The Wilmington Regional Office received the Stormwater
submittal for the subject project on June 4, 1991 and final
information on July 3, 1991. Based on our review of the
project
plans and specifications which limit the built -upon area to4,800
square feet on each of the 64 lots identified, we have determined
that the project complies with the Stormwater Regulations set
forth in Title 15A NCAC 2H. 1003(a)(2). This Certification shall
be effective from the date of issuance until rescinded and the
project shall be constructed in accordance with the plans and
specifications as filed with the Wilmington Regional Office.
Any modification of the plans submitted to this Office or
further development of this site will require an additional
Stormwater submittal/modification and approval prior to
initiation of construction. Modifications include but are not
limited to; project name changes, transfer of ownership, of built -upon surfaces, addition of built -upon surfaces, redesign
or further subdivision of project area.

COMPLIANCE WITH STORMWATER REGULATIONS
In accordance with Title 15 NCAC 21-1.1003(a)(2), the following DEED
RESTRICTIONS AND PROTECTIVE COVENANTS shall be recorded in the
Brunswick County Registry prior to the conveyance of lots. Said Deed
Restrictions and Protective Covenants shall apply to the Oyster Bay Phase 4
Subdivision project in Sunset Beach, North Carolina as shown on design
plans titled "Erosion Control and Stormwater Plan - Oyster Bay Phase 4 - Sea
Trail Plantation" prepared by Houston and Associates, P.A. dated May 21,
1991:
'No more than 4,800 square feet of any lot shall be covered by
structures and/or paved surfaces, including walkways or patios of brick,
stone, slate, or similar materials. This covenant is intended to insure
continued compliance with stormwater runoff rules adopted by the State of
North Carolina and therefore benefits may be enforced by the State of North
Carolina. This covenant is to run with the land and shall be binding on all
parties and all persons claiming under them."

On behalf of Sea Trail Corporation, we are pleased to submit for your

2. Hydrologic, Hydraulic, and Related Calculations
3. Executed "Financial Responsibility/Ownership Form"
These documents, together, represent the complete Erosion Control
Plan we have developed for the subject project. As shown on the enclosed
drawings, an erosion control plan will be implemented that includes both
temporary and permanent erosion control measures.
By copy of this letter, we are making submittal of this project today to
Mr. Paul Rawls of the Division of Environmental Management (NCDEM) for
compliance with. the current North Carolina Stormwater Regulations.
We calculate the disturbed area for this particular project to be 5.8
acres. Enclosed is a check from Sea Trail Corporation in the amount of one
hundred thirty dollars ($130.00) to cover the required application fee. The
application fee was calculated using the fee schedule previously provided us
(ie. $30.00 for the first acre of disturbed area and $20.00 for each additional
acre of disturbed area or any part thereof).
