Mr. Khan, Mr. Moore,good afternoon, Shield Engineering, Inc(Shield)would like to notify your office that,following a phone conversation with Ms. Alaina Morman from central offices of NC DEQ on 8/3/2021, our client—Daimler Trucks North America—Cleveland, NC facility —has exited Tier 3 for SDO#001 for copper(the other parameters have not triggered a Tier 2 or Tier 3 response), under the new stormwater permit NCG030000(CoC No. NCG030039). Shield spoke with Ms. Alaina Morman (regulator at the central offices of NC DEQ) in order to clarify certain gray areas of the new stormwater permit regarding Tier 3 response. SDO#001 has been beneath all benchmarks for 3 consecutive months and under the new permit SDO#001 would automatically exit all tiers, however the benchmarks were met while still under the old permit, hence the gray area. Ms. Morman clarified the language of the new permit and instructed that SDO#001 should exit all Tiers and be monitored quarterly.
