The covenant of the Grantor that neither it nor its successors and assigns will pollute or divert or change so as to diminish the flow of water of the stream that flows into and through the property. III. All right,title and interest that the Grantor shall have in and to the road leading from the above described property to N.C.State Highway No.88 heretofore jointly used by the Ashe County Board of Education and its predecessors in title. IV. A right-of-way and easement for the location of a water line under and in accordance with the Deed from Robert Bare and wife,Carrie Bare,to P.H.Hanes Knitting Company,Inc.recorded in Book X-3,Page 118. V. A perpetual right of easement of ingress and egress in,over and across the entire length of the street 40-feet in width described upon the Plat recorded in Map Book 2,Page 83, Ashe County Register of Deeds. AND SUBJECT TO: A. A street right-of-way extending 30 feet onto and parallel with the extreme north boundary of Tract One,said right-of-way having been conveyed to Gates Rubber Company by Grant of Easement of Right-of-Way from Hanes Corporation recorded in Book 111,Page 81. B. To the extent applicable and not heretofore abandoned,water system rights and easements heretofore conveyed to Jefferson Water Company,Inc.by Conveyance from Edward Osborne and wife,Beatrice Osborne,recorded in Book F-3,Page 195,the same potentially affecting only that part of Tract One hereinabove described comprised of the Second Tract in the Deed to Hanes Corporation recorded in.Book N-4,Page 299. The rights reserved in the Deed from W.B.Austin,et al,to Hanes Corporation recorded in Book E-4,Page 276,respecting the extreme southerly 2.11 acres of Tract One above described and being Lots Nos.53 through 77 of the Morphew Property described by and upon a Plat of subdivision recorded in Map Book 2,Page 83,the recited reservations being as follows: "That the right is reserved to lay,construct,operate and maintain on,over and through said lot or lots,pipelines for water or gas,for the purpose of water lines, waterworks or lighting system;also the right to construct,operate and maintain sewers, drains and water pipes for the drainage of the property,provided,however,that this restriction shall not debar the Grantee,his heirs and assigns,from making claim for damages as provided by law against the proper parties that may construct pipelines, sewers,ditches,telephone and electric lines,and only such additional restrictions as contained in any valid and subsisting ordinance of the Town of Jefferson'. The property hereinabove described was acquired by Grantor by instrument recorded in Deed Book 395,Page 342 A Map showing the above described property is recorded in Plat Book 2,Page 83,Ashe County Registry.
