Dear Mr. Smith,
This information is being provided in response to the items cited in the above referenced
document. Specifically, during an inspection of the Veolia, Creedmoor, NC facility the Division of
Water Quality, Raleigh Regional Office (RRO) noted the following deficiency:
The permittee had violated Part 11 Section 8 and C of its NPDES Stormwater permit for
failure to conduct analytical and qualitative monitoring at all three stormwater discharge
outfalls during Year 1 (February 1 to July 31, 2009). This office requests that both
qualitative and analytical monitoring be accomplished twice during Year 1 Period 2
(August 1 to December 31, 2009) and monitoring reports be mailed to the RRO by January
31, 2010.
In response to this notice of violation, Veolia has investigated the cause of the violation, and the
corrective action necessary to return to compliance.
Upon issuance of the NPDES permit, Veolia had contracted with MACTEC to conduct the required
qualitative and analytical monitoring. However, due to poor coordination between Veolia and
MACTEC personnel during Year 1 Period 1, there were no samples collected even though it
appears there were numerous representative storm events. As a corrective measure, Veolia
recently contacted MACTEC to review and reiterate the stormwater sampling obligations of the
Veolia NPDES permit and obtain assurances that MACTEC personnel would be readily available to
respond and monitor and collect samples at the Veolia facility during a representative storm event.
As a result of this meeting, Veolia is confident that compliance with the analytical and qualitative
monitoring requirements in the permit will be maintained going forward.

As a follow-up to this meeting, on September 17, 2009, MACTEC completed qualitative and
sampling of a rain event at the Creedmoor facility. Results of this sampling are included in
Attachment A. The analytical results indicate a pH of 5.8 at the East Outfall which is outside of the
benchmark value of 6-9. In response, Veolia has started the investigation as required under Tier
One and will continue with the subsequent inspections and documentation.
The second required sampling event for 2009 will be completed by Veolia after November 17,
2009, as the permit requires a time lapse of 60 days between sampling events. Veolia is committed
to complete the second sampling for 2009, however, Veolia disagrees with the agency that this
sampling needs to be completed by December 31, 2009. According to the information in the
permit, Year 1 Period 2 should run from August 1, 2009 - January 31, 2010 and allow the
monitoring reports to be submitted to RRO by February 28, 2010. Veolia requests that the RRO
respond that it agrees with this sampling event schedule.

As authorized by Kim Elmore's acceptance of Proposal No. 09-RAL-008A dated March 3, 2009,
MACTEC Engineering and Consulting, Inc. (MACTEC) is pleased to submit this Letter Report of
Stormwater-Sampling Services for the above -referenced site. The objective of our services was to
determine if the quality of stormwater runoff at the site has been adversely affected by daily operations at
the Veolia ES Technical Solutions facility.
Background Information
The subject site is the Veolia facility located at 2176 Will Suitt Road in Creedmoor, North Carolina
(Drawing 1). This facility is a permitted treater/storer/disposer of hazardous waste under the Resource
Conservation and Recovery Act (RCRA) of 1976. The Creedmoor facility receives pre -packaged wastes
from chemical and industrial clients, segregates the wastes based on the chemical characteristics, and
repackages the wastes as necessary for transport to an appropriate disposal facility. As part of stormwater
permit no. NCS000175, Veolia is required to conduct semi-annual stormwater-sampling events.
As proposed, our first sampling event was to be conducted between March I and August 31, 2009.
However, we did not conduct that event due to unfavorable weather conditions. Consequently, the North
Carolina Department of Environment and Natural Resources (NCDENR) issued a Notice of Violation
dated September 10, 2009 for failing to conduct the sampling event.
Field Activities
On September 17, 2009, you informed MACTEC that a storm event greater than 0.1 inches of rainfall was
taking place and that the flow at the outfalls was sufficient to collect stormwater samples. Matthew Gillis
of MACTEC mobilized to the subject site and observed that 0.25 inches of rain had accumulated in the
rain gauge. MACTEC collected stormwater samples from each of the outfalls (West Outfall, Middle
Outfall and East Outfall) at the subject site. The locations of these outfalls are shown on Drawing 2.

MACTEC made observations of the qualitative characteristics as shown in Table 4 of the stormwater
permit.
MACTEC submitted the stormwater samples to Environmental Conservation Laboratories, Inc. (ENCO)
for testing for total nitrogen according to EPA Methods 353.2/351.2, for total phosphorus according to EPA
Method 365.4, for total suspended solids according to EPA Method 160.2, and for oil and grease according
to Standard Method 1664.
Results of the Testing
Table I summarizes our observations of the qualitative characteristics of the stormwater samples. Table 2
summarizes the laboratory test results. The laboratory test reports and chain -of -custody records are
attached in Appendix A. ENCO measured a pH of 5.4 in the stormwater sample collected from the East
Outfall. At the request of Veolia, ENCO reran the East Outfall sample and measured a pH of 5.9. These
values are outside the permitted National Pollutant Discharge Elimination System (NPDES) Permit
Benchmark range of 6 to 9 standard units. The remaining pH values and analyte concentrations are
within the values allowed for the stormwater permit. The NPDES Permit states that if the sampling
results are above a benchmark value, or outside of the benchmark range, for any parameter at any outfall a
tiered program shall be implemented.
Conclusions and Recommendations
The laboratory measured pH's of 5.4 and 5.9 in the stormwater sample from the East Outfall. These
values are outside the range allowed under the permit. In accordance with the permit, Veolia should
implement a Tier One program.
This report is intended for the sole use of Veolia. The contents should not be relied upon by other parties
without the expressed, written consent of Veolia and MACTEC.

On August 27, 2009, Cheng Zhang of the Raleigh Regional Office (RRO) conducted a
Stormwater Compliance Evaluation Inspection at Veolia ES Technical Solutions. Your
assistance was greatly appreciated. The inspection report is attached. Findings during the
inspection were as follows:
1. NPDES individual stormwater permit NCS000175 was issued to Veolia ES Technical
Solutions to discharge stormwater runoff to a nearby creek.
2. The current permit was issued and became effective on February 1, 2009
3. The facility has developed a Stormwater Pollution Prevention Plan (SPPP). The plan
includes all components required by the permit.
4. The new permit requires the permittee to conduct qualitative and analytical
monitoring at all three stormwater discharge outfalls semi-annually. It was noted that
MACTEC Engineering and Consulting, Inc. was under a contract to conduct both
qualitative and analytical monitoring for the permittee. It was also noted that neither
qualitative nor analytical monitoring was conducted during Year 1 Period 1 (February
1 to July 31, 2009). On August 26, 2009, MECTEC stated that there were no qualified

representative storm events during the period thus no monitoring could be conducted.
This statement is not acceptable, for the following reasons:
There were not detailed daily rainfall records from the permittee or contractor
to support the statement
US Geological Survey (USGS) daily rainfall records from a site in vicinity to
the facility show that there were plenty of storm events that qualified as state
defined representative storm events during the period
Therefore,.the permittee had violated Part Il Section B and C of its NPDES
Stormwater permit for failure to conduct analytical and qualitative monitoring at all
three stormwater discharge outfalls during Year 1 Period 1 (February 1 to July 31,
2009). This office requests that both qualitative and analytical monitoring be
accomplished twice during Year 1 Period 2 (August 1 to December 31, 2009) and
monitoring reports be mailed to RRO by January 31, 2010. This office will review
your response to determine whether or not civil penalty assessment is appropriate.
Please respond to the Raleigh Regional Office by October 10, 2009, at the addresses listed
below, as to the cause of the above violations, plans for resolution, plans for monitoring, and
plans for prevention of future violations.

On July 24, 2008 I (Myrl Nisely) made a compliance inspection of the Veolia TSD facility with your help.
It was a pleasure meeting you. The transfer facility was in compliance. Please see the attached inspection
checklist. Below are the highlights from our discussion.
1. The Stormwater Pollution Prevention Plan (SP3) was current in every respect. There was a separate
page on which annual updates of the plan were documented, a helpful feature. The stormwater
program was observed to be proactive, striving to prevent problems.
2. This permit expired 8/31/2006 and DWQ has not yet issued a renewal. This matter will be brought
to the attention of the permitting unit.
