Just to summarize: This is a high density permit which by its terms would have expired on 7/25/12 (but arguably was extended under Permit Extension Act of 09). My understanding, based on a conversation with the current owner of the property, Jeff Earp of Funston Land and Timber, is that the original permittee never purchased the property, no development activities were conducted on the property, and no construction or installation of stormwater measures took place. The current owner does not plan to develop this parcel for at least 15 years. He was very clear about this. He does not want the SW permit to be transferred to him. This is not a situation in which operation and maintenance is an issue. The current owner understands that, if he does develop this parcel at a later time, he will have to apply for a stormwater permit and he will have to comply with whatever rules are in existence at that time. Can we treat this one as expired or de -activated? The Division mailed the enclosed letter on July 12, 2012, which was returned as undeliverable. I have since talked with the landowner, Jeff Earp of Funston Land and Timber, and he explained that there is a radio tower and a communications building on the property which has been leased for approximately the next two years. Since the permit is written to Southland Studios, Inc which is no longer a legal entity the permit must be transferred to another permittee. If you do not respond to this letter by October 1 2012, then the Division will consider that you have abandoned the permit and will either revoke and reissue the permit to the new property owner, or modify the permit by transferring it to the property owner for cause. If the new landowner, Funston Land and Timber, LLC wants to obtain the permit and the associated permit rights via a permit transfer, they must contact the Division in writing to express their intent by October 1, 2012. Front St. M108 Wilmington, NC 28401 Subject: 60 day Notification Revocation or Modification of a State Stormwater Permit for Cause Southland Studios Stormwater Permit No. SW8 010801 Brunswick County Dear Mr. Crawford: Dee Freeman Secretary On September 15, 2011 the Division of Water Quality (DWQ) inspected Southland Studios in Brunswick County to determine the status of compliance with Stormwater Management Permit Number SW8 010801 issued'on July 25, 2002. You were mailed notification of the inspection via certified mail on the same date. This letter also outlined your options to rescind or transfer the permit to the new landowner. A review of the file shows that we have not received a response to the letter, and therefore we have to assume that you intend to abandon the permit. The North Carolina Secretary of State shows that Southland Studios, Inc was dissolved on July 21, 2011. County records show that this project would be located on Parcel 05800007 which is currently owned by Funston Land & Timber, LLC. The September 15, 2011 inspection revealed that the project has not yet been completed. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 4 State Stormwater Management Systems Permit No. SW8 010801 Modification 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. Proiect Description: The Southland Studios Facility is a proposed project to be constructed in the near future in Brunswick County. In the first phase, the land disturbing activity associated with the project will consist of clearing and grubbing of trees, excavation for drainage swales, initial rough {preliminary} grading of the site, and sediment and erosion control measures such as a silt fence, gravel construction entrance, and a sediment basin. Phase II will consist of final grading, constructing drainage swales, building a detention pond, storm piping, water lines, irrigation lines, and sewer lines, and the construction of buildings, driveways, and parking lots. The total area which will be disturbed for this project is 33.3 acres. 2. Site Description: The project site is in Brunswick Co., NC, located directly to the south of Kay Todd Rd. (SR 1553). The site is located to the southeast of where Hwy. 17 crosses over Sunny Point RR, 2 miles south of Magnolia Greens. The property on which the development will take place is owned by Southland Studios. On site soils consist mainly of Woodington, Foreston, and Goldsboro soils. These soils are mainly loamy, fine sands. Southland Studios is currently under contract to purchase a total of 141.28 acres of land which is shown in Sheet C1. Of the total site, 18.14 acres are wetlands. The finished studio site will consist of five sound stage buildings, two mill shops, a rigging shed, a lighting/grip building, a front gate building, a pump house, and a commissary. In addition there will be roadways, parking, and sidewalks. The areas for each of these are shown in the attached appendix - Impervious Areas. Stormwater on the north side of the existing creek shown on the plans will be collected by catch basins which empty into storm piping and drain into an onsite detention pond. The pipe network is shown on Sheet C2. Stormwater on the south side of the existing creek will be collected by drainage swales which empty into a detention pond. Both detention ponds drain into the Morgan Branch of Town Creek, which empties into the Cape Fear River. General slope of the site is from north to south towards the back of the lot. Land use in the vicinity is commercial. 3. Adiacent Property: The areas adjacent to the project site are wooded and sparsely populated. 4. Drainage Considerations: Drainage calculations to determine the size of storm piping is attached in the appendix — Storm Piping Calculations. The project site is graded so that all -stormwater will drain into 29 strategically placed catch basins. Building roofs will divert stormwater into roof drains which will empty directly into catch basins. From the catch basins storm water will empty into a network of storm pipes which drain into an onsite stormwater detention pond. The storm pipes empty into the pond below the permanent pool elevation. The small overflow parking area to the south of the existing creek is drained by swales which empty into a small detention pond. Southland Studios SR 1553. March, 2001 Calculations showing the sizing of the stormwater detention ponds are shown in the attached appendixes -- Detention Pond #1 Sizing Calculations and Detention Pond #2 Sizing Calculations. Both ponds are designed to receive a Total Suspended Solids (TSS) removal of 90%. For Detention Pond #1, the Surface Area to Drainage Area ratio (SA/DA) is 2.70% based on a 4' depth. For Detention Pond #2, the Surface Area to Drainage Area ratio is 4.30% based on a 5 foot depth of the permanent pool. With 90% TSS there is no need for a vegetative filter for either pond. The required temporary storage volume was determined using the Schueler Method and basing calculations on a 1" rainfall event. Then the permanent pool volume is determined based on the permanent pool surface area and the depth of the pool. Then 20% of that volume is to be used for the forebay volume. Next the drainage orifices were sized to keep the drainage time of the 1 inch storm event between 2 and 5 days. For Detention Pond #1 an outlet structure with a pipe was designed to handle overflow. An emergency spillway was designed to handle additional stormwater overflow. For the Detention Pond #2, an overflow weir was designed above the temporary pool elevation. It was sized using the excess runoff created from pre and post development for the 25 year storm. An emergency drainage weir was sized to handle the same flow as the overflow weir. 5. Erosion Control Considerations: The following erosion control measures are used on this project: Temporary Gravel Construction Entrance/Exit A temporary gravel construction entrance should already be onsite to prevent sediment from leaving the site. The entrance should be checked to see if it is functioning properly. An additional entrance is needed directly to the south of the existing creek. If needed, each one should be adjusted to the dimensions and specifications as shown in Construction Details. 2. Land Grading The existing slope of the site is from north to south towards the back of the lot. Most of the disturbed areas on the site will drain into either catch basins or drainage swales which will empty into an onsite detention pond. 3. Silt Fence Silt fence should already be onsite from the previous clearing and grading activities. However, additional silt fence may be needed in certain areas as shown on plans. Existing silt fence should be checked to see if it is functioning properly. If needed, silt fence should be cleaned and replaced if damaged. See Construction Detail for dimensions and specifications. 4. Inlet Protection Inlet protection consisting of a small portion of silt fence surrounding proposed catch basins will be utilized to prevent sediment from entering the drainage system. See Construction Detail for dimensions and specifications. 5. Temporary Channel lining Drainage channels will need to be lined with temporary erosion control mats as shown on plans, to control erosion during construction. Southland Studios SR 1553. March, 2001 6. Detention Pond A detention pond will be built to control sediment from leaving the site. It will be constructed at the south end of the lot. See Construction Detail for dimensions and specifications. 6. Construction Schedule: 1. Obtain plan approval and other applicable permits. 2. Hold pre -construction meeting at least one week prior to beginning construction. 3. Install/Maintain temporary construction entrance/exits. 4. Before clearing and grading of the site, check existing silt fencing and clean and replace as necessary. 5. Build onsite detention ponds. 6. Begin clearing and grading of the site. 7. Construct onsite drainage swales with erosion control protection. 8. Construct onsite catch basins with inlet protection. 9. Install storm piping. 10. All erosion and sediment control practices will be inspected bi-weekly and after each rainfall event. Needed repairs will be made immediately. 11. After the entire covered area is stabilized, all temporary measures will be removed and permanent vegetative repairs to be completed. 7. Vegetation Plan: 1. After complete stabilization of the entire covered area, top cover soils will be roughened by making 1 %2" deep grooves perpendicular to the slope. 2. Spread lime (agricultural limestone) evenly over the area at a rate of 1.5 tons/acre; spread 10-10-10 fertilizer at a rate of 1000 lb/acre and incorporate into the top 6" of soil. 3. Loosen surface prior to applying seed. 4. Broadcast seed at recommended rates. 5. Rake seed into the soil and lightly pack to establish good contact. 6. Mulch with 4000 lb/acre grain straw or equivalent and anchor by weighted farm disc set nearly straight or other mulch anchoring tool. 7. July, 2001 1.0 NARRATIVE This Sediment Erosion Control Plan is being designed to control disturbed soils on a site in Brunswick Co., NC, located directly to the south of SR 1553. The site is located to the southeast of where Hwy. 17 crosses over Sunny Point RR, 2 miles south of Magnolia Greens. The property on which the development will take place is currently under contract to purchase by Southland Studios. The agreement of sale is included with this narrative. The land disturbing activity associated with the project will consist of clearing and grubbing the area, and building drainage swales throughout the site which drain into an on site sediment basin. On site soils consist mainly of Woodington, Foreston, and Goldsboro soils. These soils are mainly loamy, fine sands. Stormwater on the site will be collected by drainage swales which empty into an onsite sediment basin. This will drain into the Morgan Branch of Town Creek, which empties into the Cape Fear River. General slope of the site from north to south towards the back of the lot. Land use in the vicinity is commercial. Disturbance will follow the construction schedule and reclamation will be conducted as covered areas are completed and stabilized. Sediment Erosion Control Practices 1. Temporary Gravel Construction Entrance/Exit A temporary gravel construction entrance will be installed at the northern most corner of the site on SR 1553. to prevent sediment from leaving the site. The entrance should be graded so that runoff water will remain on owner's property. See Construction Detail for dimensions and specifications. 2. Land Grading The existing slope of the site is from north to south towards the back of the lot. Most of the disturbed areas on the site will drain into swales which will empty into an sediment basin. 3. Sediment Fence Sediment fences will be constructed at the base of slopes to prevent sediment from leaving the site. 4. Sediment Basin A sediment basin will be built to control sediment from leaving the site. It will be constructed at the south end of the lot. See Construction Detail for dimensions and specifications. Southland Studios SR 1553. ,July, 2001 K Future Development Future development on this site will consist of bringing in offsite fill to provide proper drainage of the site, constructing several buildings, parking lots, storm water piping, water lines, irrigation lines, and sewer. The total area, which will be disturbed in this activity, is projected to be 46 acres. A modification to this permit will be submitted prior to that construction. Stormwater on the site will be collected by catch basins and stormwater piping which empty into an on site detention pond. This will drain into the Morgan Branch of Town Creek, which empties into the Cape Fear River. 2.0 CONSTRUCTION SCHEDULE 1. Obtain plan approval and other applicable permits. 2. Hold pre -construction meeting at least one week prior to beginning construction. 3. Install/Maintain temporary construction entrance/exit. 4. Before clearing and grading of the site, install silt fencing at the base of slopes to restrict movement of sediment from the site. 5. Build onsite sediment basin. 6. Begin clearing and grading of the site. 7. Construct onsite temporary drainage swales. 8. All erosion and sediment control practices will be inspected bi-weekly and after each rainfall event. Needed repairs will be made immediately. 9. After the entire covered area is stabilized, all temporary measures will be removed and permanent vegetative repairs to be completed. 3.0 VEGETATION PLAN 1. After complete stabilization of the entire covered area, top cover soils will be roughened by making 1 "-2° deep grooves perpendicular to the slope. 2. Spread lime (agricultural limestone) evenly over the area at a rate of 1.5 tons/acre; spread 10-10-10 fertilizer at a rate of 1000 lb/acre and incorporate into the top 6" of soil. 3. Loosen surface prior to applying seed. 4. Broadcast seed at recommended rates. 5. Rake seed into the soil and lightly pack to establish good contact. Southland Studios SR 1553. July, 2001 6.
