Thorpe Water Quality Supervisor NCDENR - Washington Regional Office 943 Washington Square Mall Washington, NC 27889 RE: Old Soothe Apartments, New Bern, North Carolina Stormwater Permit Renewal SW7950604 AE Project No. 95046 Dear Roger: FEB '-2 2007 DWQ-WARO Pursuant to your December 7, 2006 letter to Marvin Raines of Z & R Associates, LLC enclosed please find the following: Modified Project Plans Depicting As -Built Conditions (Two Copies) Pond Sizing Calculations (Two Copies) As you are aware, the site layout was modified after one of three originally permitted phases was completed. Impermeable area calculations and pond sizing calculations were completed for the site based upon the original 90% TSS removal criteria. The pond surface area as permitted is 5,817 square feet. The required pond surface area considering the existing permeable surfaces is 4,629 square feet. The pond as constructed is sized adequately for the impermeable areas that exist. As you can see based on the calculations, a slight increase in impermeable areas occurred between the original design and the as -built conditions. A total of 1,347 square feet of additional impermeable surface was created with the modified design. The stormwater pond was constructed with a vegetated outlet in lieu of discharging through the outlet structure directly to the roadside ditch along Academic Drive. This vegetated outlet swale is present on the site today. Considering the presence of this vegetative swale, the pond could have been sized using the 85% TSS removal values from the SA/DA table. This would have resulted in a smaller required pond area. I have informed Mr. Raines that he will be required to complete maintenance activities on the pond and outlet swale to restore the pond to a fully functional slate. Additionally, I informed Mr. Raines that he will be required to execute the Operation and Maintenance Agreement which you provided to him. It is requested that you consider the enclosed information as it relates to this matter. Please let me know if any additional information is required. I have added a detail to show the inverted orifice which is required to reduce clogging. 2. The forebay has been changed to have the same bottom elevation as the pond. 3. The outlet has been moved to provide separation between the pond inlet and outlet area. 4. The elevations on the pond detail have been clarified. 5. The calculations have been annotated to show those which apply to the final design. Enclosed please find revised drawings and calculations. The outlet location also changed in part due to the fact that the owner could not obtain permission to discharge across adjacent property. Consequently, drainage must occur into the adjacent roadside swale which will result in a permanent pond depth of 0.5 feet higher than the original elevation. The original pond outflow calculations have been kept since the new permanent pool elevation will only result in less severe outflows due to the larger pond surface area and volume at this depth. The water surface area of the permanent pool elevation of 17.5 feet is 5817 square feet. 2. The stormwater pond storage volume above the permanent pool depth with a free water surface elevation of 19.0 feet is 10,416 cubic feet. The free water surface area at elevation 19.0 is 8,071 square feet. 3. The orifice size to draw down the one inch storm is one inch in diameter. The downward protruding pipe was selected as two inches in diameter in order to not interfere with the performance of the one inch orifice and to reduce the potential for clogging. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 5 Y 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: a. Semiannual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change to the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. P 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Environmental Management, in accordance with North Carolina General Statute 143-215.6(a) to 143- 215.6(c). The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction.
