Klimek P.E. Director Division of Water Quality This office received a revised stormwater package for the subject project on November 29, 2006. A preliminary review of the plans and specifications has been completed. Before a stomrwater permit can be issued, the following items must be addressed: 1) The revised plans, along with more complete details of the drainage basins, show that not all built -upon areas are captured and treated in the proposed infiltration basins. For high density type projects, the stormwater rules require that all impervious surfaces be captured and treated before leaving the site. 2) The revised soils report, along with site specific information regarding soil and water table conditions, indicates less than 12-inches of separation between the bottom of basin no. 2 and the seasonal high water table (SHWT). The stormwater rules require 2-feet of separation for infiltration systems; however, on a case -by -case basis, this office has permitted a few projects where only 1-foot of separation was attainable. To my knowledge, the Division has not issued stormwater permits for infiltration systems with less than 1-foot of separation. I suggest that you have your consultants redesign the project to make sure that all proposed infiltration systems for this site provide at least 12-24 inches of separation from the SHWT. 3) Provide revised plans, specifications, calculations and detailed stormwater narrative that reflect all changes. The above requested information must be received in this office prior to March 16, 2007, or your application will be returned as incomplete. The return of this project will necessitate resubmittal of all required items including the application fee. A vicinity map with the elements required on page 4 of the permit application is shown on Sheet C1.00. 2. Drainage basins have been updated to reflect your comments. Thev are now delineated to show areas that drain to an outlet, or to a control device. See the attached full-sized exhibit sheet titled "Drainage Area Map". 3. The numbers in the application, supplements, and plans have been revised, and are consistent. 4. The grassed swale has been revised and is now an infiltration basin. All stormwater controls now provide 85% TSS removal. 5. Cross-section/details of all control measures are shown on Sheet C2.01. 6. A new geotechnical report has been given to address all comments, and is specific to the DWQ requests (borings for the first few feet, permeability, and SHWT). Please see the last section of the calculations booklet. 7. We have listed 1.5" as the design storm on the supplemental sheets since the only two choices given in the parentheses next to it is for 1.5" for SA waters, or 1" for others. We make it clear in the narrative as well as in the calculations for each basin that since we do not provide a bypass structure, we must capture at least double the required amount (3" minimum) to mitigate for this. 8. Justification has been provided not only in the Infiltration Basin Supplemental package, but also throughout the narrative and in the calculations. 9. DEED RESTRICTIONS AND PROTECTIVE COVENANTS The following italicized deed restrictions and protective covenants are required to be recorded for all subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment. 1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number as issued by the Division of Water Quality. These covenants may not be changed or deleted without the consent of the State. 2. No more than square feet of any lot shall be covered by structures or impervious materials. Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. 4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted.
