Dear Mr. Bovino:
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8970144
to Town & Country Developers at Wilmington Inc. for a High Density stormwater pond to serve The
Lakes Phase VI Johnson Farms on 3/26/1997. This permit expired on 3/26/2007. Section .1003(h) of
15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit renewals shall be
submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee,
which is currently set at $420.00. If this is still an active project please complete and submit the
enclosed renewal application in a timely manner. If this project has not been constructed and a permit
is no longer needed, please submit a request to have the permit rescinded. If you have sold the project,
or are no longer the permittee, please provide the name, mailing address and phone number of the
person or entity that is now responsible for this permit. Enclosed is a form for change of ownership,
which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

On December 21, 1998, and July 24, 1998, the Division of Water Quality in the
Wilmington Regional Office received requests to transfer the ownership of the subject projects.
A subsequent inspection of the facility determined that the ponds were not in compliance, and the
Division sent letters to Mr. William Buchanan of South College Associates, requesting that the
necessary repair work be done. The letter also requested that the necessary documentation be
submitted and that you sign, notarize and send in the operation and maintenance plans. These
forms are required in order to complete the transfer process.
To date, neither the operation and maintenance forms nor the Designer's Certifications
have been submitted. You have already agreed to maintain the ponds, per the completed and
signed - 1998 change of ownership forms you signed. Please complete the process by signing,
notarizing and returning the enclosed operation and maintenance forms with original signatures.
Additionally, please contact the designer, Joseph Hill, P.E., to have him submit the required
Designer's Certifications.in order to complete the transfer process.

Response to Compliance Inspection
Dear Ms. Lewis:

We are responding to your letter dated January 23, 2001, regarding the Johnson Farms
stormwater ponds. As a result of checking our files and performing a field inspection of the five
(5) stormwater management ponds, we submit the following:
Phase VI (Permit Number SW8 970144) appears to be under separate
ownership. A permit name/ownership change was submitted which transferred
the permit from South College Associates, LLC to Town and Country Developers
at Wilmington, Inc. in 1998.
We did not inspect the Still Meadow Village stormwater pond, since it did not
appear to be addressed in your Compliance Inspection. If this pond needs
attention and is subject to the Compliance Inspection, please let us know. This
pond was constructed under Permit No. SW8 970726.
Pond No. 1 at Pine Hollow appeared to be in good working order. The side
slopes had a vigorous, but dormant, growth of what appeared to be
Bermudagrass on most of the pond banks. Other areas were covered with mulch
and hydroseeded. Ryegrass was providing additional winter stabilization. The
riser and orifice were properly protected with a trash rack.
4. Pond No. 1 at The Lakes at Johnson Farms had been cleaned of vegetation and
the pond depth restored. The side slopes had been graded and sodded and the
slopes stabilized. New riprap had been placed. A trash rack had been installed
in the opening in the riser face above the orifice. A trash guard for the orifice
structure had been installed. This pond was constructed under Permit No. SW8
94707.
5. Pond No. 2 at The Lakes at Johnson Farms had been cleared of vegetation and
the bottom depth restored. The pond banks had been seeded, mulched, and
sodded and new riprap had been placed. Neither the orifice nor the opening in
the riser face above the orifice had been protected with a trash guard. This
pond was constructed under Permit No. SW8 94707.
6. Pond No. 3 at The Lakes at Johnson Farms had erosion cuts through the two
forebays. The pond banks had been stabilized with sod, hydroseeded and
mulched. New riprap had been placed. The orifice had not been protected with

a trashguard. The opening in the riser face above the orifice had been
protected with a trash guard. This pond was constructed under Permit No. SW8
96026.
7. The Cambridge Heights stormwater pond (Phase VI) had winter rye growing on
the banks. We suggest that you contact the owner, Town and County
Developers, regarding permanent stabilization of the pond slopes, the deed
restrictions, and the designer's certification. Their local representative is Mr.
Mike Alvis, at 452-0296. If we can be of assistance, please contact us.
Bank stabilization of Pine Hollow pond #1, and ponds #1, 2 and 3 of The Lakes at
Johnson Farms appeared to have been brought into compliance. Remaining items to be
addressed are orifice trashguards at ponds #2 and 3 and a trashguard over the open riser face
above the orifice in pond #2. The erosion cuts through the forebays in pond #3 should be
stabilized with riprap or compacted ABC stone placed over geotechnical fabric.
In our estimation, these needed items can be addressed by the owner, with completion
in less than 30 days.
We are requesting South College Associates, by copy of this letter, to submit a copy of
the deed restrictions for The Lakes at Johnson Farms - Phase V.
A Designer's Certification for The Lakes at Johnson Farms - Phase V will be submitted
upon completion of Item #7 regarding pond #3.

On January 12, 1999, the Division of Water Quality sent you the Operation and Maintenance plans to be
signed for the two detention ponds (T4 and r5) at he Lakes at Johnson Farms, Phase VI. You had already signed
the permit name/ownership change farm (copy attached) on July 24, 1998, but the State could not complete the
transfer until those Operation and iMaintenance plans were signed and returned (copies attached). To date, the
requested documents have not been provided.
Please fmd enclosed a coov of the inspection report compiled after a recent inspection of the facilities
was performed. Since the transfer has not been completed, the report was sent to Mr. Buchanan, but I suspect he
I be in touch with you to address the deficiencies found during that inspection, if in fact, you are the
responsible party.

These ponds will store the runoff generated by 1 inch of rainfall. The stored runoff
will be discharged over a period of 2.9 days (pond #4) and 3.7 days (pond #5).

The Wilmington Regional Office received a Stormwater Management Permit Application for The Lakes @Johnson
Farms, Phase VI on January 29, 1997. A preliminary review of that information has determined that the application is
not complete. The following information is needed to continue the stormwater review:
The preliminary site plan does not match up with the proposed subdivision. A cul-de-sac has been
replaced with a through road, and a formerly unpaved right-of-way has been connected into the
neighboring property.
2. Complete Section II of the permit application, the breakdown of the impervious area. Please transfer the
numbers from the calculations to the application.
3. Please show the calculations for confirming that the forebays are designed to hold 20% of the total pond
volume. Please show the grading for the forebays on the plans, and add dimensions for the forebays.
4. Delineate all wetlands on site, or note on the plans that none exist.
5. Locate the ponds in recorded access/drainage easements.
6. Please indicate where the road paving will end for the drainage area to each pond.
7. What mechanism will be used to ensure that all runoff from the impervious areas is sent to the ponds?
You must indicate by notes on the plans and recorded deed restrictions that either the lot will be graded
to drain to the street, gutters will be required on all the houses, or rear Iot line swales will pick up the
runoff and direct it into the pond.

8. Is this project also to be known as Still Meadow Village? The TRC approved a high density project back
in September of 1996 near this site, and I need to know if this is it.
9. Please complete the data for the pond section details including forebay bottom elevation or depth, and the
top of the weir elevation.
10. Please list the streets by name, number or letter under each street detail on the plans. Both rights -of way
are 50' wide, making it more difficult to distinguish which street is 36' and which is 28' .
11. Please relocate the inlet at Pond 5 near Lot 214 so that short-circuiting of the pond does not occurr. The
forebay cannot be utilized as a reason to allow the location of this pipe so close to the outlet. The ideal
pond design is narrow at the single in with a forebay, and gradually widens toward the outlet and has
a 3:1 length to width ratio. The same thing applies to the Pond 4 inlet at the corner across from Lot 150.
12. The calculations for Pond,S show the permanent pool to be 18.2 in one location, and the surface areas
of the permanent pool and the storage pool are reversed.
13. Preliminary pond review indicates adequate surface area, volume and drawdown.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to March 12, 1997, or the application will be returned as incomplete.
The return of a project will necessitate resubmittal of all required items, including the application fee.

Dear Mr. Buchanan:
A preliminary plan for the referenced project was reviewed by the Technical Review
Committee of the County Planning Board on September 25, 1996 and approved pursuant to
Section 102-4 of the County Zoning Ordinance. Approval is contingent upon the following:
1. That the preliminary plan be revised to include a road connection to the north at
Georgetown Subdivision and to the west into the J.P. McGinnis property. ,Other road
stubs approved as part of the preliminary plan included connections to Lakewood, Pine
Hallow and Still Meadow Village. Please remit three copies of the revised plan.
2. That a temporary barricade be erected at the west end of Pine Hollow Drive for
controlling construction traffic originating in the Lakes project.
3. The subdivision will be serviced by County sewer. However, due to limited capacity at
the Southside Wastewater Treatment Plant, sewer capacity may not exist. Therefore, final
plat approval of sections of this subdivision may be withheld if in the opinion of the county
Engineer, adequate sewer capacity does not exist.
A total of 412 lots as indicated in your land use summary are approved. TRC members
Jim Wolle, Ken Shanklin, John Galarde, John Dyer, and Wesley Nixon; members of the Planning
staff; Joey Hill, Alton Lennon, and you attended the meeting. Also attending were numerous
residents from Pine Hollow and the Lakes at Johnson Farms.
This approval shall be valid for one (1) year. The plan will automatically expire if a final
plat for all or part of the plan is not recorded within twelve months. You may request a
preliminary plan extension from the Technical Review Committee if you are not able.to,record a
map in the prescribed time. Ail extension requests must bg ma ' dorta the �lan's expiration
If you desire to record a map prior to the completion of required improvements, a surety
in the form of a letter of credit, bond, or cash in escrow must be posted. However, a cost

3. Compliance Issues:
Pond #1:
(a) There are severe erosion problems around the inlets. Sediment from the banks
has entered into the fore -bay area.
(b) It appears that a portion of the fore -bay may have blown out, sediment is
entering the main body of the storm pond through the hole.
(c) The outlet orifice is clogged and the outlet trash rack is covered with decaying
. algae.
Pond #2:
(a) The fore -bay may also be blown in this pond. And the orifice may also be
clogged.
(b) More sod is required to stabilize the pond slopes.
4. Required Actions: (Explain each deficiency and what needs to be done to bring
the system back into compliance)
(a) Remove dead algae from outlet structure and clear out clogged orifice pipe for
both ponds. Place more sod on pond slopes and pond banks.
(b) Repair fore -bays for both ponds.
(c) Repair the erosion problems near inlets with rip/rap. If these are not stabilized
they will continue to get worse. Remove the sediment that has entered into the
fore -bays,

Dear Ms. Lewis:
In response to your letter dated February 12, 1997, the following information is
submitted for your review:
1. A copy of the preliminary plan was submitted to demonstrate that the
outfall ditch from pond #5 was adequate to convey future runoff at a
non -erosive velocity. Differences you noticed between the street layout
on the preliminary plan when compared with the stormwater plan are
the result of New Hanover County requirement for providing street
connections to adjacent property. Calculations reflect the actual
construction plan which is also the Stormwater Management Plan. The
preliminary plan can be disregarded, except for off -site drainage
calculations.
2. Section III (impervious surface breakdown) of the application form is
complete.
3. Calculations showing forebays are designed to hold 20% of the runoff
volume generated by a one -inch rainfall are enclosed.
4. A note is added on sheet #1 stating that no wetlands are on the site.
5. A note is added on sheet #1 stating that ponds shall be located in
drainage/access easements.
6. End of street paving is shown, indicating drainage area to each pond.
7. A note on the plans and in the deed restrictions requires all impervious
surface runoff to be directed to the ponds by grading lots to drain to the
streets or installing rooftop gutters to drain to the streets.

9. The pond section details show the forebay bottom elevation and the top
of the dam (weir) elevation.
10. Streets are listed under each detail showing which streets are 36' wide
and which streets are 28' wide. Please notice that the street pavement
shown on the plans within the rights -of -way accurately differentiate
between these widths.
11. The pond inlets have been relocated to prevent short-circuiting. The
outlet for pond #4 has been relocated to prevent short-circuiting. All
inlets to each pond are directed into a single forebay.
12. Pond #5 calculations are corrected.
