We find the plan to be acceptable with modifications and herby issue this Letter of Approval with Modifications. Modifications must be received in this office no later than two weeks prior to the project start date. Failure to submit modified plans can result in a violation and fine under the Iredell County Land Development Code. The Modifications required for Approval are listed on the attached page. The Certificate of Approval issued by Iredell County must be posted at the job site. This plan approval shall expire three (3) years following the date of this approval as is required by Title 15A NCAC 4B.0129 and Section 9.6.6 of the Iredell County Land Development Code. Title 15A NCAC 4B 0118(a) and Section 9.6.9 of the Iredell County Land Development Code requires that a copy of the approved erosion control plan be on file at the job site. Any amendments and/or revisions to the approved plan must be reviewed and approved prior to implementation in order for the site to remain in compliance. Failure to submit plans for approval may result in administrative actions and/or penalties as indicated in the Iredell County Land Development Code. Also, this letter gives notice as required by G.S. 113A-61.1(a) and Section 14.2.2 of the Iredell County Land Development Code, of our right of periodic inspection to insure compliance with the approved plan. Iredell County's Sedimentation Pollution Control Program is performance-oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is Letter of Approval with Modifications Colonial Crossing August 14, 2019 Page 2 of 4 inadequate to meet the requirements of the IredelI County Land Development Code and the Sedimentation Pollution Control Act of 1973, (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act and Code. Acceptance and approval of this plan is conditioned upon your compliance with Federal, State, and County water quality laws, regulations, and rules. This approval does not supersede any other permit or approval. As of May 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCGO10000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.ne.gov/NCG01. Please direct questions about the NOI form to Annette Lucas at Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Initially, DEMLR will not charge a fee for coverage under the NCGOI permit. However, on or after May 1, 2019, a $100 fee will be charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. In addition, it is required that this office to be notified of the proposed starting date for this project. Please notify us when you plan to have a preconstruction conference. Suggested changes are designated as "SC" for improvement of the plan. 1. Provide copies of 401/404 permits required for work in streams'creeks. —RC 2. Provide phasing for project to limit disturbed areas to no more than 20-25 acres at one time, per conversation on August 13, 2019 with Josh Overcash and Evan Hinson of Merrick & Company. Utilize sheets provided in email to this office from Merrick & Company and include this phasing in the construction sequence, requiring stabilization as areas are brought to grade. —RC 3. Turn silt fence up at basin outlets. Basin outlets should not discharge into disturbed areas. —RC 4. Silt fence should be across all down slope side of all land disturbing activity. —RC 5. All basin outlets should merge over stream buffer, not intersect perpendicularly. —RC G. All sediment stockpiles to be located at least 50 feet from diversions and basins. Wrap downslope sides of stockpiles with silt fence. —RC 7. Use slope drains for al diversions entering basins. Provide inlet/outlet protection for all slope drains. Provide details. --RC 8. Use diversionslbenns and slope drains to direct runoff into basins. Do not allow runoff to sheet flow over basin slopes into basins. RC 9. All diversions shall enter basins in front of the first row of baffles farthest from skimmer. —RC 10. Use straw wattles for check dams, not rip rap. —SC 11. Stream crossing areas to be protected from impacts, only open up to install culvert, immediately stabilize when complete. —RC 12. Stream culverts to be installed in a timely fashion to lessen impacts to stream. Work is not to be left Iingering. Do not start if there will be any delay during this construction process. —RC 13. Space baffles out more in basins. —SC 14. Silt fence should be 10 feet off toe of slopes. —RC 15. Slopes 10 feet and greater in height need more protection than silt fence. May use double row of silt fence with wire backing and silt fence stone outlets staggered. Track and place matting on slopes immediately after they are brought to grade. —RC 16. Need contours labeled for clarity. —RC 18. Basins in Phase 2 are only to be maintained. Stone pipe outlet work is permitted, but these basins are to remain in initial configuration until all areas draining to them are stabilized. —RC 19. Diversions need to be installed and maintained as the site is brought to grade, continue to carry runoff to basins from top or bottom of slopes. —RC 20. Provide a generic lot protection detail for lot building phase. —RC 21. Under the Erosion Control Notes and Construction Sequence, it should reference lredell County not NC DEQ. —RC 22. Riser basin 1 skimmer orifice should be closer to 2.75 inches to dewater the required volume in as close to 3 days' time as possible. —RC 23. Skimmer basin 2 skimmer orifice should be closer to 2 inches to dewater the required volume in as close to 3 days' time as possible. --RC 24. Riser basin 3 skimmer orifice should be closer to 2.5 inches to dewater the required volume in as close to 3 days' time as possible. —RC 25. Riser basin 4 skimmer orifice should be closer to 2.75 inches to dewater the required volume in as close to 3 days' time as possible. —RC 26. Skimmer basin 5 skimmer orifice should be closer to I inch to dewater the required volume in as close to 3 days' time as possible. —RC 27. Riser basin 13 does not need a pre and post design. The basin is to stay in its initial installation dimensions until areas draining to it have been stabilized. —RC 36. Riser basin 14 skimmer and skimmer orifice should be designed to dewater the required volume of 33,660 cubic feet in as close to 3 days' time as possible.—RC
