DEMLR file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, property records show that this project which is located at 321 Raleigh Street Wilmington (Lot 29A of Landmark Industrial Park) is currently owned by DBR Property Group, LLC. The permit is currently issued to Top Properties, LLC. Both entities must sign and submit the enclosed Name/Ownership change form to transfer this permit to the new owner. in filling out this form, Top Properties, LLC should fill out the "current permittee" sections, and DBR Property Group, LLC should fill out the "proposed permittee" sections. Please note that the form must be signed by a manager of each organization. For Top Properties, LLC the NC Secretary of State (NCSoS) lists Harold Layne and Carl Anderson Pegge as managers. The NCSoS lists Howard L Russell, Jr. as the manager of DBR Property Group, LLC. Each organization may fill out a separate form and submit the form individually rather than having both entities sign the same form if that is easier. As shown on the inspection report, the transfer is the only non -compliant item remaining for this project from the Notice of Deficiency issued on June 11, 2013. The stormwater system has now been maintained and certified. Once it is transferred to the new owner, the site will be in compliance. Please inform this Office in writing before March 11, 2014, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by March 11, 2014 then DEMLR staff will re- inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. This law impacts any development approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. In the August 9, 2011 letter a renewal application, a transfer application and a blank Engineer's Certification was provided. On August 30, 2011 this letter was returned to this office, with this written statement, "TOP Properties, LLC does not own this property. It was sold a year ago". Because the permit was not transferred per the permit requirement, an inspection was performed on May 29, 2013, to determine the status of compliance with Stormwater Permit Number SW8 011216, issued to you on March 21, 2002. . The project has been found in violation of Stormwater Permit Number SW8 011216, issued pursuant to the requirements of the stormwater rules, 15A NCAC 2H.1000. The violations found are: 1. Failure to Maintain the Stormwater System. Per Section 11.2 of the permit, the Permittee shall provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. It was observed that vegetation maintenance including weed removal, mowing of vegetation, and debris removal from catch basins were not being conducted. As also stated in the permit, the approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals, including, but not limited to: • Routine monthly inspections; • Sediment Removal; • Mowing and re -vegetation of side slopes; • Immediate repair of eroded areas; • Maintenance of side slopes in accordance with the approved plans and specifications; • Debris removal and unclogging of the outlet structure, orifice device and catch basins and piping; '' Access to the outlet 1 bypass structure must be available at all times. 2. Failure to certify the stormwater system. Any deviations from the approved plans and specifications must be noted on the Certification. 3. Failure to notify this office pLior to transfer of this property. An administrative review revealed that all documentation was provided by this office on August 9, 2011 to start the transfer process of this permit. Per Section 111.1 of this permit states that, `This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permittee until such time as the Division approves the formal permit request. " To correct these violations you must: 1. Perform the maintenance necessary to get this storm water system Certified by an appropriate Engineer. 2. Once the system is certified submit a completed transfer application and this office will transfer the permit to DBR Property Group, LLC. Please provide a written "Plan of Action" upon 30 days receipt of this notice to DWQ that states how and when these violations will be corrected. If we do not receive your plan of action by this date you will be in violation of 15A NCAC 2H.1000, which could result in the initiation of -� enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A. By copy of this letter to the New Hanover County Building Inspector, this office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved.
