Basically, there are two types of swales: 1) a 100' treatment swale with a maximum 5:1 side slope and 2) a conveyance swale with a maximum 3:1 side slope. Also, some subdivisions have a hybrid permit which allows some areas in the project to be low density (with swales) and some areas to be high density with ponds, etc. In the case at Beachwalk, it is a high density permit with a pond. So, the swales are basically conveyance swales. The permit states the following: "All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures." This is an old permit so it is allowable to provide roof drain gutters which drain to the street or to a drainage swale leading to the pond. For water quality, It is advantageous to have roof drain spouts going into the yard so the runoff can filter through the grass before entering the street or ditch. This is called disconnected impervious surfaces. We always recommend this method if possible. In some of the newer permits, credit is given if the developer agrees to design it with "disconnected impervious." I hope this helps to clear things up. Don't hesitate to call if you have any questions. Steve Pusey 910-796-7334 From: Bill Bryan[mailto:billbryan1946@gmail.coml Sent: Saturday, January 14, 2017 5:03 PM To: Pusey, Steven <steven.pusey@ncdenr.aov> Cc: HOA-Dan Church <dtchurchkb@gmail.com>; HOA-Jim Craig <jdcraig62@gmaiI.com> Subject: State Regulations Steven, There is quite a lot of confusion within Beachwalk HOA over what constitutes a legal/illegal drainage from a house's downspout into an adjacent ditch. For instance, we have one homeowner who lives adjacent to the first ditch in our SWS. He wants to pipe his downspouts directly into this ditch to prevent erosion between his house and the ditch. His logic is the water from his downspouts will be mixed with other turbid water from the neighboring subdivision's water that is discharged directly into our system (Ditch D1 on the engineering drawing). The water from D1 also proceeds through two ponds (serially) for settling. If you think through his argument, is sounds very logical; but is it legal....????. Could you please advise at your very earliest convenience? We literally have men with shovels ready to dig, but are holding off until we hear from you. Thank you.
