On May 29, 2014, Mr. Samir Dumpor of the Washington Regional Office of the Division of
Energy, Mineral, and Land Resources (DEMLR) inspected W.E. Partners II — Perdue
Lewiston development near Lewiston -Woodville, Bertie County to determine compliance
with Stormwater Management Permit Number S W7110101.
The Stormwater Management Permit Number SW7110101 was originally issued on January
13, 2011, to W.E. Partners II, LLC. During the inspection, it was discovered that the bio-
retention basin is not functioning properly. The bio-retention basin is holding water due to
either improper installation or lack of maintenance.
Accordingly, the following permit condition violation is noted during the DEMLR's
inspection:
Failure to Provide Operation and Maintenance
Schedule of Compliance, Section II. No. 1 of the Stormwater Permit SW7110101 requires
that "the stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface".... and
Section II. No.3 of the Stormwater Permit SW7110101 requires permittee to provide the
operation and maintenance necessary to assure that all components of the permitted
stormwater system function at optimum efficiency.

This Office requests that you respond to this letter in writing within 30 calendar days of receipt
of this Notice. Your response should be sent to this office at the letterhead address. Your
