Dear Mr. Dennis:
The Wilmington Regional Office received a revised Stormwater submittal for Rice Mill
Subdivision Phase I on February 28, 1994. Based on our review of the revised project plans and
information, we have determined that the revision complies with the Stormwater regulations set forth in
Title 15A NCAC 2H.1003. This Certification is a revision of the one issued on February 6, 1992. All
conditions and terms of that previously issued Certification remain in effect except as herein provided:
1. The name has been changed from Sugar Sands Phase II to Rice Mill Phase I.

COMPLIANCE WITH STORMWATER REGULATIONS
In accordance with Title 15 NCAC 211.1003(a)(2), the following DEED
RESTRICTION AND PROTECTIVE COVENANT shall be recorded in the
Brunswick County Registry prior to the conveyance of property. Said Deed
Restriction and Protective Covenant shall apply to the Sugar Sands Phase 3
project in Sunset Beach, North Carolina as shown on design plans titled
"Erosion Control and Stormwater Plans - Sugar Sands Phase 3 - Sea Trail
Plantation" prepared by Houston and Associates, P.A. dated November 27,
1991 and revised as noted on January 22, 1992:
'No more than 3,500 square feet of any lot shall be covered by
structures and/or paved surfaces, including walkways or patios of brick,
stone, slate, or similar materials. This covenant is intended to insure
continued compliance with stormwater runoff rules adopted by the State of
North Carolina and therefore benef is may be enforced by the State of North
Carolina. This covenant is to run with the land and shall be binding on all
parties and all persons claiming under them."

STATEMENT CONCERNING AREAS RESERVED BY SEA TRAIL
Sea Trail Corporation hereby agrees that no construction of any structure(s)
and/or paved surfaces including walkways or patios of brick, stone or similar
materials will neither be initiated nor allowed by Sea Trail Corporation
within any area designated "Reserved by Sea Trail" unless such structure(s)
and/or paved surfaces are as shown on design plans titled "Erosion
Control/Stormwater Plan - Sugar Sands Phase Three - Sea Trail Plantation"
prepared by Houston and Associates, P.A., dated November 27, 1991 and
revised as noted on January 22, 1992 or unless Sea Trail Corporation, prior
to any construction of such structure(s) and/or paved surfaces, submits
revised plans with the required supporting documentation and calculations
and has obtained the required approval from the North Carolina Department
of Environment, Health and Natural Resources Division of Environmental
Management.
