Wilmington, NC 28405 Re: Report of Unanticipated Bypass/Upset on 9-24-2021 NPDES Permit #NCG080000, Certificate of Coverage #NCG080960 Kinder Morgan Wilmington Woodbine St Terminal 1710 Woodbine St., Wilmington, NC 28401 New Hanover County Dear Mr. Tharrington Kinder Morgan Wilmington Woodbine St. Terminal (WWT) is submitting this follow-up report for an unanticipated bypass/upset event that occurred on September 24, 2021. This event was reported to the NC DEQ Wilmington Regional Office on 9/24/2021 via phone call at 10:30 and email. General Permit No. NCG080000, Certificate of Coverage NCGO80960 WWT has coverage under the National Pollutant Discharge Elimination System (NPDES) General Permit NCG08000 (the Permit) and Certificate of Coverage NCG080960. Part H of the Permit, Other Occurrences That Must Be Reported, notes that an unanticipated bypass must be reported within 24 hours (oral or electronic notification) and within 7 calendar days a report that includes an evaluation of the quality and effect of the bypass be submitted. This letter serves as the required 7 day report. Incident Location On September 24, 2021, WWT reported an unanticipated bypass of storm water when a dike containment failure was discovered near WWT NPDES Outfall 001 that resulted in storm water being discharged to the Cape Fear River (receiving water). The facility experienced heavy rainfall days prior to the incident resulting in storm water being routed to and accumulating in Containment Area #4 near Outfall 001. Permit Compliance Prior to the incident on September 24, 2021, the facility had no events of non-compliance with the Permit. Were Samples Taken No samples of the discharged water were taken prior to the event. It is expected that the only water discharged was storm water that did not contain any constituents required to be sampled for in the Permit (oil and grease, total suspended solids, pH). 1001 Louisiana Street, Suite 1000, Houston, TX 77002 CINDERMORGAN Delivering Energy to Improve Lives Discharges from the containment area regulated under the Permit typically do not occur. Accumulated storm water typically evaporates and is not sampled, discharged or reported under a discharge monitoring report. Incident Start and Duration On Thursday, September 23, 2021, no issues with the facility's Containment Area #4 dike wall were observed. On the morning of September 24, 2021, at approximately 07:15 WWT personnel observed a dike wall failure and loss of containment. Estimated Volume of the Bypass/Upset The loss of containment discharged approximately 1,090,000 gallons of storm water to the Cape Fear River. Weather Conditions during the incident On Friday, September 24, 2021, we received no rain and had clear skies with a temperature between 60-65 degrees at the time of the incident. Wind speed <10 mph. Surface Waters The Cape Fear River is the receiving water for the facility. Fish kill Based on observations at the facility on September 24, 2021, the incident did not result in any fish kills, sheen (oil), odors, or abnormal condition (debris, suspended solids, discoloration, etc.). Specific causes of the bypass/upset No issues with the dike wall were observed prior to the incident. The likely causes of the containment failure were erosion and lack of adequate structure affected by recent, abnormally high rainfall in the area. Repairs Made or Actions Taken On September 24, 2021, temporary containment was established. On September 26, 2021, permanent containment repairs were completed.
