Dear Mr. Poole:
The Wilmington Regional Office received a modification to the Stormwater Management Permit Application for Waste
Industries, Wilmington District Facility on March 7, 1997, with final information on July 17, 1997. Staff review of the
plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth
in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 880213 Modification dated August 4, 1997, for the
construction of Waste Industries, Wilmington District Facility.
This permit shall be effective from the date of issuance until August 4, 2007, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

.1000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the. Division of Water Quality and considered a part
of this permit.
This permit shall be effective from the date of issuance until August 4, 2007 and shall be subject to the following specified
conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this
permit, the Project Data Sheet. The front basin has been designed to handle the runoff from 36,590 square feet of
impervious area, and the rear pon for 152,896 square feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.

4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved
plans.
5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -
upon area.
6. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan
In addition, the Director may determine that other revisions to the project should require a modification to the
permit.
7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the stormwater
management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's
intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
4. This permit shall.become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.

5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted .facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the crcation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
5. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components
of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

Permit Application for Waste Industries, Inc. on April 14, 1997. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater review:
1. Please add the specific inlet/outlet elevations to the catch basin/bypass mechanism details.
2. Please indicate that the overflow opening for CB-1B will be on the same side as the inlet pipe.
3. The revised calculation sheets must be sealed.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to June 1, 1997, or the application will be returned as incomplete.

I am enclosing the revised plans and requested documents as per your review comments.
Additionally, I wish to address each comment item as follows:
1. Application form revised to address each infiltration basin.
2. Mr. Poole's title (Vice President of Support Services) has been added to the applications.
3. A signed Operation and Maintenance Plan is enclosed.
4. Catch Basin are detailed on the Grading Plan (Sheet 3) and enclosed.
5. Pavement elevations are shown and the grading scheme adjusted to direct the surface flows to
the appropriated drainage structure and infiltration basin.
6. The existing swales are shown on the Grading Plan (Sheet 3).
7. The two catch basins serving the rear basin are designed as a bypass after the required pond
volume has been obtained. My intent is to have an open throat inlet (2 sides) with a concrete
slab top located in a conveyance channel. The opening is proposed to be 1'x 4' and the
invert of the opening set to equal the proposed max. volume water elevation. The opening
will align with the channel and allow the excess flow to pass and exit the site. A channel is
proposed around the pond with a release at the property corner.
8. I have revised the infiltration calculations to reflect the total drainage area in accordance with
the process outlined in the NC DEHNR publication "Stormwater Best Management.
Practices" November, 1995.

Dear Mr. Braxton:
The Wilmington Regional Office received a modification to the Stormwater Management Permit
Application for Waste Industries, Inc. on March 7, 1997. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue the
stormwater review:
1. Please split up the statistics for each infiltration basin on the application form. Use both
columns, and list the requested information for each. Please realize that the total project area
is not the same as the impervious area.
2. Add Mr. Poole's title to the application..
3. A signed Operation and Maintenance Plan, copy attached.
4. Please specifically detail the 4 catch basins that act as the bypass mechanisms. See #7 below.
5. Please show some existing pavement elevations along the entrance drive to verify that runoff
from the west side of the proposed recycle center drive will actually be collected by DI -#5.
All nmoff from the proposed impervious areas must be collected and sent to the basin. None
may leave the site without treatment.

6. There is supposed to be an existing swale to collect the existing parking lot runoff graded
/ from the existing paved drive into the front basin. Please show this swale on the plans.
7. In order to permit the modification to rear pond without a bypass, the 25 year, 24 hour storm
must be stored and infiltrated. Otherwise, please redesign the inlet CB's with a bypass
mechanism.
v 8. The volume calculation is based on the entire drainage area to the basin, not just the.
impervious areas. Please revise the calculations.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to April 14, 1997, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.

PROJECT OWNERSHIP
THE SITE OF THIS PROPOSED WORK IS OWNED BY WASTE INDUSTRIES, INC., 3949
BROWNING PLACE, RALEIGH, NC, A RALEIGH BASED SOLID WASTE MANAGEMENT
COMPANY. THE EXISTING FACILITY IS A DISTRICT FACILITY HOUSING THE
ADMINISTRATIVE OFFICES, COLLECTION VEHICLE AND CONTAINER MAINTENANCE
AND LIMITED RECYCLING FUNCTIONS.
PROJECT DESCRIPTION
THE PROPOSED WORK SHALL INCLUDE THE SITE EXPANSION OF AN INDUSTRIAL
FACILITY TO ACCOMODATE THE ADDITIONAL STRUCTURES AND THE REQUIRED
PARKING AREAS. AT PRESENT, THE FACILITY HOUSES THE DISTRICT COLLECTION
OPERATIONS AND ADMINISTRATIVE OFFICES. THE PROPOSED EXPANSION WILL
CREATE A SOLID WASTE MANAGEMENT FACILITY TO INCLUDE THE ADDITIONAL
FUNCTIONS OF RECYCLING AND CARDBOARD PROCESSING. THE FINAL COMPLEX IS
VIEWED AS A COMPREHENSIVE WASTE MANAGEMENT FACILITY INTENDED TO
REDUCE THE WASTE STREAM AS MANDATED BY REGULATIONS.
SITE DESCRIPTION
THE WASTE INDUSTRIES, INC. WILMINGTON DISTRICT FACILITY IS LOCATED ON THE
NORTHEAST SIDE OF HIGHWAY 421 NORTH, APPROXIMATELY 3 MILES FROM
WILMINGTON, NC. THE SITE IS 6.428 ACRES WITH APPROXIMATELY 4.5 ACRES
DEVELOPED. THE UNDEVELOPED SECTIONS IS LOCATED ADJACENT TO HWY 421 AND
IS CHARACTERIZED AS A KNOLL COVERED WITH PINE VEGETATION. THE SITE'S SOIL
CI'.ARACTERISTICS ARE SILTY SANDS AND CLEAN FREE-DRA,'NAING SANDS. THE
ESTABLISHED INFILTRATION RATES RANGE FROM 22 TO 110 GALLONS PER HOUR PER
SQUARE FOOT. THE SITE'S LANDSCAPE POSITION IS CONSIDERED "RIDGE TOP" WITH
POSITIVE OFF -SITE DRAINAGE AND NO ON -SITE DRAINAGE FROM ADJACENT AREAS.

A STORMWATER PERMIT IS REQUIRED FOR THIS PROJECT FROM THE NORTH
CAROLINA DEPARTMENT OF ENVIRONMENTAL HEALTH AND NATURAL RESOURCES.
THE SITE IS CONSIDERED HIGH DENSITY WITH AN INFILTRATION SYSTEM DESIGNED
TO CONTOL RUNOFF VOLUME CREATED BY A ONE INCH RAINFALL FROM THE
IMPERVIOUS SURFACES.

CULVERTS: THE CULVERTS WERE SIZED FOR THE Q10 FLOW. THE OUTLET
PROTECTION WAS BASED ON Q10, V10 AND SIZED ACCORDING TO THE NYDOT CHART
AND THE, NRCD PROGRAM. TH`E V10 AND DEPTH OF FLOW WERE DETERMINED BY THE
NRCD PROGRAM MODEL AND THE STONE SIZE CHECKED VIA TRACTIVE FORCE.
DITCHES: THE DITCHES WERE CHECKED BY MANNINGS AT Q10 WITH A GRASSED
LINING (n=0.03) AND A MAX. ALLOWABLE VELOCITY OF V=4.0 fps. ALL DITCH
SECTIONS WITH A V10 > 4.0 fps WERE DETERMINED TO REQUIRE ARMOR AS A
PERMANENT LINING. NO DITCH SECTION RELATED TO THIS PROJECT WERE
COMPUTED TO REQUIRE ARMOR. EACH GRASSED LINED CHANNEL WAS TESTED FOR
A TEMPORARY LINING AT Q2, V2 WITH A MAX. ALLOWABLE VELOCITY OF 2.5 fps. IF
NEEDED, THE CHANNELS WERE TESTED AND DESIGNED FOR VARIOUS TEMPORARY
LININGS CONSISTENT WITH THE ALLOWABLE SHEAR STRESS.
SPECIAL CONDITIONS
AS PART OF THE STORMWATER MANAGEMENT PLAN, THE STORMWATER
CONVEYANCE SYSTEM WAS DESIGNED TO DIRECT THE REQUIRED INFILTRATION
VOLUME (ONE INCH x IMPERVIOUS AREA) TO THE INFILTRATION PONDS AND ALLOW
THE REMAING FLOW TO BYPASS. THIS WAS ACCOMPLISHED BY CAPTURING THE
SURFACE FLOW IN A SUBSURFACE SYSTEM. THE OUTLET PIPE WAS SET TO
OVERFLOW WREN THE INFILTRATION POND VOLUME WAS OBTAINED. THE
OVERFLOW SYSTEMS WERE EITHER A SECOND PIPE SET AT THE OVERFLOW
ELEVATION OR AN OPEN CATCH BASIN (WITH CONCRETE LID) THAT ALLOWS THE
OVERFLOW TO PASS THROUGH TO AN OPEN CHP2INEL.
SEDIMENTATION CONTROL MEASURES
ALL SEDIMENTATION CONTROL MEASURES WERE SIZED BASED ON 1,800 CF/YR/AC OF
DENUDED ARE)i WITH A 12 MONTH CAPACITY. ALL WEIR DESIGNS WERE BASED ON
THE CONTRIBUTING DRAINAGE AREA AND SIZED ACCORDING TO THE NC-S&E
PLANNING AND DESIGN MANUEL. THE PROPOSED MEASURES INCLUDE SEDIMENT

SAME has recently completed an infiltration study of the subsurface
soils encountered at the proposed Waste Industries Branch Facility site located
on the eastern side of U.S. Highway 421 north of Wilmington, North Carolina.
As requested, our infiltration testing was conducted at each of the
designated locations to a depth of four feet below the existing ground surface.
At each test location, our personnel visually classified the in —place soils and
measured the depth to groundwater, if encountered during the field testing
work. Representative samples of the in —place soils were also obtained and
subjected to laboratory gradation testing in accordance with the American
Society f- r_,a Tes wing and Materials (ASTM) test procedure entitled ASTM D-422,
"Standard M6thod for Particle —Size Analysis of Soils."

CompHance with Stormwater Regulations for Waste Industries. Stormwater Regulation 15A NC:AC
2H.1003(k)(3) stipulates the following:
Upon completion of construction, a registered professional appropriate for the type of
Stormwater system designed must certify that the system was inspected during
construction and was constructed in substantial conformity with plans and specifications
reviewed by the Division and complies with the requirements of this rule.
As of this date, our records indicate the required engineer's certification has not been
received. Operation of the stormwater systern prior to submission of the required certification is in
violation of NCAC 2H.1003(1) in accordance with NCGS 143`215.6A. On July 23, 1991, a Notice of
Violation was issued for failure to construct the stoymwatw controls. The controls have since been
constructed and Mr. Henry Webster, P.B. desponded on October 2, 1991 with a conditional
certification (copy attache!). Please verify that the conditions have been met and arrange to have the
attached Certification completed and returned immediately.

Project No. 880213 - Waste Industries, Inc.

Waste Industries Inc., proposes to construct a truck servicing
facility to repair, fuel, wash and store trucks. The proposed site
is located approximately 3 miles North of Wilmington on U.S.
Highway 421.
According to the plans and supporting data, the applicant proposes
to construct an office, a shop, and parking areas totaling 3.65
acres of built -upon area. The applicant proposes to construct 3
infiltration basins on the site to collect at least 1 inch volume
of runoff. Soil data indicates that infiltration rates are
extremely, rapid in this area ranging from 22 gal./hr/ft2 to 110
gal. /hr/ft2 .
Stormwater runoff is designed to sheet flow off the parking areas
into swales prior to entering the 3 basins. Three monitoring wells
and a maintenance plan have also been included in the plans. The
site is located approximately 4000 feet from the Northeast Cape
Fear River, classified "C-Swampwater".
It is recommended that the proposed project be presented to the
director for certification that the stormwater runoff from the site
poses no threat to surface waters due to the distance to classified
waters, and the fact that the applicant has proposed mitigative
controls by designing a system which meets the intent of the
stormwater regulations. A draft certification form is attached for
your review and consideration.

Dear Mr. Annis:
S&ME has recently completed an infiltration study of the subsurface
soils encountered at the proposed Waste Industries Branch Facility site located
on the eastern side of U.S. Highway 421 north of Wilmington, North Carolina.
As requested, our infiltration testing was conducted at each of the
designated locations to a depth of four feet below the existing ground surface.
At each test location, our personnel visually classified the in --place soils and
measured the depth to groundwater, if encountered during the field testing
work. Representative samples of the in -place soils were also obtained and
subjected to laboratory gradation testing in accordance with the American
Society for Testing and Materials (ASTM) test procedure entitled ASTM D-422,
"Standard Method for Particle -Size Analysis of Soils."
Based on the results of our field and laboratory testing, the
on -site soils consisted mainly of silty sands and clean free -draining sands.
The infiltration rates at the three test locations ranged from 22 to 110
gallons per hour per square foot.

Dear Mr. Williams:
We are enclosing three prints of the storm water
management plan for the referenced project.
Also included is a location map showing the site,
which is approximately 4000 feet from the N.E. Cape Fear
River. As indicated on the location map, a sand pit
operation is located between the proposed site and the N.E.
Cape Fear River.
We propose to utilize three infiltration basins to
retain the first inch of run-off from the impervious areas.
The three areas were bored to a depth of eight feet without
any indication of reaching the seasonal high water table.
Also as per our conversation, the owner has acquired
Soil & Material Engineers to perform an infiltration test.
The volume of the infiltration basins are as follows:
Basin #1 - drainage area = 0.33 acres
volume of storage = 1208 cu. ft.
basin size = 2.51 x 15' x 32'
Basin #2 - drainage area = 1.66 acres
volume of storage = 6026.cu. ft.
basin size = 4' x 30' x 50'
Basin #3 - same as Basin #2

The Environmental Management Commission (EMC) recently adopted
new stormwater regulations which became effective on 1 January
1988. The new rules will affect much of the development taking
place in the 20 coastal counties. Any development project
located in a coastal county that is required to submit a
Sedimentation and Erosion Control Plan to a State, County or City
review agency, must comply with the newly adopted Stormwater
Regulations.
The Division of Environmental Management has received a copy of
your Sedimentation & Erosion Control Plan (or your Stormwater
Management Plan) for the subject project. At this time your
submittal concerning Stormwater Management:
Appears to be complete, and your project will be reviewed as
soon as possible.
Is not complete. The following information is needed to
complete your submittal. Please submit the following items
within 30 days, or your project will be returned as
incomplete.
For projects using density limits approach.
A site plan that clearly indicates all built -upon
areas (i.e., streets, driveways, walkways, building
footprints, etc.).
Computations showing the percent built upon areas,
both existing and planned.
A copy of deed restriction(s) and restrictive
covenants which include the State as a beneficiary.
The attached submittal form should be completed for
projects using the density limits approach.

For projects involving an engineered Stormwater
Management System.
Plan and profile drawings of the collection and/or
disposal systems.

Computations or other criteria used to support
design of the system.
Volume of runoff.
Volume of containment/disposal system.
Dewatering time of containment/disposal
system.

Supporting data concerning the hydrogeology of the
site:
Seasonal high water table.
Infiltration capacity - saturated hydraulic
conductivity.

A complete stormwater maintenance manual including
responsible party, quantitative and qualitative
criteria which would indicate when corrective
maintenance is required, and a periodic maintenance
