I wanted to let you know that the items are being/will be addressed. If you have not heard from Nick at Coastal Carolina Resource Group yet, you should be soon in regards to a plan of action. #1— Excess sediment has accumulated in the upper basin #113 (near Northampton Drive). This top layer of sediment and vegetation should be removed to promote better infiltration. ■ Coastal Carolina Resource Group, Inc. will be breaking up the compacted surface soils and grass thatch present in basin 1A, 1B,and 3A. Landscapers will mow the area first, as soon as weather permits and basins are not filled with water; then CCR will be able to address any further issues. #2 — Basin #313 in the "villas' section was like a pond, holding at least one foot of water. However there was no overgrowth of invasive plants or other vegetation. It is believe that root matter and clay sub -soil is causing it not o infiltrate properly. It is our understanding that much of the root matter has already been removed. Further Study is needed to come up with a solution for stormwater treatment; maybe this basin can be converted to different type(s) of stormwater control measures(s). ■ Coastal Carolina Resource Group, Inc. will be looking into the further and working with the Seaspray Villas to reach a solution. This will be a huge project and will require much time and funds to work on correcting. If there is anything else needed from me, please let me know. Do not click links or open a Good Evening Steve, Thank you for the inspection report. I'm sorry I missed you on the day you visited the site. I wanted to follow up with our conversation regarding the current state of infiltration 3B. As you may know we have had issues with phragmites in this basin. We worked for years to chemically treat this vegetation and get it under control. We have added bacteria to help break down the accumulated organics in the basin: and to help re-establish the infiltration. With all the rain we had last year, this basins lack of performance caused the townhome area to flood numerous times. I started working with the board to come with solutions. Our first step was to dredge the basins bottom back to natural soi's and remove any remnant phragmite root debris that may be blinding off the facility. We proceeded with this and had just pulled the machines out of the basin a few days before your arrival. During our dredging operation we found that all the natural subsoils were composed of a clay loam. We dug a few eight foot deep test wells and found that the clayey loam was present at all depths. The presence of this clay is restricting the infiltration. I proceeded to the MRCS website and found that this area was mapped as having a Yaupon silty clay loam. I have attached the soil map and description for your records. Given this situation, we will never be able to get infiltration in this soil. Because of the current complexity of this situation, I brought Mark Arcuri with SEPI engineering on board to help engineer a solution to this problem. During our walk through, Mark has also determined that this basin lacks the ability to go offline during these large storm events. We are currently working with the board to come up with cost effective options to resolve these problems. We will keep you informed as we work through this. Clark, President 1630 Military Cutoff Road, Suite 108 Wilmington, NC 28403 Subject: Notice of Inspection — Not Compliant Seaspray Cove at Carolina Place State Stormwater Management Permit No. SW8 040129 Brunswick County Dear Mr. Clark: On July 30, 2019, staff from the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected the subject project, located in Brunswick County, to determine the status of compliance with the State Stormwater Management Permit Number SW8 040129, last revised on November 7, 2016. DEMLR file review and site inspection revealed that the site is'NOT in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Excess sediment has accumulated in the upper basin #113 (near Northhampton Drive). This top layer of sediment and vegetation should be removed to promote better infiltration. 2. Basin #313 in the "Villas" section was like a pond, holding at least one foot of water. Failure to provide the requested information, or to respond to this letter with a plan of action, including a timeline to resolve the identified deficiencies, by August 30, 2019, are considered violations of the permit. If the requested information is not submitted to this office by the due date, then DEMLR staff will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day. Skvada, III Secretary On November 21, 2014, we received a complaint from Mr. Jim MulCahy, President of Carolina Place HOA, where he stated that the overflow from infiltration basin 1A in Seaspray Cove had clogged up the roadside swales in the Carolina Place subdivision. Therefore, on December 11, 2014, staff from the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected Seaspray Cove at Carolina Place in Brunswick County to determine the status of compliance with the State Stormwater Management Permit Number SW8 040129 issued on June 13, 2005 and as modified thereafter. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection. report, the following deficiencies must be resolved: Infiltration basin 1A appears to be inundated with water and is not drawing down properly. The basin bottom elevation. is supposed to be at 23 feet and the minimum berm elevation is supposed to be 25.5 feet according to the approved plans. However, according to the as -built plan received on Jan. 19, 2006 by land surveyor, David Edwards, care of WK Dickson, the bottom elevation is 15 feet and the top of berm elevation is 19 feet. According to the soils report by S&ME dated December 8, 2003, the SHWT elevation is at least 5 feet below the ground surface. This equates to a seasonal high water table (SHWT) of 24 feet, or 9 feet above the as - built bottom elevation. Accordingly, during the wet season, the bottom elevation could be as much as 9 feet below the water table, which is not acceptable. Even if the SHWT is 21 feet as shown on the infiltration basin supplement, the bottom elevation would be 6 feet below the water table. Requirement for infiltration basin design is that the SHWT must be 2 feet below the bottom elevation, so the SHWT should be at 13 feet for this basin to function properly. We believe that this is the reason why the basin doesn't draw down properly. A designer's certification was received on Oct. 19, 2007 from James Fentress, Jr. of Stroud Engineering, stating that construction was built within substantial compliance and intent of the approved plans and specifications. However, based on the as -built plans, it appears that this certification was in error. 2. Again, according to the as -built plans, the top of berm is at about 19 feet elevation. However, it appears that an overflow weir has been installed adjacent to the roadside Swale that is about 1 foot lower than the berm. So, the overflow elevation would be at 18 feet, which is about 6 feet below a SHWT of 24 feet. Even if the SHWT is 21 feet as shown on the infiltration basin supplement, this overflow weir would be 3 feet below the water table, which is a problem. This would cause the water to drain constantly into the swale and could cause sediment buildup from the basin overflow point downward in the swale. According to visual observation during the inspection, the current water table appeared to be at about 6 inches below the overflow weir, so this would be at 17.5 feet elevation. Please note that the overflow weir is not shown on the plans. Slopes of basin should be free of woody vegetation (trees or shrubs). Main treatment area needs to be clear of weeds and cattails. Basin 2B - Severe erosion was noticed in the inlet vegetated swale to Basin 2B. This erosion needs to be repaired and the area stabilized by re-seededing and installing sod or riprap. Basin 3B - Inlet vegetated swale was severely overgrown and causing a possible clog at the inlet pipe. Water was backed up in three drop inlets in the adjacent parking lot. In addition, the main treatment area and slopes of Basin 3B were severly overgrown. This area needs to be cleared of all weeds and cattails and the grass trimmed to a height of 6" or less. Basin 8 - There was some erosion of the banks around the inlet pipe FES. This area needs to be shored up with riprap to stop the erosion and ensure that the pipe does not break. Project Description The project site is an approximately 112 acre tract, averaging twenty to thirty feet above mean high water, adjacent to Jump and Run Creek and Calf Gully Creek off Highway 133 near Southport in Brunswick County. The tract actually runs parallel to Dutchman Creek Canal between two of it's tributaries (Jump and Run Creek and Calf Gully Creek). However, the property does not actually border Dutchman Creek due to a tract of land owned by Carolina Power and Light Company which also runs parallel to Dutchman Creek between the applicant's property and Dutchman Creek Canal. The tract is currently wooded. Man-made features currently on the site include: an old dike probably made from old dredge spoil and unpaved roads. The tract is basically undeveloped with no wastewater treatment facilities or drinking water supply source. Since water access to Dutchman Creek is blocked by the tract of land owned by CP&L, the tract's only waterward boundaries are adjacent to Calf Gully Creek along the southern boundary and Jump and Run Creek along the northern boundary. The waters adjacent to the site are classified as SA waters by the Division of Water Quality. They are open to the harvest of shellfish and are designated Primary Nursery Area by the NC Division of Marine Fisheries. The applicant proposes to create a subdivision from the tract and to sell individual lots. Lots have not yet been platted, so the size an n37U4er of lots are own. s an ameiuty to the subdivision the applicant is proposing to construct a 6' x 96' walkway, partially over "404" type wetlands from which a 6' x 24' walkway and a 6' x 10' walkway would extend. Each walkway would extend towards Jump and Run Creek with each terminating with a 10 X 20 ft elevated deck over open water. A third elevated deck is proposed to extend directly from the eastern terminus of the 6 X 120 ft walkway, which is also proposed. over open water. At the location of the piers, Jump and Run Creek is a navigable tidal creek approximately forty feet wide and five to six feet deep at mean high water. A narrow strip of Smooth Marsh Cordgrass (Spartina alterniflora) exists along the boundary adjacent to the proposed construction. The applicant is proposing no construction beyond 114 the width of the creek and all construction shall be elevated over coastal wetlands. No construction is proposed within 15 ft. of the adjacent riparian corridor line. This project was permitted under CAMA Major Permit #100-98, on 7/27/98, however the permittee at the time, Bermuda Trace C/o Three Island Partners, LLC, neglected to renew the permit at the time of expiration. The proposed project is nearly identical to the previously permitted project, with the exception of the reduction in the overall length of the 6' x 96' walkway (previously permitted at 6' x 120'). Additionally, at the time Permit #100-98 was issued, the 15A NCAC 07H .0209 allowed for a pier structure to extend up to, but not beyond,1/3 of the width of the waterbody. The applicant's current proposal would limit the span of the pier structure to %4 of the width of the waterbody. 10. Anticipated Impacts Impacts to the upland portion of the development will involve the transformation of a moderately wooded tract to a residential subdivision. Location and number of residences and associated streets have not yct been determined, so impervious coverage cannot be calculated. However, development of individual lots within the estuarine shoreline area of environmental concern along both creeks would require minor permits, which would allow for separate review. The applicant is proposing no other development within the Division of Coastal Management Areas of Environmental Concern besides the walkway and associated structures. However, the applicant has been made aware that all future development will be subject to review from the appropriate agencies and that the Division reserves the right of full disclosure of any subsequent upland develo me . The pier is consistent with the 1/4 Rule and should not impede navigation.
