A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SW960401 for a stormwater treatment system consisting of two
infiltration basins serving Colington Speedway located at 1064 Colington Road, Kill
Devil Hills, NC expires on March 6, 2021. This is a reminder that permit renewal
applications are due 180 days prior to expiration. We do not have a record of receiving
a renewal application.
This permit was originally issued to Jimmie Summerell. A search of the Dare County tax
records indication that the property is now owned by Walker Boys Investment Holdings,
LLC. The Coastal stormwater rules and the NC General Statutes require a stormwater
permit for this project. Stormwater permits are not automatically transferred when
property is sold. Please submit a completed permit renewal application and a
stormwater ownership transfer application along with a $505.00 processing fee. Permit
application forms for renewal and ownership transfer can be found on our website at:

The Washington Regional Office received your completed
Stormwater Application for the subject project on December 18,
2006. Staff review of the plans and specifications has determined
that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW7960401 dated March 6, 2007 to Mr. Jimmie
Summerell.
This permit shall be effective from the date of issuance
until March 6, 2017 and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and
maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the
form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-
7447. Unless such demands are made this permit shall be final and
binding.

(hereafter referred to as the "stormwater rules") and the approved
stormwater management plans and. specifications and other

Colington Road at Kill Devil Hills, NC.
This permit shall be effective from the date of issuance until
March 6, 2017, and shall be subject to the following specified

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and
volume of stormwater described in the application and other
supporting data.
2. This stormwater system has been approved for the management.
of stormwater runoff as described on page 4 of this permit,
the Project Data Sheet.
3. Approved plans and specifications for this project are
incorporated by reference and are enforceable parts of the
permit.

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales)
shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit
and receiving approval from the Division.
5. The following items will require a modification to the
permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign 'or addition to the approved amount of built -
upon area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes
have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed
in its entirety, vegetated and operational for its
intended use prior to the construction of any built -
upon surfaces except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2. The facilities must be properly maintained and operated at
all times. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the
scheduled intervals.
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:

a. Semi-annual scheduled inspections (every 6 months)
b. Sediment removal .
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of
this permitted facility, a certification must be received
from an appropriate designer for the system installed
certifying that the permitted facility has been installed in
accordance with this permit, the approved plans and
specifications, and other supporting documentation. Mail the
Certification to the Washington Regional Office, 943
Washington Square Mall, Washington, North Carolina, 27889,
attention Division of Water Quality.
7. A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance
conditions, the Permittee .shall take immediate corrective
action, including those as may be required by this Division,
such as the construction of additional or replacement
stormwater management systems.
5. The permit may be modified, revoked and reissued or
terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does
not stay any permit condition.
6. At least 6 months prior to the expiration date, the permittee
shall request that this permit be renewed.

NARRATIVE DESCRIPTION AND, UPDATE OF PROJECT STATUS
REVISED DECEMBER 15, 2006
This, narrative is prepared,to provide an update regarding the as -built condition of the
existing facility and'the stormwater management BMP's. In March of 2006 the Div. of .
Water Quality notified the permittee, Mr. Jimmie Summerell of the requirement to renew
the stormwater permit referenced above and to provide the Designer's Certification for
the as -built condition of the project and the associated infiltration basins. The Engineer
was asked to inspect the project to confirm conformance with the approved plans. The
initial inspection resulted in the observation that there were certain minor inconsistencies
between the site plan as designed and as built. Therefore, Mr: Robert.Cummins, P.L.S.
` was retained to perform a physical survey, to reflect the existing features and topographic
information. Based on the as built survey by" Mr. Cummins, calculations for coverage and
required storage volume in the two infiltration basins were revised. Mr. Summerell.
regraded the existing basins to restore uniform bottom elevations and proper side slopes..
The deviations between the, approved plan were generally very slight and the stormwater.
BMP was functioning effectively. The most significant inconsistency is the presence of a
small area of standing water in the northern section of Basin "B". Mr. Summerell reports "
that he was unaware of this low area, which can be described as a shallow pond, prior to
clearing the areato construct the designed basins. The "pond", approximately•1'-3' deep,
was in a heavily wooded area, near the property line, and was not detected prior to'Mr.
•Summerell's developing of the siteAt is proposed to leave this wet area in its current
state due to the adverse environmental impacts of filling it or digging it deeper. Thebasin,
functions very effectively and recent observations have shown the normally dry areas to "
draw down in approximately three days after torrential rains, well in excess of I".
Prior to Mr. Summerell's ownership, the tract was used as a concrete production plant., .
The previous owners left sizable masses of concrete buried and/or partially buried in-
numerous locations. These concrete deposits have created significant constraints to the '
owner in attempting to grade the basins to the exact lines and slopes originally specified. '
However, the original basins were in fact constructed in substantial conformance with the
original plans and at no time was there any direct discharge of run-off stormwater into. the'
adjacent on -site wetlands.or on to.the adjacent properties. The BMP's, ascurrently
constructed,'provide storage, capacity equivalent to'a 2.12* * inch rainfall event for Basin
"A" and a,2.37** inch rainfall event for•Basin "B". Summary" Calculations for the
drainage areas and associated basins are provided on the plan sheet submitted with the
Permit -Renewal Application package. Complete calculations are also provided on
separate sheet. .
The 250 feet of marsh, through which'overflow water sheet flows, is adjacent to
Colington Creek. This creek is non -SA waters. Therefore the design storm event is F'
rainfall. The basins, as constructed, have capacities more than double the design storm
runoff'volume, as demonstrated in the.attached calculations.

This letter is written in response to correspondence dated May 14, 2006 from Mr. Al
Hodge of D.WQ to Dana Summerell (the letter uses Mr., it should be Mrs.): Jimmie and
Dana Summerell are the owners of Colington Speedway and the permit holders for the -
"above referenced permit. Mr:'Hodge, in a telephone `conversation on 5/1'1/06; indicated
that you are theperson I:that I should correspondence with: Shortly after receiving Mr.
Hodge's letter Mr.. Summerell contacted me to assist him in preparing the Engineer's
Certification and permit renewal application. I met with Mr. Summerell at the -project site '
to verify that the project was built in accordance with the'plans.that I. had prepared and
which, were ultimately approved. I surmised that the site improvements were slightly,'
inconsistent with the plans. Also, a portion of the areas designated for infiltration was
discovered during construction to contain a small pond. This area wasembedded in dense'
woods prior to Mr. Summerell :beginning construction and he was unaware of its
existence until he attempted to construct the designed basins. I explained to Mr.
. Summerell that an "as -built" survey will'be required in order for to evaluate.the
deviations in the extent of covered area and to devise a BMP which can incorporate the . .
existing "pond" referenced above into our overall project plan for stormwater
management. Mr. Summerell has retained a'professional land surveyor to perform,the .
work. I met with the surveyor on May 8, 2006 to give him directions regarding the scope
of topographic. information I will need. He has completed his field work but as of this '.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW 7960401
to Jimmie Summerell for Colington Speedway on 5/29/1996. This permit expires on 5/30/2006. Section
.1003(h) of 15 A NCAC 2H .1000 (the stormwaterrules) requires that applications for permit renewals
shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete and
submit the enclosed renewal application in a timely manner. If this project has not been constructed
and a permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

infiltration basins to serve Colington 'Speedway located near
Colington, NC.
This permit shall be effective from the date of issuance until May
30, 2006, and shall be subject to the following specified
conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and
volume of stormwater described in the application and other
supporting data.
2. This stormwater system has been approved for the management of
stormwater runoff as described on pages 4 and 5 of this
permit, the Project Data Sheet(s).
3. Approved plans and specifications for this .project are
incorporated by reference and are enforceable parts of the
permit.

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -upon
area
e. Further subdivision of the project area..
In addition, the Director may determine the other revisions to
the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surfaces
except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2. The facilities must be properly maintained and operated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.

3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made
available upon request to authorized personnel of DEM. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designed for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional Office, 1424 Carolina Avenue, Washington,
North Carolina, 27889, attention Water Quality Section.
7.' A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change to the Permittee, a formal permit request must be
submitted to the Division of Environmental Management
accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered
on its merits and may, or may not be approved.
2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Environmental Management, in accordance
with North Carolina General Statute 143-215.6(a) to 143-
215.6(c).

3. The issuance of this permit does not 'preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

LOW DENSITY PROJECTS
GENERAL SUBMITTAL REQUIREMENTS
1. A completed coastal stormwater permit application.
2. Two sets of plans showing north arrow, scale, revision date,
property/project boundaries clearly marked, contours, drainage basins, mean
high water line, wetlands, easements, a minimum 30' buffer between surface
waters and proposed impervious areas, and road cross -sections.
3. Calculations of the built -upon area. For subdivisions, please show the
methodology for arriving at the per lot built -upon area. For non -
subdivision projects, break down the calculation into buildings, roads,
parking and other (include all impervious areas).
4. Low Density projects with curb and gutter will require:
- drainage basins and Swale locations delineated on plans -
- detail of swales (minimum 100 l.f. and 5:1 side slopes)
- velocity calculations
- inlet -outlet elevations
- type of grass cover
DEED RESTRICTION REQUIREMENTS
NOTES:
The following items must be included for all low density projects:
No more than square feet of any lot, including that portion of
the right-of-way between the edge of pavement and the front lot line, shall
be covered by impervious structures, including asphalt, gravel, concrete,
brick, stone, slate or similar material, not including wood decking or the
water surface of swimming pools. This covenant is intended to ensure
compliance with the stormwater permit issued by the State of North Carolina.
The covenant may not be changed or deleted without the consent of the State.
1. If lot sizes vary significantly, owner should provide attachment with lot
number, size and allowable impervious area for each lot.
2. No one may fill in or pipe any roadside swales or lot line swales, except
as necessary to provide a driveway crossing.
3. For curb and gutter projects, no one may pipe, fill in or alter any lot line
swale used to meet North Carolina Stormwater Permit requirements.

OuB--- Ousley fine sand, 0 to 5 percent slopes, rarely flooded.
This moderately well drained soil is on low dunes near the sound side of the Outer
Banks. It is farther away from the ocean and out of the main salt spray zone.
Areas are irregular in shape and range from 5 to 135 acres in size.
Typically, the surface layer is grayish brown fine sand about 3 inches thick. The
underlying material to a depth of 80 inches is fine sand. It is yellowish brown and
light olive brown in the upper part, dark grayish brown in the next part, and dark
gray in the lower part.
Permeability is rapid. The soil is very strongly acid or strongly acid. The seasonal
high water table is 1.5 to 3.0 feet below the surface. This soil is subject to rare
flooding during hurricanes or exceptionally strong wind tides.
Included with this soil in mapping are small areas of Conaby, Corolla, and Osier
soils. Conaby and Osier soils are in the wetter troughs and depressional areas.
The nearly level Corolla soils are on the slightly higher, nearly level parts of the
landscape. The included soils make up about 10 percent of the map unit.
The Ousley soil is used mainly as woodland, Loblolly pine, live oak, water oak,
and sweetgun are the dominant speies. The most common understory plants are
waxmyrtle, grapevine, persimmon, yaupon holly, Virginia creeper, and blueberry.
Wetness is the main limitation affecting woodland.
This soil generally is not used as cropland, mainly because of its location on the
Outer Banks and the wetness.
the main limitations affecting urban and recreation uses are wetness, flooding,
seepage, and the sandy texture. the wetness can be reduced by installation of
perforated drain tile, drainage ditches, or a combination of the two systems.
The capability subclass is Illw. Based on loblolly pine as the indicator species, the
woodland ordination symbol is 8W.

Routine Maintenance
The maintenance required for infiltration basins is slightly greater than that
needed for dry detention ponds. Some of the normal maintenance tasks for
infiltration basins are detailed below.
INSPECTION
The performance of the infiltration basin should be checked after every major
storm in the first few months after construction. Particular attention should be paid
to how long runoff remains in the structure. Standing water in the basin within 48
to 72 hours after a storm, is a good indication that the infiltration capacity of the
basin may have been overestimated. The inspector should look for factors which
may be responsible for clogging the basin, such as upland sediment erosion, low
spots, excessive compaction, or marginal soils; and then get the contractor to
make any needed repairs. As a practical matter, local governments should not
release any bonds posted for a basin until the inspector determines that it is
performing as designed.
Thereafter, the basin should be inspected annually. Some of the more important
items to check for include: differential settlement, cracking, erosion, leakage or
tree growth on the embankment; the condition of the riprap in the inlet, outlet and
pilot channels; sediment accumulation in the basin; and the vigor and density of
the grass truf on the floor of the basin.

The buffer, side -slopes and basin floor must be mowed at least twice a year to
prevent woody growth. More frequent mowing may be needed if the basin is to be
used as a passive recreation area. Mowing operations may be difficult since the
basin floor may often be soggy. If low maintenance grass such as Tall Fescue is
used, basin mowing can be performed in the normally dry months of June and
September (Md WRA, 1983a).
DEBRIS AND LITTER REMOVAL
Trash will tend to collect in full -infiltration basins since they do not have outlets.
Infiltration/detention designs also will collect trash that might clog the riser or low
flow orifice. Therefore, it is a good practice to remove all debris and litter during
each mowing operation.

This is a very important maintenance task since eroded sediments can adversely
affect the infiltration capacity of a basin. Eroding or barren areas should be
immediately revegetated.

If a basin is located on marginally permeable soils, annual or semi-annual tilling
operations may be needed to maintain infiltration capacity. A rotary tiller or disc
harrow can be used, preferably in the late summer months when soil permeability
is likely to be the lowest (freezing and thawing of the soil in the winter and spring
months often helps to break up the soil and keep infiltration capaacity high).
Tilled areas should be immediately revegetated to prevent erosion.

Non -Routine Maintenance
STRUCTURAL REPAIRS / REPLACEMENT
If the basin is of the infiltration/detention basin design, the pipes and barrels will
eventurally need to be replaced. Corrugated metal pipe has an estimated
longevity of approximately 25 years in the field; whereas, concrete pipe and other
structures may last up to 50 years. However, if the basin is designed for full
exfiltration (i.e., no oulet apart from an earthen emergency spillway) then the
frequency and cost of structural repairs is sharply reduced.
RESTORATION OF INFILTRATION CAPACITY
Over time, the original infiltration capacity of the basin floor will gradually be lost.
If the problem has been caused by surface clogging (e. g., sediment accumulation
or local compaction), deep tilling can be used to break up the clogged surface
layer, followed by regrading and leveling. (Md WRA 1986b) suggests that deep
tilling may be needed every 5 to 10 years. In some instances, sand or organic
matter can be tilled into the basin soils to restore infiltration capacity as well. If a
basin still experiences chronic problems with standing water after these measures
have been taken, it is likely that the orginal infiltration capacity was overestimated.
It may then be necessary to install perforated underdrains beneath the basin to
remove the excess water.
SEDIMENT REMOVEL
Infiltration basins are normally located in smaller residential watersheds that do
not generate large sediment loads, or are equipped with some kind of sediment
trap. However, even though sediment loads to the basin are likely to be low, they
will still have a negative impact on basin performance, since the sediment
deposits will reduce the storage capacity reserved for exfiltration and may also
clog the surface soils.
Sediment removal methods in infiltration basins are different from those utilized for
extended detention and wet ponds. Removal should not begin until the basin has
had a chance to thoroughly dry out, preferably to the point where the top layer
begins to crack. The top layer should then be removed by light equipment, taking
care not to unduly compact the basin floor. The remaining soil can then be deeply
tilled with a rotary tiller of disc harrow to restore infiltration rates. Areas disturbed
during sediment removal should be revegetated immediately to prevent erosion.
TOTAL MAINTENANCE COSTS
Infiltration basins have only recently come into widespread use in the Washington
region, and consequently, there is very little data on which to base maintenance

cost projections. However, since the routine and non -routine maintenance tasks
for infiltration basins appear to be similar to those associated with conventional dry
detention ponds, it may be resonable to assume that annual maintenance costs
(routine and non -routine) will comprise 3-5% of a basin's initial construction cost
(Wiegand et al.,1986). This should be considered an interim estimate until more
infiltration basin maintenance experience has been gained.
