REGAN Secretory TRACY DAVIS Director The Wilmington Regional Office received a complete, modified State Stormwater Management Permit Application for the subject project on October 23, 2017. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations. This project was originally designed and approved under the regulations set forth in Title 15A NCAC 02H.1000 (1995 Rules) as amended by Session Law (SL) 2006-246 and as subsequently amended on January L 2017 (2017 Rules), as applicable. We are forwarding modified Permit No. SW8 080649 dated October 23, 2017, for the construction, operation and maintenance of the stormwater control measures (SCMs), built - upon areas, as well as the stormwater collection system and/or vegetated conveyance system associated with the subject project. Please add the attached plans to the previously approved plan set. Please replace the previous application (SWU-101 with the attached modified versions. This permit shall be effective from the date of issuance until December 30, 2021 and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. Please pay special attention to the permit conditions regarding the operation and maintenance of the SCMs, stormwater collection system, and/or vegetated conveyances; the limitation of built -upon area; modification of the project:; the procedures for changing ownership of and/or transferring the permit, and the need to renew the permit. Failure to comply with these requirements will result in future compliance problems. The following clarifications, corrections, and modifications are included and covered by this permit: 1. The original permit issued July 22, 2008 approved the construction, operation and maintenance of two wet detention ponds. However, only one set of design information was presented in the permit, the supplements, the operation and maintenance agreement, and the calculations. Additionally, the pond design presented in the supplement and the calculations are not consistent. In comparing the two ponds and their drainage areas approved in 2008, the following differences and similarities are noted: a. Pond 1 has a larger drainage area and more built -upon area which should result in a slightly larger minimum required storage volume. b. the size and shape of the ponds are roughly identical with only subtle differences including bottom surface areas and the forebay position. This is supported by the pond summary table provided on D-4 of the plans approved on July 23, 2008. . With only one set of design information having been provided and the two ponds being roughly identical on the plans, it is assumed that both ponds were based on the same pond design. 2. For Pond 1, this permit is being corrected to maintain the original design found in the calculations as noted on the revised supplement originally provided in 2008. Future modifications to Pond 1 . or its drainage area will need to confirm and permit the as -built condition of Pond 1. A new designer's certification will be required at that time. 3. For Pond 2, this modified permit approves the slightly revised as -built condition. A new designer's certification is required to be submitted upon completion of this modification. DESIGN STANDARDS This permit is effective only with respect to the management and volume of stormwater described in the application and other supporting data. The maximum amount of built - upon area (BLIA) allowed for the entire project is 91,801 square feet. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 this permit. The stormwater control measures labeled Pond 1 and Pond 2 have been designed to handle the runoff from 45.871 and 45,930square feet of built -upon area, respectively. This permit does not provide any allocation of built -upon area for future development. 3. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 4. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. 5. A vegetated filter strip is not required for these ponds as they have been designed for a 90% total suspended solids removal efficiency. 6. The built -upon areas associated with this project shall be located at least 30 feet landward of all perennial and intermittent surface waters. Any future modifications to Pond 1 or its drainage area will need to confirm and permit the as -built condition of Pond ' If. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes and the vegetated filter strip. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, level spreader, filter strip, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept for each permitted BMP. The records will indicate the date, activity, name of person performing the work and what actions were taken. The permittee shall submit an annual summary report to the Division of Energy, Mineral and Land Resources of the maintenance inspection records for each BMP. The report shall summarize the inspection dates, results of the inspections, and the maintenance work performed at each inspection. 6. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 7. Decorative spray fountains will not be allowed in the stormwater treatment system until calculations are provided documenting the permeant pool volume is greater than 30,000 cubic feet. 8. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications; and other supporting data. 9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including; but not limited to; those listed below: a. Any revision to any item shown on the approved plans; including the stormwater management measures, built -upon area, details, etc. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for ten years from the date of the completion of construction. III. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules; is subject to enforcement action as set forth in NCGS 143, Article 21. 2. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. Page 3 of 6 State Stormwater Management Systems Permit No. SW8 080649 3. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy; Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; C. Bankruptcy, d. Foreclosure, subject to the requirements of Session Law 2013-121, e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6-07; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 4. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 5. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. Additional or replacement stormwater management systems shall receive a permit from the Division prior to construction. 6. The permittee grants Division Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification; revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. There is just two numbers that need to get updated in the supplement to match the proposed conditions: 1. The temporary pool area should be the provided area (11,993 sf) at the temporary pool elevation (next available outlet = 18.5) instead of the minimum required surface area presented (11,362 sf). 2. The drawdown orifice is listed as 1.25" in the talcs and on the plans but is listed as 1.5" in the supplement. Since these are very minor comments, I was hoping this e-mail would be sufficient to get the updated supplement e- mailed to me. If a more formal letter requesting additional information is desired, that can be arranged. In the meantime, I will begin drafting the permit. The recent modification submitted by Kevin Avolis uses the as -built condition for Pond 2. Here's the paragraph I've drafted to try to explain this in the permit: The original permit issued July 22, 2008 approved the construction, operation and maintenance of two wet detention ponds. However, only one set of design information was presented in the permit, the supplements, the operation and maintenance agreement, and the calculations. Although there appear to be subtle differences in the bottom surface areas of the two ponds and the forebay entrance location, the size and shape of the ponds are roughly identical. This is supported by the pond summary table provided on D-4 of the plans approved on July 23, 2008. It is assumed that both ponds were based on the same pond design. Specifically, it is proposed that a new 5,348 ft.' classroom building with administrative offices be constructed. The facility will be constructed adjacent to the existing facilities in this area. The existing facilities were constructed in 2009. At the time of construction, a Coastal Stormwater Permit was secured. Stormwater Permit SW8 080649 was issued on July 28, 2008. The Stormwater Permit covered the full extent of construction that exists in this area. All the facilities originally designed were constructed including two stormwater retention basins, one for each drainage basin within the original project. The basins been constructed and an engineer certification for the project was submitted in October 2009. The proposed pre-engineered metal building will be constructed within the within the limits of Drainage Area #2 of the original permit. This drainage boundary is proposed to be expanded slightly in order to encompass the entire scope of new construction. It is proposed that the drainage area be increased in size by 1,915 ft.z It is proposed that all runoff from the new construction be routed to the existing stormwater retention pond constructed associated with Drainage Basin #2. An additional 5,508 ft.Z of new impermeable surfaces will be added to the drainage basin. The percent built -upon resulting from the proposed construction for the drainage basin is 53.64%. As originally designed, Stormwater Retention Basin #2 was constructed with excess capacity; although, no future development was allocated on the project permit. As designed and constructed, the existing stormwater basin will not require any significant modifications in order to treat the additional runoff generated from the additional impermeable surfaces. In excess of the 1.5 inch runoff volume is contained within the existing Stormwater basin. The stormwater basin is not properly sized in accordance with the Stormwater Rules under which it was permitted. The forebay is slightly smaller than the 18% to 22%threshold of the total pond volume. The forebay will be enlarged slightly by this project. Additionally, it is proposed that the orifice diameter on the outlet structure be modified to ensure that stormwater discharge occurs between the two and five day limits established by the Rules. The project drains to Wilson Bay. This water body has a surface water classification of SC, HQW, NSW and a stream index of 19-14. No wetlands exist within the limits of the proposed project. Specifically, it is proposed that a new 5,348 ft.' classroom building with administrative offices be constructed. The facility will be constructed adjacent to the existing facilities in this area. The existing facilities were constructed in 2009. At the time of construction, a Coastal Stormwater Permit was secured. Stormwater Permit SW8 080649 was issued on July 28, 2008. The Stormwater Permit covered the full extent of construction that exists in this area. All the facilities originally designed were constructed including two stormwater retention basins, one for each drainage basin within the original project. The basins been constructed and an engineer certification for the project was submitted in October 2009. The proposed pre-engineered metal building will be constructed within the within the limits of Drainage Area #2 of the original permit. This dlainaee boundary is proposed to be expanded slightly in order to encompass the entire scope of new construction. it is proposed that the drainage area be increased in size by 1,915 ft.' It is proposed that all runoff from the new construction be routed to the existing stormwater retention pond constructed associated with Drainage Basin #2. An additional 5,508 ft.' of new impermeable surfaces will be added to the drainage basin. The percent built -upon resulting from the proposed construction for the drainage basin is 53.64%. As originally designed, Stormwater Retention Basin #2 was constructed with excess capacity; although, no future development was allocated on the project permit. As designed and constructed, the existing Stormwater basin will not require any significant modifications in order to treat the additional runoff generated from the additional impermeable surfaces. In excess of the 1.5 inch runoff volume is contained within the existing Stormwater basin. The stormwater basin is properly sized in accordance with the current Stormwater Rules. It is proposed that the orifice diameter on the outlet structure be modified to ensure that stormwater discharge occurs between the two and five day limits established by the Rules. The project drains to Wilson Bay. This water body has a surface water classification of SC, HOW, NSW and a stream index of 19-14. This law impacts any development approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010, The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. As a result,120 USMC Camp Lejeune permits are impacted. Of the 120 permits, 45 permits have previously been issued extensions and 75 permits have been extended effective today. This is summarized in Attachment A.
