I am in receipt of your letter dated January 19, 2005 for the above referenced project
requesting additional information to continue your review. 'The information requested
has been addressed as follows:
1. The sidewalks have been added to the typical road cross sections and are
included on the enclosed drawings. All sidewalks to be constructed have been
included in the built -upon calculations. Since the sidewalks will be inside the
right-of-ways I have shown the impervious only under the sidewalk portion of
the application which was modified. The 23,360sf was included in error
under the wrong box in the application and has been revised and is attached
with this submittal.
2. The swale calculations have been revised to the actual dimensions of each
swale and are attached. The proposed swales were calculated correctly,
however the information for the bottoms and side slopes for each swale were
not represented properly.
If you have any additional questions or concerns, please do not hesitate to contact me.

Dear Mr. Mercer:
The Wilmington Regional Office received a Stormwater Management Permit Application for
Old Beaufort Village- Phase 5 on January 19, 2005. A preliminary review of that information
has determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. Please add the sidewalks as indicated on the site plan to the street details. For
example, the site plan indicates that Professional Park Drive has a sidewalk on one
side, but no sidewalk is indicated on the Professional Park Drive detail. Please
revise the detail to show the sidewalk. Also, the site plan indicates that Calhoun
Street has sidewalks on both sides of the street, but the detail shows sidewalks on
only one side, Either change the wording of the detail to read, "4' Sidewalk, typical
both sides" or add sidewalks to both sides of the street detail. Please add sidewalks
as appropriate to the typical residential street cross-section detail. Please include all
sidewalks in your built -upon area calculations.
2. The General Grading and Stormwater Management gent Plan indicates that Swale #4
has a 2' bottom width and that Swale #3 has a 10:1 side slope. However, the Swale
Design Data Table indicates that all swales have 10' bottom widths with a 5:1 side
slopes. Please revise the information in the Swale Design Data Table Calculation to
reflect the actual bottom widths and side slopes.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to February 2, 2005, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 60 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143415.6A.

A. Description of Project

Old Beaufort Village, Phase 5 is a planned residential community offering housing in Beaufort,
located in Carteret County. The project consists of forty-eight lots for single family residences.
The project is being proposed as low density with impervious surfaces totaling 30% of the tract
(see plans for allotments). The project is proposing curb outlets with required vegetative swales for the
treatment of stormwater. Stormwater runoff drains to Gable Creek, more than one-half mile from the
project site. Gable Creek is classified as an SA water.
B. Erosion and Sedimentation Control Measures
The following measures are proposed for the site. If it becomes evident that additional erosion and
sedimentation control measures are needed, they shall be installed immediately. It is intended that all
grading and excavation activities within a certain area will be protected as soon as that activity is
complete.
1. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or
as deemed necessary by the engineer to insure that off -site sedimentation is controlled.
2. Seeding — All disturbed areas will be seeded within 14 days following construction in accordance
with the seeding schedule shown on the plans.
3. Stone Construction Entrance — Stone construction entrance will be used to reduce transport of
sediment off site.
4. Temporary Sediment Traps — Sediment traps will be constructed as shown on plans and serve to
trap sediment and prevent from the sediment moving off -site.
Maintenance Plan
All erosion and sediment control measures shall be checked for stability and effective operations
following every runoff producing rainfall event or at least once per week. Repairs required shall
be completed immediately to the dimension and functions indicated on the plans.
Sediment shall be removed form behind the sediment fencing when it becomes 0.5 feet deep at the
fence. The fence shall be replaced or repaired as necessary to maintain a barrier.
All seeded areas shall be fertilized, seeded and mulched within 15 days of disturbance. Disturbed
areas shall be fertilized, reseeded and mulched as necessary according to the Contract documents
to establish and maintain a dense vegetative cover.
Construction Sequence
1. Grub areas within right of way, drainage and utility easements.
2. Install stone construction entrance.
3. Install silt fencing as located on plans within area of construction.
4. Fill existing ditches as shown, construct drainage swales and temporary sediment traps, where
specified. Install excelsior control blanket within all swales and newly constructed ditches. Seed
constructed ditches and sod 100' vegetated swales within 14 days of land disturbance.
5. Rough grade area within right-of-way
6. Install utilities, including catch basins.
7. Fine grade street area and seed areas to remain outside of paved area.
8. Install curb and gutter and drainage outlet flumes and place CABC.
9. Pave street.
10. Perform final seeding and mulching.
11. Remove temporary sediment traps within drainage area once all lots within said drainage area
have been developed and drainage swales are stabilized.
C. Design Assumptions
1. Design storm is ten years.
2. The rational method was used for the design.
D. Coastal Stormwater Regulations
The North Carolina Division of Environmental Management implemented coastal stormwater
regulations in coastal counties on January 1, 1988. These regulations are detailed in 15 NCAC
2H.1000 Stormwater Management. These rules allow for a development to be considered under
various options. This project is submitted for approval consideration under Section .1003(d)(1) low
density development.

YOU ARE CORRECT. THE MAP THAT WAS SUBMITTED DID NOT STATE THAT NOELLE
HAD MADE THE CALL IT ONLY INDICATED THE PROJECT IN RELATIONSHIP TO THE
1/2 MILE ARC. RON INFORMED ME LATER THAT HE MET WITH NOELLE NOT LONG
AFTER THE NEW 1/2 MILE RULE TO SA WATERS CAME INTO EFFECT, SO THAT THE
DEVELOPER WOULD KNOW WHAT HIS OPTIONS WERE FOR THE PROPERTY.

THIS FIFTH SUPPLEMENTAL AMENDMENT executed this day of ,
2005, by Mercer Building Company, a North Carolina Corporation, Professional Drive, Beaufort,
North C arolina, herein "D eclarant"; and any and all p ersons, firms and c orporations h ereafter
acquiring any of the lots within Olde Beaufort Village Subdivision;
WITNESSETH:
WHEREAS, Mercer Building Company has here therefore executed and recorded in Book
880, page 325, Carteret County Registry, a comprehensive set of Covenants, Conditions and
Restrictions for Olde Beaufort Village Subdivision which are applicable to lots 1 through 12, 49, and
81 through 92, Phase I, Olde Beaufort Village, as shown on a plat recorded in Map Book 29, Page
850, Carteret County Registry;
WHEREAS, Declarant thereafter executed and recorded a technical amendment to said
Covenants in Book 901 at Page 262, Carteret County Registry, and there after conveyed the area
described on Exhibit A to said Restrictive Covenants in Book 880, Page 325, Carteret County
Registry, to East Carolina Community Development, Inc. by Deed recorded in Book 880, Page 341,
Carteret CountyRegistry, and East Carolina Community Development, Inc. thereafter recorded a l't
Supplemental Amendment to the Declaration of Covenants, Conditions and Restrictions for Olde
Beaufort Village Subdivision in Book 918, Page 680, Carteret County Registry;
WHEREAS, Declarant reserved the right in Section VII to add additional properties to said
Covenants and to have said Covenants binding on and run with the additional properties, and
Declarant now desires to bring the additional properties described herein under the terms of said
Declaration for said Subdivision;
WHEREAS, Declarant thereafter executed and recorded a 2nd Supplemental Amendment to
the Declaration of Covenants, Conditions and Restrictions for Olde Beaufort Village Subdivision
in Book 944, Page 379, Carteret County Registry, which made the lots described as Lots 50 - 56 and
73 - 80, Phase III, as shown on the plat recorded in Map Book 30, Page 136, Carteret County
Registry, subject to the Restrictive Covenants for Olde Beaufort Village Subdivision;
WHEREAS, Declarant thereafter executed and recorded a 3Td and 4t'' Supplemental
Amendments to the Declaration in Book 1026, page 228 and Book 1058, page 38, respectively,
which made lots 57-72, Phase III, and lots 13-48, Phase IV, as shown on a Stroud Engineering Plats
recorded in Map Book 30, page 362 and Map Book 30, page 504, Carteret County Registry, subject
to said Declaration as recorded in Book 944, page 379, as amended;
WHEREAS, Declarant now desires to bring additional properties described herein under the
terms of said Declaration;
NOW, THEREFORE, in accordance with Section VII of said Declaration, Declarant hereby
amends said Declaration by adding the additional lots as follows:
1. Section II (1) is amended to read as follows:
A. Applicability. The real property described on Exhibit A to the Declaration recorded in
Book 880, Page 325, consisting of Lots 1-12,49, and 81 through 92, Phase I, Olde Beaufort Village
Subdivision, as shown on a plat recorded in Map Book 29, Page 840, Carteret County Registry, and
Lots 50 through 56 and 73 through 80, Phase III, as shown on a plat recorded in Map Book 30, Page
136, Carteret County Registry are subject to the operation of these Covenants. Lots 57 through 72,
Phase III, as shown on a Stroud Engineering Plat recorded in Map Book 30, Page 362, Carteret
County Registry, are further made subject to the operation of these Covenants. Additionally, lots
13-48, Phase IV, as shown on a Stroud Engineering Plat recorded in Map Book 30, page 504. And
lots 1-48, Phase V, as shown on a plat recorded in Map Book , page , Carteret County
Registry, are hereby made subject to the operation of these Covenants.
B. Subparagraph A under Section IV (3) in said Declaration is amended to provide as
applicable that the building setbacks on any lot on and after the recordation of this Amendment shall
be twenty five (25) feet for the front, thirty (30) feet for the rear, and eight (8) feet for the side.
C. The impervious surface restrictions applicable to the lots in Phase V shall be a set forth
on Exhibit A to this 5t' amendment to the Covenants attached hereto and incorporated herein by
reference. The exhibit restricts each lot referenced to the allowable built -upon areas shown..
D. "Reserved or Park Area". The Declarant reserves the right to convey the area designated
"reserved" or "Park Area" as shown on the plat for Phase V to the Town. of Beaufort, and said area
is excepted from this amendment and the Covenants for Olde Beaufort Village and is not subject to
the same.

2. Binding effect. From and after the date of recording this Amendment shall be binding on the
owners of said lots subject to these Covenants and their heirs, successors and interest and assigns,
and said Covenants shall run with said lots.
