renewed on February 4, 2021, and shall be effective until February 20, 2028 application. Please keep this permit
on file at all times. Please note that the renewed, updated, and re -issued permit does not impose new or different
terms; it merely restates some of the previous terms to provide you with a better understanding of your obligations
under the permit.
The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance with
the terms and conditions of this state stormwater permit. The plans originally approved on February 20, 2006,
and most recently modified on January 7, 2009, will remain in full force and effect in accordance with the

This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed
restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management system, to record
deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request
an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The
written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the
OAH wtthin thirty (30) days of receipt of this permit. You should contact the OAH with all questions regarding
the filing fee (if a filing fee is required) and/or the details of the filing process at 6714 Mail Service Center,
Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their website at www.NCOAH.com. Unless
such demands are made this permit shall be final and binding.
If you have any questions, need additional copies of the permit or approved plans, please contact Daniel Sams in
the Wilmington Regional Office, at (910) 796-7215 or dan.sams@ncdenr.gov.
Sincerely,
Brian Wrenn, Director

This letter contains my engineering certification for the above -mentioned
project. I have based this certification based on my review of the plans, my
review of the permit, and my personal inspection of the site.
My initial site visit on May 1, 2020 uncovered several maintenance items with
the ponds and the rear rain gutters. All issues have been addressed to my
professional satisfaction.
This permit expired on February 20, 2016. The Owner is aware of this situation

In looking at the index sheet, it appears that the proposed project will impact at least 1 permit. SW8 110909 was issued
to the Town of Leland for the Leland Town Center and includes Town Hall Or within its project limits. Portions of the
right-of-way are within the drainage areas for the BMPs.
There are also other permits along the way that may or may not be impacted depending on the proposed path's
location. For instance, the narrative implies that the Town has acquired right-of-way to construct the path, has that
impacted any permitted project areas? The following projects appear to be located along a portion of the proposed
project:
Village Oaks Apartments — SW8 060133
BSRI Leland Senior Center— SW8 151206
Leland Branch Library— SW8 930902 (appears to have its own compliance issues)
Glendale Subdivision —SW8 970127
Likely these permits won't be impacted by your project but the leg work still needs to be done to confirm.
If the proposed improvements does effect SW8 110909, I would suggest the Town modify their permit for SW8
110909. The modification would address the BUA that is likely being added within the drainage area and would add the
"Other" portions of the proposed improvements to the permit as additional drainage areas.
Once you have had a chance to assess the impacts to these permits, please either confirm that you are still going with
the original express request or submit a revised request.
As always, let me know if you have any questions!

2014 STP-DA Pedestrian Improvements (TIP #s: 1, J, & K)
Town of Leland
Project Description:
The Town of Leland has received STP-DA funding through NCDOT and Federal government, for
improving safety for pedestrians and bicyclists. The referenced project combines the development of
three (3) STP-DA improvement projects, identified as U-5534 I, 1 & K. The proposed project will provide
the construction of sidewalks and multi -use paths in three locations within the Town of Leland in
Brunswick County, North Carolina.
• U-5534(I) — consists of 10' wide multi -use path approximately 1,423 feet in length along Village
Road. The path will be located on the south side of Village Road.
• U-5534(J) — consists of 5' wide sidewalk that completes the pedestrian loop connecting Town
Hall Drive, Old Fayetteville Road and Village Road. One section will be located on the north side
of Old Fayetteville Road to Village Road intersection. The other section will be located on the
east side of Town Hall Drive (near Parsley Lane). The two sections of sidewalk are approximately
2,480 feet in combined length.
• U-5534(K) — consists 5' wide sidewalk approximately 2,504 feet in length along Old Fayetteville
Road from Ricefield Branch Street to the overpass of Highway 74/76. The sidewalk will be
located on the south side of Old Fayetteville Road.
This project is linear in nature which will require a Stormwater "Other' permit and Erosion Control
permit through NCDEQ. The project will be constructed within the NCDOT right-of-way and Town right-
of-way (acquired property). The project design is intended to follow the natural topography wherever
possible in an effort to minimize grading and impacts. Slight drainage improvements to roadside ditches
and structures will be necessary to install the proposed improvements; however improvements will not
be altering the overall drainage within these areas.
Temporary silt fence, inlet protection and outlet protection is to be utilized along the project area in
order to minimize any surface runoff from grading and excavation operations.
The total disturbed area for this project is approximately 3.95 acres.
