Good morning Mr. Khan, I have attached an August 18, 2017 letter that was sent to the above facility from you regarding their copper and zinc concentration exceedances in their two stormwater outfalls. It provides relief from monthly monitoring and returns the facility to a semi-annual monitoring status which they have currently been operating under. It is my understanding from speaking with facility representatives you have visited the facility previously and this letter was generated from that visit. The facility continues to have struggles with sporadic copper and zinc exceedances in their semi-annual samples from their two outfalls. The facility believes this letter relieves them of future Tier 2 and Tier 3 monitoring if they should have consecutive exceedances of copper and zinc in their two outfalls. I would very much like to speak with you about the context of this letter and the continued applicability of it. Please note, I have previously sent an e-mail to Bethany Georgoulias who has helped me in the past regarding this issue as I had incorrect contact info for you. Rowan County Dear Mr. Smith: ROY COOPER Governor MICHAEL S. REGAN Secretary TRACY E. DAVIS Director We are in receipt of your July 17, 2017 letter requesting relief from monthly monitoring at the Ceveland facility. Based on the site inspection May 4, 2017 and the information provided the facility is in compliance with the tiered response actions and other conditions of the NCG030000 General Permit. Therefore, the Division is granting regulatory relief from the Tier responses. Upon receipt of this letter, the subject facility may resume the permit specified semi-annual analytical monitoring for the remainder of the current permit term which expires on October 31, 2017. This decision applies only to the copper and zinc benchmarks. A benchmark exceedance of any other parameter listed in your permit will trigger the tiered response actions as described in the general permit. When the new general permit is issued you will need to review the new copper and zinc benchmarks and follow the applicable relief measures if required. You must notify this office, in writing, within five business days if you become aware of any significant source of copper or zinc at your facility that has the potential to be exposed to stormwater. The relief granted in this letter is contingent upon the current industrial practices at GEM Fabrication of North Carolina Inc. If industrial practices change and copper or zinc does become a significant stormwater exposure risk or significant zinc or copper values have been recorded during regular sampling events, then this office reserves the right to withdraw this decision and reinstate the permit specified tiered response or other actions that may be warranted by the new set of circumstances. Please retain and append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit.
