Today I conducted a follow-up inspection to determine if the required maintenance activities had been completed
at the Handy Mart #169 in Alliance, NC as requested in my February 26, 2014,letter to you. The site inspection
revealed that the trees on the pond dikes have been removed. However we have still not received a designer's
certification that the wet detention pond was built in accordance with approved plans, therefore this project is still
not in compliance with the approved permit.
Condition II.6. Of the permit requires that upon completion of construction and prior to operation of the permitted
facility, a certification must be received from an appropriate designer for the system installed certifying that the
permitted facility has been installed in accordance with the permit and approved plans and specifications. This
office has no record of receiving the required certification.
Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater
Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General
Statute 143-214.7. Please submit the designer's certification as soon as possible. If we do not receive the required
certification within 30 days we will prepare recommendations for an enforcement action.

On February 24, 2014, Roger Thorpe of the Washington Regional Office of the Division of Energy, Mineral, and Land
Resources inspected the Handy Mart # 169 site located in Alliance, NC to determine compliance with Stormwater Management
Permit Number SW7070226, which was issued on March 1, 2007. The site inspection revealed that the project is in not in
compliance withthe approved permit.
Condition II. 6. Of the permit requires that upon completion of construction and prior to operation of the permitted facility, a
certification must be received from an appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with the permit and approved plans and specifications. This office has no record of receiving the
required certification. Conditions 11. 2. & 3. of the permit require that the stormwater treatment facility be properly operated and
maintained. At the time of the trees were observed growing on the dikes of the wet detention pond. These trees need to be
removed.
Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater Management
Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including
operation and maintenance of your permitted stormwater system. Please advise when the repairs have been completed. A
follow up inspection will be conducted in the near future. A designer's certification should be submitted within 30 days.
Please be advised that violations of your Stormwater Management Permit may be subject to the assessment of civil penalties. If
