Dear Mr. Zilisch:
On April 8, 2021, Jesse McDonnell from the Mooresville Regional Office of the Division of Energy, Mineral,
and Land Resources (DEMLR), visited the subject site located at 149 Cayuga Drive, Mooresville, NC 28117.
The inspection and file review revealed that Late Apex Storage, has not obtained coverage under, NPDES
Construction General Permit No. NCGO 1 for stormwater discharges from the site. The site currently discharges
stormwater affected by processes on site to Byers Creek.
A National Pollutant Discharge Elimination System (NPDES) permit is required to discharge stormwater from
construction and development activities that result in a land disturbance greater than or equal to one acre, or that
are part of a common plan of development of that size or greater, that are also subject to the North Carolina
Sedimentation Pollution Control Act of 1973 to water of the state. [G.S. 143-215.1(a) and 15A NCAC 2H
.0126]
A Certificate of Coverage (COC) under the NCGO1 permit must be obtained within 15 calendar days of receipt
of this notice. The Notice of Intent (NOI) form and additional guidance are available online at
deq.nc.gov/NCGO1.
