All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On October 22, 1997, DWQ issued a modified high density State Stormwater Management Permit (# SW8 970138) for the A-1 Hitch and Trailer Sales site at 346 Ocean Highway West, Supply in Brunswick County. This permit expired on October 22, 2007. Per 15A NCAC 2H.1003 (h) (the stormwater rules), it is your responsibility to submit an application to renew the permit 180 days prior to the expiration of the permit. Please note that the current renewal period is 8 years. In order to bring this permit into an active status, two renewals are required to be submitted as demonstrated below: Renewal 1: October 22, 2007 + 8 years = October 22, 2015 (new expiration date) Renewal 2: October 22, 2015 + 8 years = October 22, 2023 (new expiration date) Upon review of the Brunswick County GIS website and tax records as well as aerial photos available online, it appears that this property has been sold and a new development has been constructed. This new development appears to have been permitted under State Stormwater Permit SW8 040201 for the Brunswick Medical Campus. If this is the case, and the permit is no longer needed, please submit a written request to have the permit rescinded. However, if the permit is still needed, please complete and submit the renewal application available on the DEMLR website at: http://portal.ncdenr.org/web/Ir/state-stormwater-forms dots. Ifyou .have sold the project, or are no longer the permittee, the renewed permit must be transferred. In order to transfer the permit, please complete the name/ownership change form that is also available on the website address provided above. Additionally, your permit requires that upon a designers certification be submitted to the Division to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. The Division does not currently have a certification for this system in our files. Therefore, please include a copy of the certification with your permit renewal request. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built - upon area. 6. The following items will require a modification to the permit; a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. State Stormwater Management Systems Permit No. SW8 270138 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 7. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have. jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, 'including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 25th day of August, 1997. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The surface area shown on the plans was previously revised to 7,589 ft2 to provide the minimum required permanent pool surface area of 7,405 ft2. Now the plans show the original 7,014 ft2. Please revise the plans to reflect the 7,589 previously shown. 2. I still cannot approve the 4" orifice. I believe it to be much too large. According to the standard orifice equation; rearranged to solve for area, if A= Q/Ca 2gh, where A is the desired orifice area, Q is the flowrate for a 2 day drawdown,q is the coefficient of discharge (usually .6) g is gravity (32.2 ft/s 2), and h is the average head to the centerline of the orifice, then a 4" orifice will draw down the volume in less than 8 hours. Can you please provide the methodology and equations used to arrive at the flowrates and time that you show? Or, recalculate the orifice based on the orifice equation, and revise the size. The rating curve you provide makes no sense to me. What is it telling me? 3. Trash may not be able to enter the perforated pipe, but floating debris can certainly prevent runoff from leaving through the perforations. The following information is needed to continue the stormwater review: This Office is unable to permit an engineered system without an outlet unless it is an infiltration system that can hold and infiltrate the 25 year, 24 hour storm, ie., 8" of rain. If infiltration is now to be the treatment of choice, a soils report indicating the type of soil, the expected infiltration rate, the elevation of the Seasonal High Water Table, and the expected drawdown time of the system must be submitted. Additionally, a site visit must be scheduled with the Regional Soil Scientist to verify the conclusions of the soils report. 2. If you are not sure if there are wetlands on site, you must contact the Corps of Engineers to schedule an evaluation, or get an evaluation done by a company recognized by the Corps to flag wetlands. You must state ON IIETLANS that no wetlands exist, or you must provide the map of the delineation. No stormwater treatment systems may be located in jurisdictional wetlands unless a permit is issued allowing them to be filled. 3. Forebays and the vegetated shelf are not options, they are design requirements. I do not have the authority to waive design requirements. Please provide orifice sizing calculations, if keeping the detention pond design. 5. I disagree with the off -site runoff. The quad sheet provided does not agree with the topo shown on the plans. The quad sheet shows a 40 contour through the middle of the site, rising to 45 to the -east, while the plans show a 46 contour rising to 55 to the east. The rising contour toward the east suggests that runoff may be entering from the east side, depending on how much more the contour rises toward the east. Please verify and either show the off - site area and account for it in the pond design, or reroute it, or state on the plans that no off - site runoff enters the site. 6. If you are using the 85 % TSS chart, then you MUST provide a vegetated filter per the enclosed detail. Again, this is a design requirement, and is not optional. The vegetated filter can be deleted if you use the 90 % TSS chart. This will increase the pond's required surface area at the permanent pool. 7. Your rounding down early in the calculations (ie. , 25 % vs. 25.3 % impervious, SA/DA of 2.1 vs. 2.124, a required surface area of .012 acres vs..012117) has thrown off the end result to the point that even the increased surface area you now provide, 5,219 square feet, is not sufficient. The minimum surface area required is 5,340 square feet, and the minimum volume is 5,817 cubic feet.. Please note that this request for additional information is in response to a preliminary review. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office. Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and supporting documentation, or a written response regarding the status of this project and the expected submittal date must be received in this Office no later than February 28, 1997, or the subject project file will be closed and construction may experience a subsequent delay.
