Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding Permit No. SW7910903 dated August 18, 2015, for the construction of an infiltration basin and building expansion for the subject project. The permit for this project issued on November 18, 2008 is hereby rescinded and replaced with this permit. This permit shall be effective from the date of issuance until August 4, 2021, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This permit modification covers the addition of a new infiltration basin to collect and treat the runoff from 62,291 square feet of existing parking impervious area in order to allow for the new building expansion of 33,106 square feet of impervious area -to be collected 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The two stormwater controls have been designed to handle the runoff from 630,967 square feet of impervious area. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Page 3 of 8 State Stormwater Management Systems Permit No. SW7910903 MOD 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowin.9 and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. o. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any - modification to the approved plans, including, but not limited to, those listed a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. Page 4 of 8 State Stormwater Management Systems Permit No. SW7910903 MOD 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. +1 91 The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. 10. This permit shall be effective from the date of issuance until August 4, 2021. The subject site i a .66 acr parcel of land located at 5430 Croatan Highway (US 158) and is approximately .5 m st of the NC 12 and N. Croatan Highway (US 158) intersection. Wendy's proposes to add a 2,570, sq.ft resta i�nr and associated drive aisle and parking areas. for the proposed facility. The parcel is currently owned by 1600 Peachtree, LLC and will be leased to Carolina Quality Foods for development. Stormwater management proposed for the site will consist of an existing infiltration basin located on the adjacent parcel of land at 5400 N Croatan Highway (US 158). This basin is currently operated and maintained by Peachtree Shoreside. LLC. The following narrative, application and calculations will demons rate the parameters of the proposed design, which will illustrate an effective stormwater management system in compliance with all state regulations. Summary of Existing Conditions The Wendy's site is currently undeveloped open green space. The total BUA of the existing site is 0%. Drainage flowing from the existing site appears to sheet flow off -site and into existing structures and ultimately into existing infiltration basins. The front half of the lot drains into existing curb inlets within Cypress Knee Trail and is directed into the existing infiltration basin adjacent to North Croatan Highway. The remainder of the lot sheet flows to a drop inlet adjacent to the intersection of Cypress Knee Trail and the existing private entrance. This stormwater is then discharged into the existing infiltration basin located on 5400 N. Croatan Highway property within easement. Summary of Proposed Conditions The project proposes the addition of a 2,570 sq.ft. Restaurant and vehicular accommodation areas to the existingsft�dpop completion of the proposed improvements the site's overall BUA will be 17,154 sq.ft. rr 59.8%%. Stormwater management improvements will be provided to treat runoff from all proposed impervious construction. Stormwater Management Plan Narrative Wendy's — Kitty Hawk, NC April 27, 2016 Stormwater Compliance Per 15A NCAC 02H.1005 (a) (3) (B) High Density Coastal Development is required to meet particular criteria. The proposed development has a built upon area of greater than 24% as required by the regulations. This development is proposed to have 59.8% of impervious coverage and is allowed up to 60% coverage per local ordinance. The existing infiltration basin off -site was previously designed in accordance with NCDEQ Requirements. The existing basin is designed to store, control, and treat the stormwater runoff generated by the one and one-half inch of rainfall from all surfaces impacted by the Wendy's development. In addition to these requirements, a minimum 50' vegetative buffer from surface waters is provided. Collection Runoff from proposed Wendy's building and associated vehicular areas are to be collected and conveyed to the infiltration basin by an underground pipe network. The proposed storm network is made up of 12" RCP with multiple onsite drop inlets. Runoff draining from the proposed building will be collected by roof drains and connected into the proposed storm network. Drainage from the front of the site will remain unchanged and will continue to be treated through the existing infiltration basin at the front of the lot adjacent to Cypress Knee Trail. This area will not drain any proposed impervious surfaces. Treatment The proposed system will offer treatment prior to release. Runoff from vehicular areas will be directed into the infiltration basin via the proposed pipe network. Riprap will be provided at the inlet to the basin from the proposed 12" RCP. Stormwater entering the basin will be deenergized by the riprap as to reduce inflow velocities to the basin. Larger debris and pollutants will settle on the riprap aprons as the stormwater enters the basin. The primary treatment of runoff will be provided within the infiltration basin. The infiltration basin bottom and side slopes will be grassed according to general seeding specifications. The runoff will undergo filtration of fine particulates and pollutants by the vegetation within the basin. The filtration by vegetation is considered the primary method of treatment. A secondary method of treatment is also available when the stormwater runoff infiltrates into the subsurface. The soil particles between the basin bottom and the season high water table (SHWT) will offer additional filtration and/or absorption of particulates and pollutants prior to reaching the water table. Storage For NC DEQ stormwater permitting requirements, the infiltration basin has been designed with above grade storage in excess of the 1.5" rainfall event for the proposed development. The infiltration basin temporary storage is`s¢ed to accommodate a storage volume in excess of the volume of runoff produced by the 1.5 inch rainfall event over the drainage area for the proposed Wendy's site (DA-F). Drainage areas are indicated on the proposed drainage area map provided within Appendix A. The existing infiltration basin currently serves the ABC Store at 5440 North Croatan Highway (US 158) and is located on Shoreside Center property, owned by Stormwater Management Plan Narrative Wendy's — Kitty Hawk, NC April 27, 2016 Peachtree Shoreside, LLC. The ABC store drainage areas are indicated on the provided drainage area map as DA-A, DA-B, and DA-C. The storage volume allowed for the ABC Store site at the time of design was a storage volume in excess of the volume of runoff produced by the 1 inch rainfall event. The storage required to completely capture the first 1 inch from the existing ABC store (DA-A, DA-B, and DA-C) and 1.5 inch of rainfall from the proposed Wendy's (DA-F) is 4,499 cf. The existing infiltration basin has a temporary storage capacity of 5,330 cf. Disposal Disposal of runoff from the infiltration basin located in DA-C will occur via infiltration into the subsurface. Based on the determined soil saturated hydraulic conductivity of 23.57, the basin is calculated to draw down within .02 days. Soils The USDA NRCS Soil Survey lists the soil in the vicinity of the stormwater detention basin primarily as Fripp fine sand. Quible and Associates conducted a soil boing test in the vicinity of the wet detention basin. The soils observed were consistent with the NRCS soil description for the Fripp soils. These soils have rapid permeability with infiltration rates typically 2.0 to 20.0 inches per hour. A copy of the soils report and memo regarding on -site soils analysis are provided within Appendix D. Calculations A copy of the Drainage Calculations are provided in the Appendix B of this narrative Summary and Conclusions The proposed stormwater management plan for this site provides stormwater treatment in excess of the required 1.5 inch rainfall event for all proposed impervious surfaces. The proposed system will offer treatment for the required volume of run-off.
