I've also attached a few photos of the pond now that the trees and overgrowth have been removed. We have reached out to Tripp Engineering that performed the original inspection several times, but have not received a return call. Can you recommend other firms that complete this type of Certifications? Thank you for all of your help and patience and please let me know if you need any other information. We have contracted with another company that is scheduled to begin work on Aug. 21st to be completed by Aug. 23` (weather permitting). Once it is completed we will schedule the Engineer to certify compliance. If you would like us to submit another letter stating this, we would be more than happy to do so. Good Morning Kelly, We received the attached notice of non-compliance regarding the inspection of the detention pond located at 108 Landmark Drive. After the inspection, we contacted our landscaping company to complete the clearing of the trees and debris in the detention pond, which will be completed during the month of April. The drainage piping at the outlet box and running from the parking lot will also be inspected to insure there are no blockages. Once this is completed, we will have the final. engineers certification (as we did not know this was not completed when purchasing the property). I will contact you once the clearing projects are complete and the Engineer is scheduled for certification. Please let me know if there is any additional information that you require. TW Landmark, LLC was not notified of the stormwater permit when purchasing the property to transfer the permit at that time. Layne and Giaquinto: TRACY DAVIS Director Effective August L 2013; the State Stormwater program was transferred from the Division of Water Quality (D\VQ) to the Division of Energy, Tlineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the subject permit. PERDIff EXTENSION On August 5, 2009, the Governor signed Session Law 2009-406, This law, impacted any development approval issued by the. former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stonnwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit, which already expired on November 30, 2016, shall now be effective from the date of issuance until November 30, 2020. REQUEST FOR DESIGNER CERTIFICATION On November 30, 2006, the Division issued a high density state stormwater management permit to Monroe Holdings, LLC for the development of Lot 7 Landmark ]ndustrial Park, located at 408 Landmark Drive in Wilmington. Per Schedule of Compliance Condition 11.7. the permittee is required to submit a certification from an appropriate designer, certifying that the permitted system has been installed in accordance with the permit conditions, the approved plans and specifications, and other supporting documentation on file with the Division and a part of the permit. Although construction of the project appears to be complete, a review of the file indicates that the required designer certification has not been submitted to the Division. REQUEST FOR PE10111' TRANSFER On October 4, 2017, the Wilmington Regional Office of DEMLR conducted a file review of the subject project currently operating under the afore -mentioned Stormwater Management Permit Number SW8 061105. DENILR review of the New Hanover County Tax Records and NC Secretary of State Corporations database, revealed that the ownership of the properly covered by this permit has changed and the pemtittee corporate entity has been dissolved. The bank (Land Holding, LLC, aka the foreclosure arm of PNC National Bank) foreclosed on the property on September 23, 2013, and then sold the property to TW Landmark, LLC on October 30, 2014. The NC Secretary of State administratively dissolved Monroe Holdings, LLC on March 4, 2014. Please note that per General Condition 111.9 of the permit, the permittee must notify the Division within 30 days of any name, ownership (i.e., dissolution or sale) or mailing address changes. Additionally, per General Condition III.1, the permit is not transferable except after notice to and approval by the Division. S WS 061105 Pape 2 of 2 Based on this research, Momoe Holdings, LLC, is required to initiate the transfer of the permit, and TW Landmark, LLC, currently does not hold a permit to discharge to surface waters. Please note that several options are available for transferring the permit to TW Landmark, LLC. Grantor was substituted as Trustee by a Substitution of Trustee recorded in Book 5703, Page 1303 of the New Hanover County Public Registry, and WHEREAS, default having occurred in the payment of the indebtedness secured by the Deed of Trust and in the performance of the stipulations and conditions therein contained, due demand was made upon Debtor, by the owner and holder of the indebtedness secured by the Deed of Trust, that the Grantor foreclose the Deed of Trust and sell the real property described therein under the terms and provisions thereof and the laws of the State of North Carolina, and WHEREAS, under and by virtue of the power and authority in him vested by the Deed of Trust and according to the terms and the stipulations of' the same, and pursuant to the Order of the Assistant Clerk of Superior Court of New Hanover County in that certain FORECLOSURE PROCEEDING, entitled 13-SP-104, whereupon the Assistant Clerk of Superior Court of New Hanover County, North Carolina authorized Grantor to proceed under the Deed of Trust and sell the Property, and Grantor, at 12 05 p in on August 30, 2013, did expose the Property for sale at public auction at the New Hanover County Courthouse, and WHEREAS, Grantor duly reported the sale to the Clerk of Superior Court for New Hanover County on August 30, 2013, wherein PNC Bank, National Association was the highest bidder with a bid of S466,50000 (the "Credit Bid"), and thereafter said sale remained open ten (10) days as by law required, and WHEREAS. no upset bids were filed, and the rights of the parties to the sale have become fixed in accordance with N C Gen Slat §45-21 27(a), and WHEREAS, PNC Bank.
