Subject: EXEMPTION from Stormwater Management Permit Regulations
Boiling Spring Lakes Sewer Transmission Force Main -Utility Project

Dear Mr. Lawing:
The Wilmington Regional Office of the Division of Water Quality received a copy of the Linear Utility Line application for the
subject utility project on February 14, 2012. Staff has reviewed the application for the applicability of the Stormwater
Management rules to this project. Based on our review, you do not appear to be proposing development activities on this site at
this point in time that would be subject to the stormwater requirements as provided for in 15A NCAC 2H.1000. However, be
advised that other regulations will potentially apply to your proposed activities.
In accordance with 15A NCAC 2B.0231 and Division policy, new or continued ditching activities after March 1,1999, may be a
violation of state wetland standards. Violation of these standards may result in the assessment of civil penalties and other
requirements to bring the project into compliance without additional wetlands impacts. In addition to the wetland standards, if
your project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the
National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an
NPDES permit for stormwater discharge from projects meeting these criteria. Any temporary built -upon area associated with the
construction of the project must be removed wfthin 30 days of completing the project, or when it is no longer needed, whichever
occurs first.
If at any time in the future, development of any part of this site is planned, as defined in NCAC 2H.1000, or you do not develop
the project in the manner indicated in the application, you must apply for and receive a Stormwater Management Permit prior to
