Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000. We are forwarding Permit No. SW8 040129, dated June 13, 2005, for the construction of the subject project. This permit shall be effective from the date of issuance until June 13, 2015, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory 'hearing upon written request within sixty (60) days following receipt of this permit. This request must be in the form, of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This permit shall be effective from the date of issuance until June 13, 2015 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff from the specified built -upon area within the specified drainage area as described in Section 1.6 on page 3 of this permit. The subdivision is permitted for 122 single family lots each allowed 3,200 ft2 of built -upon area, and ten (10) multi -family buildings with a total BUA of 150,241 if. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. Basin #r2A must be operated with a 50' vegetated filter. All other basins are designed to store and infiltrate a 4.5" storm event, and are not required to have a vegetated filter. 5. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The receiving stream for this project is the Dutchman Creek Outlet Channel in the Cape Fear River Basin. The Stream Index Number is CPF17 18-88-9-3-3, and it is classified "SA" Page 3of9 State Stormwater Management Systems Permit No. SW8 040129 II. SCHEDULE OF COMPLIANCE 1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 2. The permittee is responsible for verifying that the proposed built -upon area for the entire lot, including driveways and sidewalks, does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the Division of Water Quality, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer o1 ownership. d. Redesign or addition to the approved amount of built -upon area or drainage area. e. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit_ 6. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 7. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Infiltration systems should not be used as erosion control devices, due to the potential clogging. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. Page 4 of 9 State Stormwater Management Systems Permit No. SW8 040129 9. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of structures, orifice, catch basins and piping. g. Access to all components of the system must be available at all times. 10 Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 11 Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 040129, as issued by the Division of Water Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. f. The maximum built -upon area per lot is 3,200 square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. h. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. i. Built -upon area in excess of the permitted amount will require a permit modification. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 13. Permanent seeding requirements for the stormwater control. must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 14. Prior transfer of the permit, the stormwater facilities will be inspected by DWQ personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 15. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 16. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. III. GENERAL CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event there is either a desire for the facilities to change ownership, or there is a name change of the Permittee, a "Name/Ownership Change Form" must be submitted to the Division of Water Quality accompanied by appropriate documentation from the parties involved. This may include, but is not limited to, a deed of trust, recorded deed restrictions, Designer's Certification and a signed Operation and Maintenance plan. The project must be in good standing with DWQ. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all of the terms and conditions of this permit until such time as the Director approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Permittee grants permission to staff of the DWQ to access the property for the purposes of inspecting the stormwater facilities during normal business hours. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. 4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. We received your comments in a letter from you dated October 21 of last year and have revised the plan as noted below. We appologize for the delay in resubmitting the application In addition to other several other projects, this was one of the last projects Pat was involved with and it has been difficult to track down the status of this particular permit. Nevertheless, we have made several modifications Pursuant your comments which are summarized as follows: • Some of the grading of the project has been changed to ensure the bottoms of the basins are a minimum of 2 feet above the SIM Most notably, basins IA and 1B have been raised substantially to accommodate the high water table. The grading of the cul-de-sac adjacent to Basin 6 has been raised one foot to allow for adequate clearance of the basin from the SHWT. Basin 9 has been eliminated complctcly due to the sharp grade change in the footprint of that basin. The natural topography at that location made it a poor place to locate the basin. Basin 8 has adequate clearance from the SHWT as shown. The highest natural contour through that basin is EL. 20, which gives a SHWT level of EL 15. We are proposing the bottom at EL 18. • As previously mentioned, Basin 9 has been eliminated and its flow redirected to Basin 8. Basin 8 did not have the capacity to handle the 4.5 inch runoff requirement, so we have sized it to handle the 1.5 inch volume requirement and provided a bypass at the catch basin via smart weir. • A 50 foot vegetated filter strip has been added at the discharge of the bypass at Basins 2A and 8. A detail is also shown on the detail sheet. • Bypass structures have been labeled on the plan. • Original signatures have been provided on all the revised infiltration supplements. MembershiR shall mean and refer to the rights, benefits, duties and obligations which shall inure to the benefit of and burden of each Member as hereinafter set forth in Article V. Every person who is a. record owner of a fee or undivided fee interest in any Site which is subject, by covenants of record, to assessment of the Association, including contract sellers but excluding persons who hold an interest merely as security for the performance of an obligation, shall be a member of the Association. Ownership of such interest shall be the sole qualification for such membership. There shall be two (2) classes of Membership in the Association as set forth hereinafter in Article IV., Section 3, (Voting Rights) and each class of Membership shall have the votes as defined therein. Membership shall be appurtenant to and may not be separated from ownership of any Site which is the subject of this Declaration. The Board of Directors may make reasonable rules regarding proof of ownership. SECTION 12. Owner shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Site which is a part of the Properties, including contract sellers, but excluding those having such interest merely as security for the performance of an obligation. SECTION 13. Properties shall mean and refer to all of Seaspray Cove at Carolina Place, as shown on the Plat recorded in Map Book at Page in the Brunswick County Registry and any of the Additional Properties that may hereafter be brought within the jurisdiction of the Association as herein provided. SECTION 14. Site shall mean and refer to any of the numbered lots or units, and specifically including condominium units, in any phase of Seaspray Cove at Carolina Place as shown on the Plat or recorded maps of Additional Properties, as recorded in the Brunswick County Registry, together with all improvements, including any structure or dwelling unit, constructed thereon. ARTICLE II PROPERTY RIGHTS SECTION 1. Owners' Easements of Enjoyment. Every Owner shall have a right and easement of enjoyment in and to the Common Area (but not the Limited Common Area), if any, which shall be appurtenant to and shall pass with the title to every Site, subject to the following provisions: A. The right of the Association to suspend the voting rights and privileges of an Owner for any period during which any assessment against his Site remains unpaid and for a period not to exceed sixty (60) days for any infraction of the published rules and regulations, but access to the Owner's Site shall not be denied. B. The right of the Association to dedicate or transfer all or part of the Common Area, if any, to any public agency, authority, or utility for such purposes and subject to such conditions as may be agreed to be the Members. No such dedication or transfer shall be effective until approved by vote of at least two-thirds (2/3) of the Members as indicated in an instrument executed by the Association and recorded in the Brunswick County Registry. C. The right of the Association to impose regulations for the use and enjoyment of the Common Area, if any, and improvements thereon, which regulations may further restrict the use of the Common Area. D. The right of the Association to limit the number of guests of Members allowed to utilize any Site or Common Area. E. The Association may not restrict the right of utilization of any Limited Cornmon Area nor may any Limited Common Area be conveyed without the consent of the Member entitled to utilization thereof_ Rug 04 04 09:42a Stroud Engineering 9100150593 p.5 Owner of such Site at the time when the assessment fell due. The personal obligation for delinquent assessments shall not pass to his successors in title unless in expressly assumed by them. SECTION 2. Purpose of Assessment. The assessments levied by the Association shall be used exclusively to promote the recreation, health, safety and welfare of the residents in the Properties and for the improvement and maintenance of all roads, and streets until such time as the roads and streets are accepted by the North Carolina Department of Transportation, as it is the developer's intent to turn the roads over to the North Carolina Department of Transportation at a later time; for the improvement and maintenance of all curbs, easements, utilities and the Common Areas, and to carry out the obligations of the Association and to administer the Association. SECTION 3. Annual Assessments. For the calendar year 2004, the annual assessment is hereby established as $ per Site, which amount shall be prorated and paid by the Owner at closing, for the homeowner's dues through the remainder of that calendar year. Thereafter, annual assessments shall be in an amount to be fixed from year to year by the Board of Directors which may establish different rates from year to year as it may deem necessary for the purposes set forth in Section 2 above. The amount of the annual assessment against each Site for any given year shall be fixed at least thirty (30) days in advance of the annual assessmentperiod and written notice to the Owners to be subject thereto shall be delivered to the Owners at or prior to the closing of their Site(s). Written notice of each annual assessment thereafter shall be sent to every Owner subject thereto. The due date shall be established by the Board of Directors and the Board of Directors shall have the authority to require the assessments to be paid in pro rata monthly or quarterly installments. The Association shall, upon demand, and for a reasonable charge, furnish a certificate signed by an officer of the Association setting for the whether any assessment of a specified Site has been paid. SECTION 4. Special Assessments. In addition to the annual assessments authorized above, the Association may levy, in any assessment year, one or more special assessments, applicable to the year only, for any purpose for which the Association is authorized to expend funds provided that any such assessment for the purpose of constructing new capital improvements on Common Areas shall have the assent of two-thirds (2/3) of the votes of the Members who are voting in person or by proxy at a meeting duly called for this purposes. All other special assessments may be adopted by a majority of all of the members of the Board of Directors. SECTION S. Insurance. The Board of Directors on behalf of the Association, as a Common Expense, shall at all times keep the property of the Association insured against loss or damage by fire or other hazards and other such risks, including but not limited to directors' liability and public liability insurance, upon such terms and for such amounts as may be reasonably necessary from time -to -time to protect the Properties and Common Areas (including Limited;Common Areas), which insurance shall be payable in case of loss to the Association for all Members. The Association shall have the sole authority to deal with the insurer in the settlement of claims. Such insurance shall be obtained without prejudice to the right of each Member to insure his personal property for his own benefit at his own expense. In no event shall the insurance coverage obtained by the Association be brought into contribution with insurance purchased by Members or their mortgagees. The Association shall insure no personal property of an Owner, even if located on or in a Common Area (whether Limited Common Area or not)_ SECTION 6. Insurance Assessments. All insurance policy premiums on the Common Areas for the benefit of the Association purchased by the Board of Directors or its designee and any deductibles payable by the Association upon loss shall be a Common Expense and the Association may either levy against the Owners equally as an additional annual assessed amount, (herein called "Insurance Assessment") which shall be in addition to the amounts provided for under Section 2 above, in an amount sufficient to pay the annual cost of all such insurance premiums, or shall include such amount in its annual budget as a Common Expense. SECTION 7. Uniform Rate of Assessment. Both annual and special assessments must be faxed at a uniform rate for all Sites. Assessments may be collected on a monthly quarterly or annual basis as determined by the Board. SECTION S. Commencement of Assessments_ Annual assessments for each Site shall commence upon the date of acceptance by an Owner of a deed from Declarant. Declarant shall not be required to pay annual assessments on unsold Sites retained by the Declarant until a primary residential structure, with Certificate of Occupancy issued, has been constructed on a Site. No special assessment Aug 04 04 09:44a Stroud Engineering 9100150593 p.6 shall be payable by Declarant for any Site for which, as of the due date for such assessment, there is no completed primary residential structure with Certificate of Occupancy thereon. SECTION 9. Effect on Nonnavment of Assessments and Remedies of the Association. Any assessment not paid within the thirty (30) days after the due date shall bear interest from the due date at the highest rate allowable by law. The Association may bring an action at law against the Owner personally obligated to pay the same, and/or file and foreclose a lien against the Site, which lien shall be filed as a prime contractor's lien as set out in the. North Carolina General Statutes. No Owner may waive or otherwise escape liability for any assessments provided for herein by non-use of the Common Area or abandonment of his Site. All costs, including attorney fees, shall be the responsibility of the delinquent Owner, and shall be included in any judgment entered as a cost of the proceeding. SECTION 10. Subordination of the Lien to Mortgagee The lien of the assessments provided for herein shall be subordinate to the lien of any first mortgage_ Sale or transfer of any Site shall not affect the assessment lien. However, the sale or transfer of any Site pursuant to mortgage foreclosure or any proceeding in lieu thereof shall extinguish the lien of such assessments as to payment which became due prior to such sale or transfer. No sale or transfer shall relieve such Site from liability for any assessments thereafter becoming due or for the lien thereof. SECTION 11. Working_Cauital. At every closing, wherein the Declarant sells to a third party, the Association shall collect One Hundred Dollars ($100.00) working capital. Declarant reserves the right to amend this section including the amount at any time. ARTICLE VI. ARCHITECTURAL CONTROL SECTION 1. Building and Site Improvements. No dwelling, fence, wall or other structure shall be commenced, erected, maintained upon any Site in the Properties, nor shall any exterior addition to or change in or alteration thereof (including painting or repainting of exterior surfaces) be made until the plans and specifications have been submitted and approved as more fully set out hereinafter. The Declarant shall, as determined by it, either sit as an Architectural Control Board, or shall appoint a three (3) person committee to sit as an Architectural Control Committee ("Association Committee"). The Association Committee shall review all alterations to previously approved improvements including renovations and repairs impacting exterior appearance), and shall further review all changes in the initially approved plans for each Site. At least thirty (30) days prior to the anticipated commencement of any construction, erection, establishment or modification of any structure or improvement on any Site, the Owner of such Property (or his duly appointed agent) shall submit to the Chairman of either the Association Committee or the Architectural Control Board as appropriate, a plat of the Site, which plat shall show each Site corner, as to new construction, and there shall be shown thereon the proposed location of all proposed and existing structures or improvements, including driveway, bulkheads, piers, patios, decks and walkways. There shall further be provided sufficient building elevations and other site plans, including a statement of exterior building materials and proposed exterior colors, to allow the appropriate committee to accurately evaluate all structures and improvements proposed for construction on the Site. There shall be submitted two (2) copies of all information required to be submitted. Within thirty (30) days after the receipt of all required information, the appropriate committee shall submit in writing to the Owner of the Site whether or not the requested construction and/or landscape plans are approved. The response of the appropriate committee may be an approval, a denial an approval with conditions or a request for additional information. A request for additional information shall be deemed a determination that the information submitted was inadequate, and the thirty (30) day time for response shall only commence upon receipt of the requested additional informations. If approval with conditions is granted, and construction then begins, the construction shall be deemed approval by the Owner of the Site of the conditions imposed. Any improved landscape plan shall be approved subject to the express condition, whether or not so stated in the Letter of Approval, that the landscape plan shall be fully implemented in a professional way as soon as reasonably possible following completion of construction of improvements on the Site, and shall be further conditioned upon the commitment of the Owner of the Site to complete timely such landscape plan, and once implemented, said landscaping shall be maintained in a professional manner at all ties. There shall be a $25.00 Architectural Review fee paid to the Association for each and every submission. Aug 04 04 08:45a Stroud Engineering 9108150593 p.7 The appropriate committee shall approve the plans as submitted, if all required information is submitted, if all specific requirements imposed by this Declaration are met, and if the following affirmative findings are made: A. That the improvements sought to be constructed will not have negative economic impact on any other Sites. B. That all required specific building standards and other conditions contained within this Declaration, the guidelines established by the applicable committee for utilization throughout Carolina Place, and other applicable legal documents have been complied with; C. That the improvements are architecturally compatible with proposed or constructed improvements on other Sites. SECTION 2. Requirements. Single-family residences shall have a minimum of One Thousand (1,000) square feet of fully enclosed floor area devoted to living purposes (exclusive of roofed and unroofed porches, sundecks, patios, terraces, carports and other buildings). This requirement shall not apply to condominium units_ A. Since the establishment of inflexible building setback lines for location of house on Sites tends to have detrimental effects on privacy, view, preservation of important trees and other vegetation and may have ecological. consequences which are undesirable, no specific setback lines are established by this Declaration. In order to assure, however, that the foregoing considerations are given maximum effect, the Site and location of any house or other structure upon any Site shall be controlled by and must be approved by the appropriate committee. B. No structure shall be erected, altered, placed or permitted to remain on any Site, except one single-family dwelling not to exceed two stories in height, and one or more necessary buildings (which may include detached private garage, or guest facilities) provided the use of such dwelling or accessory building does not in the opinion of the appropriate committee overcrowd the Site, and provided further that such buildings are not used for any activity normally conducted as a business. Architectural features extending above the roof Iuie may be approved if compatible with the primary structure. C. All structures constructed on any Site shall be stick built of substantially new material. No mobile or modular homes shall be erected on any lot. Once commenced, construction of improvements must be completed within six (6) months or the Site owner shall pay a S 10.00 per day penalty to the Association until a certificate of occupancy is issued for the Site. D. All service utilities, fuel tanks, clothes lines, wood piles and trash and garbage accumulations are to be enclosed within a fence, wall or plant screen of type and size approved by the appropriate committee, so as to preclude the same from causing an unsightly view from any highway, street or -,A,ay within the Property, or from any other Site. SECTION 3. Maintenance by Associa*ion. The Association shall maintain all Common Areas (including Limited Common Areas), including roadways, until such time as they are turned over and accepted by the North Carolina Department of Transportation, plantings and shrubbery, boardwalks or walkways located thereon, garages within Common Areas, exterior lighting fixtures (including bulbs) and shall pay all costs of operation thereof, including premiums associated with general liability insurance insuring the Association from liability arising from ownership and operation thereof. Provided, however, in the event any lot owner has taken any action whatsoever which would hinder or prevent the Developer from turning over maintenance of the streets and roads within the subdivision to the North Carolina Department of Transportation, the Developer can, at the owner's expense, take any appropriate actions necessary to gain State acceptance of the street maintenance. The Association, at its expense, shall be responsible for maintaining, repairing and replacing the planted areas, the storm water drainage system, including any retention pond, all drainage lines, pipes Rug 04 04 08:46a Stroud Engineering 9108150593 p.8 and ditches which are located on the Properties, except those constructed by individual Site owners and located within individual Sites. Provided, however, site owners shall be responsible for damage to drainage swales caused by their own negligence or malfeasance, or the negligence or malfeasance of their guests. The Association shall have the right to go onto the Sites at reasonable times for the purpose of maintaining, repairing and replacing all utility and drainage lines and pipes which might be located on such Sites; and each Owner hereby grants permission to the Association for its representatives to enter his Site for such purposes. ARTICLE VII USE RESTRICTIONS SECTION 1. Land Use and Building Tyne. No Site in Carolina Place shall be used for any purposes except for residential purposes provided, however, that so Iong as Declarant retains Sites for sale, nothing herein contained shall prevent or limit Declarant or its agents from maintaining a model unit on the Property and from conducting sales of Carolina Place Properties from said Site. Any building erected, altered, place or permitted to remain on any Site shall be subject to the provisions of Article VI of this Declaration relating to architectural control. Different land use restrictions and architectural control guidelines may be established for adjoining properties to be developed by Declarant. SECTION Z. Nuisances. No noxious or offensive activity shall be carried on upon any Site, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. There shall not be maintained any plants or animals, nor device or thing of any sort whose normal activities or existence is in any way noxious; dangerous, unsightly, or unpleasant so as to diminish or destroy the enjoyment of other properties by the Owners thereof. It shall be the responsibility of each Site owner to prevent the development of any unclean, unsightly or unkempt conditions of buildings or grounds on such Site which would tend to substantially decrease the beauty of the neighborhood as a whole or the specific area. The Board of Directors shall have complete authority to determine what activities are restricted by this section. SECTION 3. Site Maintenance. In the event that any Site owner shall fail or refuse to keep his Site free from weeds, underbrush or refuse piles, or unsightly growth or objects, then, after thirty (30) days notice from the appropriate committee, the appropriate committee, or its designee, shall enter upon such Site and remove the same at the expense of the Owner, and such entrance shall not be deemed a trespass. In the event of such removal, a lien shall arise and be created in favor of the Association for the full amount of the cost thereof chargeable to such Site, including collection costs and a 15% administrative charge, and such amounts shall be due and payable within thirty (30) days after the Owner is billed therefore. Such Iiens shall be enforceable by judicial proceedings as provided by law for enforcement of liens. Developer reserves the right to charter and form a lawn care association to provide uniform and reasonable lawn care for the lots within Seaspray Cove at Carolina Place, said association to be separate and apart from the Carolina Place Homeowners Association. In the event the developer does elect to form such a lawn care association, all property owners of lots in Seaspray Cove at Carolina Place, and any areas hereafter developed subjected to this Declaration, if any, shall be members of the association, which membership shall be appurtenant to and may not be separated from the ownership of such single family lot. The lawn care association shall be empowered to assess each lot owner a pro -rate portion of the costs of the lawn care provided by the association, and such assessments shall be a charge on the land and shall be a continuing lien upon the lot against which each assessment is made. Each such assessment, together with interest, costs and reasonable attorney's fees, shall also be the personal obligation of the person who was the Owner of such lot at the time when the assessment fell due. The personal obligation for delinquent assessments shall not pass to his successors in title unless in expressly assumed by them. The lien of the assessments provided for herein shall be subordinate to the lien of any first mortgage. Sale or transfer of any lot shall not affect the assessment lien. However, the sale or transfer of any lot pursuant to mortgage foreclosure or any proceeding in lieu thereof shall extinguish the lien of such assessments as to payment which became due prior to such sale or transfer. No sale or transfer shall relieve such lot from liability for any assessments thereafter becoming due or for the lien thereof. SECTION 4. TemporaME Structures. No temporary house, trailer, tent, garage or other outbuilding shall be placed or erected on any Site; provided, however, that the Declarant may grant Aug 04 04 08:48a Stroud Engineering 9108150593 p.9 permission for any such temporary structures for storage of materials during construction. No such temporary structures as may be approved shall be used at any time as a dwelling house. SECTION S. Recreational Vehicles. No boat, motorboat, camper, trailer, motor or mobile home, or similar type vehicle, except for temporary construction or sales trailers during the construction, shall be stored on any Site longer than 48 hours unless it is stored within a garage or carport. SECTION 6. Animals. No animals, livestock or poultry of any kind shall be kept or maintained on any Site or in any dwelling except that dogs, cats or other household pets may be kept or maintained provided that thy are not kept or maintained for commercial purposes and provided further that they are not allowed to run free and are at all times properly leashed. SECTION 7. TV Satellite Dishes and Outside Antennas TV satellite signal receiving dishes and antenna shall be adequately screened from view from Common Areas and other Sites. No outside radio or television antenna shall be erected on any Site or dwelling unit within the Properties unless and until permission for the same has been granted by the Architectural Control Board or its Association Committee. SECTION S. Window Coverings. All drapes, curtains or other similar materials hung at windows so as to be visible from outside the home shall be of a white or neutral background material. SECTION 9. Exterior Lights. All light bulbs or other lights installed in any fixture located on the exterior of any building or any Sites shall be clear, white or non -frosted lights or bulbs. Light wattage and placement shaII be approved by the Architectural Control Board. SECTION 10. Junk Vehicles. No inoperable vehicle or vehicles will be permitted on the Property. The Association shall have the right to have all such vehicles towed away at the Owner's expense. SECTION 11. Signs. No signs, except name identification of the owner not to exceed three (3) square feet, shall be erected or placed on any Site; no "For Sale" signs will be allowed on undeveloped or vacant Sites. "For Sale" signs will be allowed on houses but must be approved by the Architectural Control Board or its Association Committee. SECTION 12. Burning. No outside burning of trash, garbage or household refuse shall be permitted. SECTION 13. Trees. No tree with a diameter of six inches or larger when measured at a height of 4 feet above ground shall be cut or removed without approval of the Architectural Control Board or its Association Committee. The Association shall have the power to levy penalties and finds for the violation of Article VII, Section 1-13. ARTICLE VIII ANNEXATION OF ADDITIONAL PROPERTIES SECTION 1. Approval. Except as provided in Section 2 below, annexation of Additional Property shall require the assent of two-thirds (2/3) of the Members at a meeting called for this purpose. Written notice of such meeting shall be sent to all Members not less than thirty (30) days nor more than sixty (60) days in advance of the meeting. SECTION 2. By Declarant. If the Declarant, its successors or assigns, shall develop all or any lands in close proximity to the Properties, said additional lands or any portion thereof may be annexed to said Properties without the assent of any other person or entity. Annexation provided for in this section shall become effective upon the filing by the Declarant of a Supplemental or Amended Declaration in the Office of the Register of Deeds of Brunswick County. Such additional lands to be annexed hereto shall be developed in the same general scheme of development as Seaspray at Carolina Place. ARTICLE IX. STORM WATER MANAGEMENT Rug 04 04 08:49a Stroud Engineering 9108150593 p.10 Section 1. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 040129, as issued by the Division of Water Quality under NCAC 2H.1000. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. These covenants are to run with the land and be binding on all persons and parties claiming under them. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. Section 2. The maximum allowable built -upon area per lot is 3,200 square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built -upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the water surface of swimming pools. Filling in or piping of any vegetative conveyances (ditches, swales etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. Each lot will maintain a 30' wide vegetated buffer between all impervious areas and surface waters. All roof drains shall terminate at least 30' from the mean high water mark of surface waters. Section 3. FiIling in, piping or altering any designated 5:1 curb outlet Swale associated with the development is prohibited by any persons. This project proposes a curb outlet system. Each designated curb outlet swale shown on the approved plan must be maintained at a minimum of 100' long with 5:1 (H:V) side slopes or flatter, have a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non -erosive manner, and maintain a dense vegetative cover. ARTICLE X. RULES AND REGULATIONS SECTION 1. Enforcement. The Association, or any Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges now or hereafter imposed by the provisions of this Declaration. Failure by the Association or by an Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. SECTION 2. Severability. Invalidation of any one of these covenants or restrictions by judgment or court order shall in no way effect any other provisions which shall remain in full force and effect. SECTION 3. Sites Subject to Declaration. All present and future owners, tenants and occupants of Sites and their guest(s) or invitee(s), shall be subject to, and shall comply with the provisions of the Declaration, and as the Declaration may be amended from time -to -time. The acceptance of a deed or conveyance or the entering into of a lease or the entering into occupancy of any Site shall constitute an agreement that the provisions of this Declaration are accepted and ratified by such owner, tenant or occupant. The covenants and restrictions of this Declaration shall inure to the benefit of and be enforceable by the Association, or the Owner of any Site, their respective legal representatives, heirs, successors and assigns, and shall run with and bind the land and shall bind any person having at any time any interest or estate in any Site as though such provisions were made a part of each and every Deed of Conveyance or Lease. SECTION 4. Amendment of Declaration. Declarant reserves the right any time prior to all lots being sold, that these protective covenants may be amended by the Declarant in its sole discretion. Retention of this right by the Declarant is not intended to affect the general or common scheme of development for the property herein described but to correct and modify situation or circumstances which may arise during the course of development. These protective covenants may also be amended by a vote of not less than sixty-seven percent (67%) of the owners and an instrument must be recorded at the Brunswick County Registry for such an amendment to be effective. In no event may the protective covenants be amended so as to alter any obligations to pay ad valorem taxes or assessments for public improvements as herein provided, or affect any lien for tfie payment thereof established herein or so to deprive the Declarant, its designee, its successors and assigns of any rights herein granted which are reserved unto the Declarant. The Board of Directors of the Association shall have the power to formulate, publish and enforce reasonable rules and regulations concerning the use and enjoyment of each Site and all Common Areas. According to my calculations, Basins 1A, 2A, 213, 4A, 4B, 5, 6, 7A, 8 and 9 must provide offline bypasses because they do not provide sufficient storage for the 4.5" rain event. 2. Infiltration systems are offline, that is, they must bypass their runoff prior to entering the basin. This is usually accomplished by providing a smart weir in the last catch basin, manhole or junction box prior to entry into the basin. The plans appear to locate the required bypass -structures within the basin, similar to a wet pond, which is incorrect. 3. Please provide a detail for the bypass structure, which specifies the elevation of the smart weir for each basin. The smart weir elevation should correspond to the 1.5" temporary storage elevation. 4. 1 am still waiting for a copy of the proposed deed restrictions for the high density single family development. Please calculate the SHWT elevation for each basin based on the highest existing ground contour in each basin. For example, the highest contour in Basin 1 B is 32, so the SHWT for that Basin would be 27. The bottom elevation of that basin must be 29 or higher. Specifically, our representatives performed the following work items on December S, 2003: 1. Advanced one hand-augered boring near each infrltrometer test location in order to visually classify the in -place soils. A Munsell Soil Color Chart was used to define the hue and chroma of the recovered soil samples. 2. Conducted three double -ring infiltrometer tests at depths ranging from 11 to 12 inches below the existing ground surface. This testing was conducted in general accordance with American Society for Testing and Materials (ASTM) procedure D-3335 entitled, "Infiltration Rate of Soils its Field Using Double - Ring Infiltromeetef'. Based on our field classifications of the excavated soils at the hand-augered boring locations, the in - place soils consisted of slightly silty sands, siltysands, clayey sands, and- clays which extended to the maximum completed boring depth of 7 below the existing ground surface. Water was encountered in the bomholes at depths ranging from about 6 to 6'/. feet below the existing ground surface. The site water level will fluctuate with climatic and seasonal conditions, however, and may be higher or lower at other times of the year. It is our opinion that the depth to the seasonal high water table exceeds five feet below the existing ground surface.
