edition of the NC Erosion and Sediment Control Planning and Design Manual.

III. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request form must be submitted to the Division of Water
Quality accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved. Until such time as the transfer is approved by the Division, the permittee is responsible
for maintenance of the approved stormwater management facilities.
Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
6. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days.

Based on how the proposed impervious is scattered around the site, and that Tract H is located away from the water,
J can say that low density is a possibility. In order to permit as low density, you will need complete grading plans
which show the sheet flow and swale drainage, and which demonstrate that no points of concentrated discharge are

Based on how the proposed impervious is scattered around the site, and that Tract H is located away from the water,
I can say that low density is a possibility. In order to permit as low density, you will need complete grading plans

Dear Ms. Lewis:
We have been asked to provide design services for Tract "H" within the Winding
River Plantation project area. We have reviewed the files on -hand within the
DWQ office and would like confirmation on a stormwater issue. It is our
understanding that the entire project area, as depicted in the overall master plan,
is as a low -density project. As such, interior pockets of high density, such as
Tract "H", can occur within the confines of the larger overall tract providing low -
density design features are adhered to (i.e. no piped collection system).
Currently, Tract "H" is listed on the master plan as 2.83 acres with an allowable
built -upon area (BUA) of 2.7 acres.
It would appear that, based on the findings, that a storn water pond or other high
density -type feature will not be required for the design providing the design does
not exceed the allowable BUA and low -density features are incorporated.
We ask that a confirmation memo be forwarded regarding the above issues in
order to proceed with the project. As our client hopes to close on the property
shortly, a timely response would be greatly appreciated.

The intent of the permit is to maintain low density on an overall basis. Single family areas need not provide
engineered controls, while interior pockets of high density development must utilize engineered systems. It is
possible that some interior development can meet low density requirements by providing sheet flow over 30' wide
grassed areas, by spreading out the 13UA on the tract, and not having a collection system. The location of the tract
is also a determining factor. For example, if it was adjacent the water, we would certainly require an engineered
system.
The best thing to do is to send a sketch plan in and let us review it.

Dear Jason:
There appears to be a lot of confusion concerning how and what to submit for this very large and complex project.
The Division has already permitted a Master Plan, SW8 961109. Under that Master Plan various control measures
For developed tracts, parcels and sections were shown and approved. Additionally, the undeveloped parcels and
tracts were identified and assigned a maximum built -upon area based on the type of development. So far so good.
The confusion comes about when the built -upon area assigned to a parcel or tract is changed from what was
approved under the Master Plan.
In cases where the proposed built -upon area that was originally assigned by the Master Plan increases or decreases,
Please submit TWO complete but separate application packages - one for the Master Plan only and one for the
individual tract, section orparcel that causes the modification. The two applications will be handled under ONE fee.
The modified tract, section or parcel will be assigned a separate project number for tracking purposes, and issued
a separate permit. At the same time, the modification to the Master Plan permit will be reissued under the original
permit number. Substantial increases in 13UA adjacent sensitive waters may or may not be approved.
In cases where the permitted built -upon area for an undeveloped tract, section or parcel will NOT be modified from
what was approved under the Master Plan, you need only submit a set of grading and dimension plans for that tract,
section or parcel and a cover letter. The cover letter should reference the Slate's Master Plan Permit Number and
provide a comparison of the approved and proposed 13UA which should be less than or equal to the original 13UA
permitted under the Master Plan. In these cases, THI-RE' IS NO FEE' OR APPLICATION REQUIRE']). The
Division will verify the grading and total built -upon area and issue a short letter indicating that the plans are
acceptable and that the owner trust add the stamped set of approved plans to the approval set.
A modification to the Master Plan was received on August 16, 2000, to accommodate Sections S-1 and S-2. On
September 19, 2000, I requested via facsimile, that an offsite supplement be completed and submitted forthe portion
of Section S-1 that was draining to one of the ponds approved under SW8 990201 (Phase III of Winding River).
To date, the supplement has not been received. The application to reduce the 13UA for Section Q will be assigned
a different project number and the Master Plan permit will be reissued at the same time, however, I also need to have
a completed application for the Master Plan only and two sets of revised Master plans. NO ADDITIONAL Pf:E' IS
REQUIRED. The Master Plan modification will be handled under the fee already submitted for Section Q.

Project Number: SW8 961109 Control Measure: 25% low density with curb outlet
swales and wet detention ponds for high density areas.
Water Body: Lockwoods Folly River Classification: SC 1-1QW
Directions to site, address: From Hwy 21 1 from Southport, turn left onto Zion Hill Road (NCSR
1114). Subdivision is located on both sides of Zion Hill and Goley Hewett
Road (NCSR 1251).

3 Compliance Issues:
a. A copy of the recorded deed restrictions for the single family lcw density portions of the
subdivision have not been submitted.
b. Access to portions of the subdivision is limited by gates, which require a card to open.
Required Actions:
a. Please submit a copy of the recorded deed restrictions.
b. Please provide information on how the State can access all areas of the subdivision. While
scheduled inspections would be nice, it is not always possible to let you know we're coming.
