Slaughter PO Box 785 Fuquay-Varina, NC 27526 SUBJECT: NOTICE 017 VIOLATION and RECOMMENDATION FOR ENFORCEMENT Construction of Impervious Surfaces Prior To Storn»rater Management Permit McCullers RELO Harnett County Dear Mr. Slaughter: On May 9, 2006, you received a certified letter by Michael Lawyer from the Fayetteville Regional Office of the Division of Water Quality notifying you that the McCullers RELO project located off Hwy 401 near Chalybeate Springs in Harnett County, North Carolina is subject to the requirements for obtaining a Stormwater Management Permit due to its location being within one mile of and draining to Hector Creek, which is classified as WS-IV;HQW (Water-Supply-1V;High Quality Waters). The letter also stated that a Stormwater Management Permit must be issued prior to the construction of any built -upon areas. A number of attempts have been made to, contact you as well as Mr. John A. K. 'fucker, PE, consulting engineer, in regards to the need for obtaining a Stormwater Management Permit. A voice mail message was left for Mr. Tucker on January 4, 2007 and another certified letter was sent to you on May 9, 2007, but was returned as unclaimed. As of the date of this letter, a Stormwater Management Permit has not been issued nor has an application for the permit been received. On July 2, 2007, Ken Averitte and Chad Turlington, also from this office, conducted a site visit to the McCullers RELO project. As ascertained during the site visit, a gravel roadway and parking area has been constructed at the project site. Please refer to Title 15A, Chapter 02H .1002 of the North Carolina Administrative Codes, which states: "Built -upon Area" means that portion of a development project that is covered by impervious or partially impervious cover including buildings, pavement, gravel roads and parking areas, recreation facilities (e.g., tennis courts), etc. (Note: Wooden slatted decks and the water area of a swimming pool are considered pervious).
