All previous references to DWQ will remain in older stormwater permits issued prior to .August 1,.2013 until they are modified. Please note that this modified permit now references DEiMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete; modified Express Stormwater Management Permit Application for Beaufort Spring on June 14, 2017. Staff Express review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2111000. We are forwarding modified permit No. SW8 121019, dated June 21, 2017, for the construction, operation and maintenance of the BVtP's and built - upon area associated with the subject project. The modifications covered by this permit include the reallocation of the 141,846 sf or permitted BUA between Lot 1 and Lot 2. The permittee will submit a request to transfer the permit to Beaufort Spring Housing Associates, LLC upon receipt of this modified permit. This permit shall be effective from the date of issuance until January 10, 2021, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the BMP's, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the Stormwater management system, to record deed restrictions, to limit BUA, to certify the BMP's, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. Beaufort Spring US Hwy 70, Beaufort, Carteret County FOR THE construction, operation and maintenance of one (1) constructed wetland, within ''/z mile of and discharging to SA waters, in compliance with Session Law 2008-211 and the provisions of 15A NCAC 2H .1000 (hereafter, the "storm water rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources (hereafter, DEMLR or Division) and considered a part of this permit. This permit shall be effective from the date of issuance until January 10, 2021 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The subdivision is permitted for 2 lots, each limited to a maximum amount of built - upon area as indicated in Section 11.14 (f) of this permit. 3. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.10 of this permit. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater wetland has been designed to treat the runoff from 141,738 square feet of built -upon area. The maximum built -upon area allowed for the entire subdivision is 141,846 square feet. Of this amount, 141,738 square feet will drain to the stormwater wetland and 108 square feet of sidewalk will drain to the infiltration area/stilling basin to obtain settling prior to being discharged. Direct discharges to SA waters are not allowed. Swale discharges from the design storm must either be infiltrated or diffused at a non -erosive velocity into the vegetated buffer or other natural area. The vegetated buffer or natural area must be capable of providing effective infiltration of the runoff from the design storm. The infiltration area/stilling basin will provide effective infiltration for the runoff from the 108 square feet that cannot drain to the stormwater wetland. The drainage area will be limited to the amount of built -upon area indicated in Section 11.14 of this permit, and per approved plans. The built -upon area for the future development draining to the stormwater wetland is limited to 54,339 square feet. A 50' wide vegetative buffer must be provided adjacent all surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. The volume in excess of the design storm must flow overland through a level spreader and 50 foot vegetative filter strip, designed per NCAC 2H.1008 (0 to pass the peak flow from the 10 year storm in a non -erosive manner. The stormwater wetland design storm must discharge to a level spreader and filter strip capable of providing effective infiltration per SL2008-211, Section 2(b), (1)(c)(2). 9. Prior to the discharge of stormwater runoff from any lot into the approved stormwater system, the permittee shall ensure that the owner of the lot has obtained a separate Offsite Stormwater Management Permit. 10. The following design criteria have been approved for the constructed wetlands stormwater facility, and must be provided in the system at all times: a Drainage Area #1, acres: 5.93 Onsite, ft2: 258,311 Offsite, ft2: 0 b. SCHEDULE OF COMPLIANCE The stormwater management system shall be entirely constructed, vegetated and operational for its permitted use prior to the construction of any built -upon surface. 2. The facilities shall be constructed, operated and maintained in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 3. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 121019, as issued by the Division under NCAC 02H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. The maximum built -upon area per lot is 54,339 square feet for Lot 1 and 87,507 square feet for Lot 2. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area is defined in NCGS 143-214.7. g. All runoff from the built -upon areas on the lot must drain into the permitted system. This may be achieved by piping or grading. h. Built -upon area in excess of the permitted amount will require a permit modification. j. All affected lots shall maintain a 50' wide vegetative buffer adjacent to all surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. k. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the Stormwater Rules is subject to enforcement procedures as set forth in NCGS 143, Article 21. I. Each lot within the subdivision whose ownership is not retained by the permittee, must submit a separate Offsite Stormwater Management Permit application package to the Division and receive a permit prior to any construction on the lot. 4. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 5. The permittee shall review all individual proposed and modified lot plans for compliance with the conditions of this permit. The permittee shall not approve any lot plans where the maximum allowed built -upon area has been exceeded, or where revisions to the grading or to the storm drainage system are proposed, unless and until a permit modification has been approved by the Division. The permittee is responsible for the routine monitoring of the project to assure continued compliance with the built -upon area limits, grading and storm drainage system established by this permit, the permit documents, the approved plans and the recorded deed restrictions. The permittee shall notify any non -compliant lot owner in writing and shall require timely remediation of the non-compliance. 7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. All stormwater runoff collection and control measures must be contained within either a public right-of-way, dedicated common area or recorded easement. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 11. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further development, subdivision, acquisition, or sale of any, all or part of the project area as reported on the application documents. d. Altering, removing, regrading, relocating, or resizing of any component of the approved stormwater runoff collection system and/or the approved stormwater BMPs. e. The construction of built -upon area within any permitted future development areas shown on the approved plans. f. The construction of permeable pavement, areas of #57 stone, or public trails for BUA credit. g. Any other revisions as determined by the Director. 12. The permittee shall provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at design condition. The approved Operation and Maintenance Agreement is incorporated by reference into this permit and must be followed in its entirety and maintenance must occur at the scheduled intervals. 13. Records of maintenance activities must be kept by the permittee. The records will indicate the date, activity, name of person performing the work and what actions were taken. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 121019 14. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR personnel. The project and the stormwater facility must be in substantial compliance with all permit conditions. Any items not in substantial compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. III1115c7A.1=1:7n\wKeffik,I This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Permit Transfer Application Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy, d. Foreclosure, subject to the requirements of Session Law 2013-121, e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6-07, 2. The permittee shall submit a competed Permit Update Form to the Division within 60 days of any one or more of the following events: a. A name change of the current permittee; b. A name change of the project; c. A mailing address change of the current permittee; 3. The permittee is responsible for compliance with all permit conditions until the Division approves a request to transfer the permit. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. 4. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit is subject to enforcement action by the Division in accordance with NCGS 143 Article 21. 5. The issuance of this permit does not preclude the Permittee from complying with all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 6. If the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permittee grants DEMLR Staff permission to enter the property during normal business hours to inspect all components of the permitted stormwater management facility. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. The permittee shall maintain a copy of the permit, O&M agreements, and the approved plans on file. 11. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 12. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Permit modified and reissued this the 215t day of June 2017. All of the BUA numbers on the application, EXCEPT for the Future allocation (for Lot 1) should be attributed to Lot 2, which is deed -restricted to a total of 87,507 sf. This amount includes the 108 sf of BUA being treated in the small stilling basin. Subtract 108 from 87,507, in order to determine how much of Lot 2 BUA is treated in the wetlands - 87,399 sf. So, the BUA numbers in Drainage Area column #1 need to add up to 87,399. However, the breakdown of that 87399 sf as indicated on the revised application page 3 of 6 received on June 1.4, only adds up to 86,925 sf. You've listed the future BUA amount for Lot 1 as 54,813 sf, but the current deed -restricted BUA for Lot 1 is 54,339. You should correct that on the application and add that 474 sf difference to the 20,625 Other amount, so that is becomes 21,099 sf. In addition, you have not listed any amount for street, but there is a fairly lengthy access drive. Is the access drive BUA reflected in the 20,625 sf [21099 sf] Other BUA amount? I suggest moving that the street box on the application. Assuming that 54,339 sf is allocated to Lot 1, 1 think your breakdown should look like this: Building 29185 Street 21099 Parking 26594 Sidewalk 10521 Other 0 Future (Lot 1) 54339 Total 141738 Please review and adjust accordingly and resend the adjusted page 3 of 6 by June 23, 2017. Yes, I did put the private drive under "other" category because it was not a public street. The 474 s.f. difference is due to the future area that will be between private drive in Lot 2 and Lot 1. Evergreen Construction Company originally owned both Lot 1 and Lot 2. Lot 2 has already been developed and this developed tract consists of a residential senior living facility, associated entrance drive and parking lot, associated utilities, associated storm drainage, a constructed stormwater wetland, and a level spreader. An adjacent tract consisting of Lot 1, which was part of the original project site, will be developed for commercial use this year by Beaufort Storage, LLC. Lot 2 was originally permitted to have a maximum built upon area of 85,915 s.f. and Lot 1 was originally permitted to have a maximum built upon area of 55,931 s.f. Once Lot 2 was developed and residents settled in, they requested additional concrete benches and a bike pad. The construction of aforementioned items has resulted in excess built upon area in Lot 2. The latest survey shows that Lot 2 actually has 87,033 s.f. of existing built upon area. There will be additional 474 s.f. of future built upon area installed within Lot 2 between the existing private drive and Lot 1 per the proposed site plan as part of entrance drives to future mini storage buildings that will be installed by Beaufort Storage, LLC. Therefore, the original permit needs to be revised and the allowable built upon area within Lot 2 needs to be 87,033 s.f. + 474 s.f. = 87,507 s.f. Drainage from both the current residential tract and the future commercial tract will be treated in the existing constructed stormwater wetland. The site area of the current residential site (Lot 2) is 6.403 acres. The site area of the adjacent future development tract (Lot 1) is 1.836 acres. The combined area of the tract with the current residential development and the adjacent future development tract gives a 'total project area" of 8.238 acres. The project site is located northwest of the right-of-way of US HWY 70 approximately 0.20-mile northeast of the intersection of US HWY 70 and Campen Road in Carteret County. The project site is bounded on the southeast by US HWY 70, on the southwest by developed commercial land and undeveloped land, and on all other sides by undeveloped land. STORMWATER INFORMATION Pre -development: The project site consists of 8.238 acres, with existing grades averaging from 0% to 4%. In the construction of phase 1 (Lot 2), the 2-story multi -family residential building in the northwest section of the tract and associated parking area, the entrance drive, sidewalk in the southern -most portion of the tract along US Highway 70, the constructed stormwater wetland, and the level spreader have been installed. Phase 1 involved development of Lot 2 and consists of 2.016 acres of impervious area. Approximately 4.42 acres of on -site drainage area is being collected via sheet flow, swales, drop inlets, and a reinforced concrete pipe system before it is routed to the proposed constructed stormwater wetland and level spreader. At this time, only a small portion of the area in future development tract (Lot 1) is draining to the constructed stormwater wetland (including all the existing impervious area constructed during phase 1). The total impervious area within Lot 2 ended up being 1,118 s.f. higher than the permitted area due to addition of concrete benches, concrete bike pad, and reconfigured sidewalks. I have checked myself in AutoCAD and our surveyors are correct so I cannot certify as -built area in Lot 2 at this time. I was told that concrete benches and concrete bike pad were added because the residents living there requested them. So what I need to do now I guess is to submit a minor stormwater permit modification for express review on behalf of Evergreen Construction before they can even transfer their permit to Beaufort Spring. We will basically "borrow" some allowable impervious square footage that was allocated to Lot 1 since the proposed impervious area within Lot 1 will only be 50,486 s.f, which is much less than 55,141 s.f. that they were allowed for future development. Please take a look at what I believe has to happen and offer your comments as far as sequence and additional items needed. 1. Submit minor stormwater permit modification request for express review on behalf of Evergreen Construction to reflect new allowable impervious areas for Lot 1 and Lot 2. 2. Highway 101 in Beaufort Township, Carteret County, NC. The property is bounded on the north by woods, bounded on the east by U.S. Highway 70 (Live Oak Street), bounded on the south by private drive/sidewalk, and bounded on the west by constructed wetland. There are no wetlands or riparian buffers located at this project site. This project does not involve subdivision property. This project will consist of the construction of 2 commercial mini -storage buildings and associated parking/drive areas. In addition, associated storm drainage and utilities, and any other appurtenances needed to serve the new buildings while disturbing approximately 1.697 acres will be constructed. This project is being built on an empty 1.836-acre site. There is approximately 774 square feet of existing sidewalk within the property that was permitted and constructed during the initial phase of the project back in 2013, This existing impervious area does not count against the 55,141-square foot built upon limit that was allocated for future development within this lot because it has already been accounted for during initial phase of the project for the retirement housing next to the constructed wetland. The total proposed impervious area includes 700 square feet of offsite impervious area. This is the impervious area required to make the tie-in between the existing private drive 1700-0 EAST ARLINGTON BLVD. • GREENVILLE, NORTH CAROLINA27858 and the proposed lot that is to be developed. This proposed impervious area spans from the property line until the edge of the existing private drive and it consists of proposed handicap ramps, sidewalks and asphalt. The runoff from this impervious area will drain into the existing ditch along the western property line of the proposed development and will then be discharged into the existing constructed wetland. STORMWATER INFORMATION Pre -development: The existing project site area consists of 1.836 acres. Majority of project site consists of empty pervious land with about 774 square feet of existing sidewalk that was built at the time that the retirement housing and constructed wetland were constructed and was already permitted and accounted for under stormwater permit #SW8 120919. The storm water from this undeveloped pervious area is currently sheeting off to the existing ditch along the western and eastern property lines. The storm water runoff from the western ditch enters constructed wetland and is then discharged into the ditch along eastern property line. This runoff is then picked up by the existing storm drainage system along Live Oak Street and is then discharged into Turner Creek in White Oak River Basin. Post -development: The storm water runoff from all the proposed impervious areas will be discharged to the existing constructed wetland. The runoff from half of building roofs will be collected in the downspouts. Along the eastern property line, the downspouts will discharge runoff from the roofs into the proposed storm drainage system while the downspouts along the western property line will discharge roof runoff directly to the existing ditch along western property line. Majority of runoff from parking lot/drive areas will be collected in the proposed storm drainage system while the remainder will sheet off directly to the constructed wetland at the northern side of the proposed mini -storage buildings. The runoff from the proposed offsite impervious area will discharge into the existing ditch along western property line and will then enter existing constructed wetland via this ditch. Beaufort Spring Housing Associates, LLC owns lot #2 and the constructed wetland itself. According to the attached document that I received from our client, Beaufort Spring is currently responsible for 100% of constructed wetland maintenance but once our client develops lot #1, he will be responsible for 22% of constructed wetland maintenance costs while Beaufort Spring Housing Associates, LLC will be responsible for 78% of costs. See Sec. 2.2 on page 3. This document would take care of the ongoing maintenance of the stormwater wetland and our client is aware that he will need to share expenses for maintenance. At one point in time G & M Development, LLC, might have owned both lot 91 and lot #!2. Our office manager is currently looking into ownership transfers and at which point who bought what lot. I do know that Evergreen Construction, LLC initially owned both lots. Lyle Gardner is a member -manager of both Evergreen Construction, LLC and G and M Development, LLC. What would be your advice as far as untangling this legal mess goes since we have separate entities here owning separate lots? There are quite a few steps involved in a transfer. Does G&M own both lots? In order to transfer the permit to them they need to own both lots and they need to make provision for the ongoing maintenance of the stormwater wetlands by the 2 lot owners in perpetuity. If they own both lots, at least they can go ahead and get the deed restrictions recorded before we transfer. The necessary language to record is already in that permit, but please make sure the correct permit number (SW8 121019) is referenced. Also, if G&M will agree (in writing) to provide the final certification, and address any other non- compliance issues at the site, then we should be able to transfer relatively quickly. However, the final certification would have to be submitted with the offsite application, along with a copy of the recorded deed restrictions. If not, then they'll just have to draft up new ones. The permit number is incorrectly referenced — the correct permit number is SW8 121019. According to the database, a partial certification was submitted by Steve Janowski on November 8, 2014. It deferred certification of the wetlands plantings until the following spring (2015). That final certification has NOT been submitted. A copy of the recorded deed restrictions for the 2 lots has also NOT been submitted. The original permittee, Evergreen Construction Company, was required to record the deed restrictions prior to selling the lots. I think it's apparent from your email that Evergreen has apparently sold out to G & M Development, LLC at some point without notifying the Division to transfer the permit. The Division will not be able to accept your client's application for an offsite permit until ownership of the SW8 121019 permit is transferred to the seller, G&M Development, LLC and they provide the necessary final certification for the permitted wetlands and record the necessary deed restrictions. If your client has already purchased one of the lots, your client will need to sign off on those restrictions prior to recording. Beaufort Storage, LLC is in a rush to get this project started so we will go with the express permit review. On the off -site supplement form it asks whether deed restrictions have been recorded and whether engineer certification has been submitted. The engineer, Matthew D. Williams, who has designed the existing constructed wetland in stormwater permit #SW8 120919 has left the company around the time that the permit was issued or shortly after. I have looked though our documents and I could not locate a copy of engineer certification. However, I do not have access to all of the documents that Matthew had for this project. I do not want to initial the application and say that the engineer certification was provided because I do not know if it was. Is there a way for you to check on your end if you received engineer certification? The certification might have come from a different engineer, Stephen Janowski, that our company might have sub -contracted once the original engineer Matthew Williams left the company. Offsite permitting requires the $505.00 application fee. The application form should be completed specific to the lot in question. There is no need to provide SCM design calculations, or to report all of the BUA that the SCM has been permitted to treat. The review of the layout and grading plans will be to assure that the BUA limit assigned under the master permit, has not been exceeded and that the proposed grading / runoff collection system adequately conveys runoff to the permitted offsite SCM. The review will also include a file review of the master permit to assure that a copy of the recorded deed restrictions is in the file, and that the SCM has been certified. A compliance inspection of the offsite SCM will also be conducted (if one has not been conducted within the last 6 months or so) to assure that it is currently in compliance with its permit. At the time that we submitted erosion control plan, the address that we had available for Beaufort Storage, LLC was 1400 Dills Creek Lane and the LLC was not registered with the state. As of now, Beaufort Storage LLC is showing up as registered on NC secretary of state website but the registered address is 123 Core Drive West. Below is Warren Benton's response regarding the address discrepancy. "The newly formed company is Beaufort Storage LLC. My partner, Frank Gainey lives at the 123 Core Drive address and that will be the address for the LLC since he is handling all the financial matters for the company." As far as constructed wetland goes, we are not using it for erosion control. We have provided a silt fence along the constructed wetland edge and a rock dam in the ditch to stop the sediment from flowing into the pond. Installation of storm drainage pipes will being with DI41 and inlet protection will be provided for each successive drop inlet installed up to the stormwater wetland. Inlet protection at drop inlets will prevent sediment from flowing into storm drainage pipes and reaching constructed wetland via pipe flow and the silt fence will prevent sediment from reaching the constructed wetland above ground. Thus, the risks to the constructed wetland will be mitigated. The lot that we are developing on was originally part of Beaufort Spring project. There is already an existing stormwater permit (Permit # SW8 120919) that covers the lot that we are developing. See attached stormwater permit and restrictive covenants placed on lot #1 that we are developing. As you can see from sheet #2 of our plans, our proposed impervious area is less than the allocated allowable built upon area of 55,922 square feet that is listed on the restrictive covenants. Please let me know if this gives you enough information to move on with your review.
