Fifth Street Washington, NC 27889 Subject: Stormwater Permit No. SW7080720 Park Boat Company Project Redevelopment Type Project Dear Mr. Smithwick: Beaufort County w 0, �-/'o By letter dated October 9, 2020, the Washington Regional Office of the Division of Energy, Mineral, and Land Resources received your request to rescind Stormwater Permit No. SW7080720, issued February 17, 2009, to Park Boat Company for the Harbourside Marina Village project located at Chocowinity, NC. Also, a request to modify your project site, along with additional information and plans, was received by email on October 22, 2020. The proposed project now involves the demolition and redevelopment of this site with a new dry stack storage facility and waterfront improvements. As proposed, the redevelopment will result in a net decrease of impervious area. While the original site had no stormwater control measures, stormwater runoff from the proposed new dry stack storage buildings will be collected for treatment in a stormwater basin located at the NW portion of the site and then released to an adjacent natural wetland area. Based on your request, State Stormwater Permit No. SW7080720 is hereby rescinded. In addition, it has been determined that the current project proposes activities that are excluded from State Stormwater permitting requirements as set forth in stormwater rules under Title 15A NCAC 2H .1000. Therefore, the Division of Energy, Mineral, and Land Resources is hereby providing confirmation that the subject project is excluded from State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as shown on the plans submitted to this Office; 2) The project proposes no net increase in impervious coverage; and 3) The proposed stormwater controls provide equal or better protection of surface waters than the existing stormwater control. Under Section .1003(b) of the stormwater rules, the entire common plan of development must be permitted. Therefore, any future development or changes to the proposed development, including but not limited to, the locations of the built -upon area and construction of additional built -upon area, may require approval or a Stormwater Management permit application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the site prior to receipt of the required approval or permit will constitute a violation of Title 15A NCAC 2H.1000 and may result in the initiation of appropriate enforcement action. Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals which may be required by Federal, State, or local government agency rules or laws. Park Boat no longer plans to develop their properties as considered in the plans associated with the issued stormwater permit referenced above. Redevelopment is proposed, but the focus of the redevelopment is limited to dry stack storage and waterfront improvements with no residential units and no increase in built upon area. Park Boat Company, Inc. does want to rescind the active permit SW 7080720 (letter from owner attached) as the proposed redevelopment of the Site is significantly different (and much less intense) than previous development plans. The proposed dry stack storage, service shop addition and waterfront improvements as shown on the attached Site Plan demonstrate no net increase in impervious surfaces. An active CAMA Major Permit #79-09 for this development is being modified (modification request forwarded to NC DCM on September 18, 2020) to significantly reduce the scope and impact of the development. In addition, the City of Washington has agreed that the proposed development would comply with the City of Washington stormwater program provided there is no net increase in impervious coverage. The proposed development is considered redevelopment pursuant to NC GS 143-214.7 (a1) (2)) With no increase in built upon area. We understand that an NCG190000 general permit may be required for the marina and the developer is willing to provide stormwater control measures (none currently exist) as shown on the attached plan. The stormwater control measures include site grading to convey runoff away from public trust waters, providing gutters on new structures, and routing runoff to a stormwater basin with a rock lined spillway to diffuse flow prior to eventual release into a large expanse of existing wetlands that border the property to the west. Specifically that no City stormwater permit is required, if there is not an increase in impervious surfaces. Would the City of Washington be willing to provide a simple letter or response to this email that summarizes your position? A preliminary review of your project indicates that before a State Stormwater permit can be issued, the following additional information is needed: 1. Portions of the project appear to be redevelopment; additional explanation is needed to determine existing site built -upon areas. 2. Wet Pond surface area & storage volume calculations do not appear to meet minimum design criteria. Revise design calculations. 3. Permanent pool elevation on supplement sheets does not match Plan Sheet 7. 4. Provide outlet structure detail for wet pond. 5. Site plan raises some confusion regarding location of Tar -Pamlico Buffer lines along NW corner of property. Further explanation is needed. 6. Vegetated filter near NW comer of property appears to be located in wetland area. Wetland types & jurisdiction is not clear. Under normal circumstances, the Division would not permit constructed stormwater measures in a natural wetland area. Suggest all stormwater measures be located on high ground. 7. Wet pond design criteria calls for average depth to be a minimum 3 feet. 8. It does not appear that the proposed Bio-retention filter can maintain adequate separation from the SHWT. Application/design package does not support location of Bio-retention filters for this site. 9. Based on the proposed level of development, the site boundaries & soil/water table conditions, it may be very difficult to provide adequate stormwater controls that meet current design criteria. It may be helpful to conduct a site visit together with your engineer and the overall design approach for this project. The above requested information must be submitted to this office prior to November 10, 2008, or your application will be returned as incomplete. The return of this project will necessitate resubmittal of all required items including a new application fee. If you need additional time to complete the application package, please mail or fax your request to this office and include any reason(s) for the time delays. You should also be aware that the Stormwater Rules require that the permit be issued prior to any development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina General Statute 143-215.1 and may result in civil penalties of up to $25.000 per day. This package has been revised to address comments generated during your first review of the project and reflects the design changes we have discussed since your review. Specifically, your review comments have been addressed as follows: Comment: Portions of the project appear to be redevelopment. Response: A map showing the existing impervious area, as delineated in the field in a meeting with Kyle Barnes of DWQ, is included in Narrative Appendix C. Comment: Wet Pond surface area & storage volume calculations do not appear to meet the minimum design criteria. Revise design calculations. Response: The wet pond has been elongated (towards the boat basin) in order to provide the minimum average depth required. Average depth is now calculated on Sheet 3 in Appendix B of the Stormwater Narrative. Comment: Permanent pool elevation on supplement sheets does not match Plan Sheet 7. Response: Details on plan sheet 7 have been modified to match the rest of the design. Comment: Provide outlet structure detail for the pond. Response: The draw -down structure for the pond is actually integrated into the weir/level spreader outfall structure located to the northwest of the dry stack. See detail on sheet 7 for outlet structure detail. Comment: Site Plan raises some confusion regarding the location of the Tar -Pamlico buffer lines along NW corner of property. Further explanation is needed. Response: The buffer, as shown, runs parallel to the existing MHW line, with the exception of the bulkheaded section in the middle of the project along the boat slips, boat ramp, and boat -drop area, where the buffer follows the proposed alignment of the bulkhead (hence the labeling "proposed 30' buffer" and "proposed 50' buffer" - the buffer is simply following the proposed bulkhead alignment). This proposed bulkhead alignment is the subject of a Major CAMA permit and will not be installed unless fully permitted through CAMA. Comment: Vegetated Filter near NW corner of property appears to be located in a wetland area. Wetland types & jurisdiction is not clear. Under normal circumstances, the Division would not permit constructed stormwater measures in a natural wetland area. Suggest all stormwater measures be located on high ground. Response: As we have discussed, the vegetated filter was required in order to meet the City of Washington's Nutrient Removal requirements. Through additional review and discussions with the City, we have determined that the difference between our target Nitrogen level and the level achieved without the installation of the vegetated filter can be mitigated via the payment of a mitigation fee to NCEEP. As per our discussions in the field, the stormwater overflow will now be level - spread to the existing wetland (wooded 404 wetland) of the edge of the travel aisle via level spreader. All BMP's are now located within existing high -ground. ` Comment: Wet Pond design criteria calls for average depth to be a minimum of 3 feet. Response: The Wet Pond has been elongated towards the boat slips in order to provide a minimum average depth of 3.31 feet. Average Depth Calculations are provided on sheet 3 of Narrative Appendix B. Comment: It does not appear that the bio-retention filter can maintain adequate separation from the SHWT. Response: We have raised the bio-retention filter I' from its original design elevation in order to provide separation from the SHWT (new bottom elevation results in 1.7' of clearance from the bottom of the bio-retention basin to SHWT). It is anticipated that, with construction of the bio-retention basin and the associated removal of subsurface debris and old road bed that the SHWT will actually regulate itself lower than its current perched location, providing even more clearance from the bottom of the basin. We feel that the attached plans address the concerns raised during your first review of the plans and design and the attached design fits into your rules while representing a significant improvement over the existing condition. North Carolina Administrative Code 15 NCAC 2H.1000 requires that any project located in a coastal County that must receive either a Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit apply for and receive a Stormwater Management Permit by the Division of Water Quality. To obtain a Stormwater Permit you must submit a completed application, application fee of $505.00, two sets of plans and specifications showing the proposed project and all stormwater treatment units along with engineering calculations, soils report and a narrative description.
