Hobbs. in the amount of 1 339.60 which includes $339.60 in investigative costs. Attached is a copy of the assessment document explaining this penalty. This action was taken under the authority vested in me by delegation provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality. Any continuing violation(s) may be the subject of a new enforcement action, including an additional penalty. Submit a written request for remission or mitigation including a detailed justification for such request: A request for remission or mitigation is limited to consideration of the reasonableness of the amount of the penalty and is not the proper procedure for contesting the accuracy of any of the statements contained in the assessment letter. Hobbs FOR VIOLATIONS OF CONDITIONS OF A STORMWATER MANAGEMENT PERMIT PERMIT No, SW8 960608 NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES File No. PC-2004-0023 FINDINGS AND DECISION AND ASSESSMENT OF CIVIL PENALTIES Acting pursuant to North Carolina General Statutes (G.S.) 143-215.6A, and by authority delegated to me in accordance with G.S. 14313-282.1(0,1, Thomas Reeder of the Division of Water Quality (DWQ), Department of Environment and Natural Resources (DENR), make the following: I. FINDINGS OF FACT: A. Richard S. Hobbs was issued a State Stormwater Permit No. SW8 960608 on August 21, 1996, project known as Something Fishy H located in Carolina Beach, New Hanover County. B. Richard S. Hobbs developed a restaurant known as Something Fishy II. The restaurant is now know as Barrier Island Restaurant. C. For development activities located within the 20 coastal counties, a Stormwater Management Permit is required by 15A NCAC 2H .1003 for development activities that require a Coastal Area Management Act Major Permit or an erosion and sedimentation control plan. D. New Hanover County is a Coastal County as define by 15A NCAC 2H .1002(4). E. The land disturbances associated with the development of the restaurant, Something Fishy 11, required an erosion and sediment control plan. F. On February 4, 2000, and on June 4, 2001, DWQ staff inspected the site. The site inspections and subsequent file review resulted in the following observations: 1. Failure to maintain the side slopes of the pond at a 3:1 or flatter. 2. Failure to provide a Designer's Certification. 3. Failing to submit a modification for a transfer of ownership upon sale of property. 4. Failing to submit a formal permit request to change ownership. 5. Failure to provide the operation and maintenance necessary to assure optimum efficiency of the stormwater pond. G. State Stormwater Management System Permit No. SW8 960608 contained the following relevant conditions: I. Design Standards 6. The following items will require a modification to the permit: a. Any revisions to the approved plans, regardless of size. b. Project name change. c. Transfer of ownership d. Redesign or addition to the amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyances shown of the approved plan. H. State Stormwater Management System Permit No. SW8 960608 contained the following relevant conditions: II. Schedule of Compliance. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operations and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclodgging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. IT. Schedule of Compliance. 5. Upn completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. I. State Stormwater Management System Permit No. SW8 960608 contained the following relevant conditions: III General Conditions. 1. This permit is not transferable. In the even there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. J. On June 19, 2002, the New Hanover County Sheriff's Office delivered ithe inspection reports and enforcement letter to Richard S. Hobbs. K. The cost to the State of the enforcement procedures in this matter totaled 339.60. Based on the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. Richard S. Hobbs is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). B. New Hanover County is a coastal county as deigned by 15A NCAC 2H.1002(4). C. Richard S. Hobbs holds a valid Stormwater Management Permit, Number SW8 960608, issued on August 21, 1996, for the construction of Something Fishy U (restaurant). D. Richard S. Hobbs violated Conditions I. DESIGN STANDARDS, 6. b of Stormwater Permit SW8 960609 by failing to submit a modification for a transfer of ownership upon sale of property. E. Richard S. Hobbs violated Conditions WSCHEDULE OF COMPLIANCE, 2. of Stormwater Permit SW8 960608 by failure to provide operation and maintenance necessary to assure optimum efficiency of the permitted stormwater system. F. Richard S. Hobbs violated Conditions II.SCHEDULE OF COMPLIANCE, 2. e. of Stormwater Permit SW8 960608 by failure to maintain side slopes in accordance with approved plan. G. Richard S. Hobbs violated Conditions II.SCHEDULE OF COMPLIANCE, 5. of Stormwater Permit SW8 960608 by the failure to provide the DWQ a Designer's Certification. H. Jerry R. Coston violated Conditions IH.GENERAL CONDITIOSN, 1. of Stormwater Permit SW8 960608 by failing to submit a formal change of ownership. Richard S. Hobbs may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(2), which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation per day may be assessed against a person who is required but fails to apply for or to secure a permit required by G.S. 143-215.1, or who violates or fails to act in accordance with the terms, conditions, or requirements of such permit or any other permit or certification issued pursuant to authority conferred by this Part. The State's enforcement cost in this matter may be assessed against Richard S. Hobbs pursuant to G.S. 143- 215.3(a)(9) and G.S. 143B- 282(b)(8). K. Thomas Reeder, of the Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources, has the authority to assess civil penalties in this matter. Based upon the above Findings of Fact and Conclusions of Law, I make the following: III. DECISION Accordingly, Richard S. Further, this assessment recommendation will consider past violations, penalty amounts may be up to 25,000.00, and unless these violations are resolved future/continuing penalties will be consider unless this matter is properly resolved.... 2) Send the NOV to both parties. The first approach remains; however, we could also tailor the NOV to current owner as well. The justification is that the current owner is enjoying the benefit of not having to comply with a permit when if fact they own a treatment unit and are operating a treatment unit without a permit..... That is, we could send a NOV explaining both the failure to transfer and operating a treatment unit without a permit. We could possibly have the Allan rescind the permit such that we could reissue it to the current owner.. I know messy. but it might work? Linda let me know I would be happy to take a stab at the NOV and email it to you for your consideration? danny Linda Lewis wrote: Danny/Bradley/Bill: I have a case where a wet detention pond was permitted in 1996 to a Richard Hobbs. He sold the project in 1998 or 1999, but did not transfer the permit to the new owner. The pond has been in a mess for quite a while, and the new owner doesn't want to pay to clean it up because he thinks Mr. Hobbs should. Mr. Hobbs was fined $1339.60, which was paid in January, 2005, but he has not contacted the Division to initiate the transfer nor has be maintained the pond. The new owner is looking to the Division to resolve this, but other than initiating another enforcement action and fine (hopefully much larger this time), I don't know what else to do. The restaurant is now known as Barrier Island Restaurant. B. On August 21, 1996, Richard S. Hobbs was issued a Stormwater Management Permit, No. SW8 960608 , for the construction of a wet pond to treat the runoff from the entire Something Fishy 11 development. C. The site was inspected on February 4, 2000 and again on June 4, 2001, and the following violations of the permit were noted: 1. Condition 11.2(e)- Failing to maintain the side slopes of the pond at 3:1 or flatter. 2. Condition 11.5- Failing to provide the Designer's Certification. 3. Condition 1.6- Failing to submit a modification for a transfer of ownership upon the sale of the property. 4. Condition 111.1- Failing to submit a formal permit request to change ownership. 5. Because the pond has not been maintained since the permit was issued, another violation is being added: Condition 11.2- Failing to provide the operation and maintenance necessary to assure optimum efficiency. D. The New Hanover County Sheriff s Office delivered the inspection reports and enforcement letter on June 19, 2002. E. Staff costs and expenses associated with detecting the violations, defining their nature and extent, and bringing the enforcement action totaled $339.60, Page 2 of 6 File No. WQ SP-2004-0003 Based on the above Findings of Fact, I mane the following: CONCLUSIONS OF LAW: A. Richard S. Hobbs, is a "person" --within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). B. New Hanover County is a coastal county as defined by 15A NCAC 2H.1002(4). C. Richard S. Hobbs, holds a valid Stormwater Management Permit, Number SW8 960608, issued on August 21, 1996, for the construction of a wet detention pond to treat the runoff from the impervious areas associated with the Something Fishy II development, which has not been transferred. D: Richard S. Hobbs violated Condition 11.2(e)- by failing to maintain the side slopes of the wet detention pond at 3:1 or flatter. E. Richard S_ Hobbs violated Condition 11.5 by failing to provide the Designer's Certification F. Richard S. Hobbs violated Condition 1.6 by failing to submit a modification for a transfer of ownership upon the sale of the property. G. Richard S Hobbs violated Condition 11.2 by failing to provide the operation and maintenance necessary to assure the permitted system functioned at optimum efficiency. H. Richard S. Hobbs violated Condition 111.1 by failing to submit a formal permit request to change ownership. 15A NCAC 2H.1003 is a rule of the Environmental Management Commission implementing Part I of Article 21 of the North Carolina General Statutes. J. G.S. 143-215.6A(a)(2) provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation may be assessed against a person who is required but fails to act in accordance with the terms, conditions or requirements of such permit or any other permit or certification issued pursuant to the authority conferred by the general statutes. K. G.S. 143-215.3(a)(9) provides that the reasonable costs of any investigation, inspection or monitoring survey may be assessed against a person who violates any rules, standards, or limitations adopted by the Environmental Management Commission or who violates any terms or conditions of any permit issued pursuant to G.S. 143-215.1, or special order or other document issued pursuant to G.S. 143-215.2. L. G.S. 143-215.6A (b1) provides that a penalty of more than ten thousand dollars ($10,000), or in the case of a continuing violation, more than ten thousand dollars ($10,000) per day, may be assessed against a violator if a civil penalty has been imposed against the violator within the five years preceding the violation. DECISION: In determining the amount of the penalties, I have taken into account the Findings of Fact and Conclusions of Law, and have considered each and every factor set out in G.S. 143B-282.1. The duration and gravity of the violation: The project has been in violation since approximately 2000, when it was sold to Todd Williams. Mr. Williams indicated that Mr. Hobbs did not provide any information regarding the wet. pond, nor was the permit transferred to him. 3. The effect on ground or surface water quantity or quality or on air quality: Since _.. the pond has not been certified or maintained in at least 4 years, it's ability to store the 1" volume, to settle solids and to draw down within the required 2-5 days cannot be verified. The effect on surface water quality is to introduce potential pollutants contained in the runoff from a high density project into surface waters. 4. The cost of rectifying the damage: Those costs associated with restoring the pond to design condition.. ____.___....--_._5.—_ The_amount.of money_saved..by-noncompliance: Those -costs -associated -with the required routine maintenance of a wet detention pond. 6. Whether the violation was committed willfully or intentionally: Mr. Hobbs has used several addresses over the years. All documents mailed to those addresses were returned. The New Hanover County Sheriff was finally able to deliver all the documents to his wife at their residence, on June 19, 2002, at 319 Canal Street in Carolina Beach. The new owner, Mr. Williams, had been in contact with Mr. Hobbs over the years, but he showed no interest or desire to contact the Division or to get this resolved. The Division has not heard from Mr. Hobbs at all. His failure to respond should be taken as willful and intentional. 7. The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority: Unknown 8. It has been a year and'a half since the sheriff delivered the paperwork, and there has been no response from Mr. Richard Hobbs. I am currently in contact with the person who bought the property, Todd Williams. He is trying to get Mr. Hobbs to bring the pond into compliance, then he will accept the transfer of the permit. The pond is so far gone that it will require a substantial amount of money and work to bring it back into compliance. The package that was delivered on June 19, 2002, included a recommendation for enforcement, so I was thinking that a letter where we fined him for failing to comply with permit conditions (i.e., failure to maintain the permitted system and failure to notify us of the change of ownership) delivered by the sheriff would probably get him to start a dialogue with DENR and Mr. Williams to resolve. We should be willing to reduce or eliminate the fine if he will pay for repairing the pond and transfer the permit. Something Fishy H on June 10, 1996. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Please add the finished grade pavement elevations to the parking lot front edge to verify drainage into the pond. 2. A complaint was received a few weeks ago concerning the direction of drainage from the site. The complainant was worried that the runoff would cross their property and flood them out. From the existing contours provided on the plans submitted to DEM, a low area can be seen at the back north corner of the site, but no indication is given as to how this runoff left the site. The plan proposes to collect the runoff into the pond, but no existing drainage outlet is noted on the plans that will receive the runoff from the outlet structure. 3. 1 am concerned -that only one catch basin will collect all the runoff. Have you checked the inlet capacity for the design stone? 4. The spillway overflow detail is not on the plans. 5. Are the dumpsters located on concrete pads?
