Skvarla, III Secretary Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. The Division issued the following low density State Stormwater Management Permits to Morton Farms, Inc., for various Sections of Rock Creek Subdivision, located off NCSR 1316 near Richlands: SW8 890202 Section VI issued on March 16, 1989 for 77 lots @10,047 sf/lot; SW8 000809 Section VIIA issued on February 1, 2001 for 24 lots @4700 sf/lot; SW8 060122 Section IX issued on March 15, 2006 for 51 lots @6733 sf/lot; SW8 100709 Holly Grove issued on September 9, 2013 for 54 lots. Lots 1, 2, 20 and 25 are limited to 2,239 sf; Lots 26-54 are limited to 2,452 sf; and Lots 3-19 and 21-24 are limited to 3,550 sf. Each of the listed permits contains the language that must be recorded. In addition, some of the later permits have separate documents listing the deed restriction statements that required your signature. Please refer to the permits if you have any questions about what statements need to be recorded. Per the requirements of each permit, a copy of the recorded deed restrictions must be forwarded within 30 days of the date of recording. A review of our files indicates that, as of this date, a copy of the recorded deed restrictions has not been received in this Office for any of these permitted subdivisions. Failure to record and/or provide a copy of the recorded deed restrictions prior to selling lots is a violation of your permit, and subject to enforcement action. Please forward a copy of the recorded deed restrictions to this Office at the address below by August 24, 2014, or enforcement action may be initiated which may include recommendations for civil penalties and/or revocation of the permit. In addition, it is probably time to transfer these permits to the Homeowner's Association. In order to transfer a permit, please submit the following information for each permit: 1. A completed and signed Name/Ownership Change form or permit transfer form for each subdivision. If the HOA formation was subject to Chapter 47F, the Planned Community Act, then you may use the HOA permit transfer form which only requires the signature of the permittee to initiate the transfer; 2. A copy of the recorded deed restrictions; 3. A copy of the deed conveying the common areas to the HOA; 4. Documentation that no lot has exceeded its permitted maximum built -upon area limit; 5. The Designer's Certification stating that the stormwater management system has been installed in accordance with the approved plans. Unless other arrangements are made between yourself and the HOA, you must provide the necessary actions to bring the project into compliance with the permit before the Division can approve the transfer of the permit to the HOA. Please note that the Division's determination of compliance is based solely on the stormwater rules, and not on other issues which are not regulated by the stormwater permit such as nuisance flooding. At that time, the project was proposed Low Density with Curb Outlets. Since that time, it has been necessary to revise the design to satisfy NCDOT requirements. The only significant change is the deletion of curb and gutter (and curb outlets) and reduction in width of streets. The project, however, still meets the requirements of Low Density project. We hereby request that you discard the previously submitted Permit Application, Low Density Supplement and Curb Outlet Supplement. The site is currently undeveloped. The developer intends to construct/develop roadway, drainage & utilities only (i.e., lots to be sold to third parties and will be cleared/developed by others). The project site is adjacent to an UT of New River (C;NSW) in the White Oak Basin. Site topography is gently sloping (0-5%), falling gently in a southwesterly direction toward the New River. An existing ditch traverses the southerly boundary of the site, intercepting the sheet flow and conveying flow to the UT to New River. The proposed development activities are low density (percent impervious = 30 %) and includes 51 lots of approximately 1/3 to''/2 acre each. Soils are loamy sand/sandy loam underlain by more restrictive "hardpan" strata. The entire area designated within "Clearing Limits" will be disturbed during initial construction, and will include grading for street and utility construction.
