The report summarizes the findings of a recent inspection of the project's stormwater controls conducted on January 6, 2009 to determine compliance with Stormwater Permit Number SW8 970538 issued on July 25, 1997. The required actions that are necessary to bring this site into compliance are noted on the attached inspection report. Please inform this Office in writing before Monday, March 2, 2009 of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $10,000 per day. As indicated in the attached inspection report the following issues must be resolved: The stormwater system must be corrected so that it functions as it was designed to do. The level spreader and vegetative filter must be installed per the details approved in the plans. 2. An application for a permit renewal must be completed and returned to the Division. 3. In order for the permit renewal to be processed it must be accompanied by both the renewal fee of $505 and a completed "Engineer's Certification". The engineer's certification is to be completed by a professional engineer, typically the engineer who designed the system, and simply certifies that the system has been installed as specified in the design, and is functioning properly. 4. if ownership of the property has changed since permit issuance then please also include a new "Operation and Maintenance" agreement and a completed "Name/Ownership" form. Also, an engineer has never certified that the stormwater system was installed as it should have been. Comparing the installed system to the plans it appears that the level spreader that was detailed in the plans was never installed. In order to bring this site into compliance the following items must be corrected: 1)The stormwater system must be corrected so that it functions as it was designed to do.
