Appointments are scheduled between 9:00 a.m. and 3:00 p.m. Viewing time ends at 4:45 p.m. Anyone arriving without an appointment may view the files to the extent that time and staff supervision are available. 2. You must specify files you want to review by facility name or incident number, as appropriate. The number of files that you may review at one appointment will be limited to five. 3. You may make'copies of a file when the copier is not in use by the staff and if time permits. There is no charge for 25 or less copies.: cost per copy after the initial 25 is 2.5 per copy. Payment is to be made by check, money order, or cash in the administrative offices. 4. Files must be kept in the order you received them. Files may not be taken from the office: No briefcases, large -totes, etc. are permitted in the file review area. To remove, alter, deface, mutilate, or destroy material in public files is a misdemeanor for which you can be fined up to $500.00. 5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for checks on which payment has been refused. 6. Our files (and any part of) must stay in our possession at all times. The only options are: come in for a file review and piece the site plan together on our copy machine, or, as my time allows, I will take the site plan offsite and have the copy made. I will then call you when it is ready and you can come pick it up and reimburse us for whatever our cost was. I would recommend you come for a file review. I have looked at the site plans and nothing indicates it is the drainage area map so it would be better for you to indicate exactly what you want copied if that's the route you decide to take. David Conner and I met with you on September 23 regarding a possible expansion of the Morehead Crossing Shopping Center in Morehead City. During the meeting, you had the original stormwater permit, and with it there was a drainage area map that corresponded to the pond design and approved permit. Can you send me a scan or hard copy of that map? We are continuing to evaluate options for the pond, but having the map would be helpful so I can accurately account for new vs. existing impervious area. The previous site was designed permitted in approximately May 2001. The existing stormwater permit number was not found during a preliminary records search. The existing shopping center is located north of Highway 24, west of the intersection of Highway 70 and Highway 24. The site drains to the north into a wetland conservation area which then flows into a tributary to the Newport River. Newport River is classified as SA; HQW. There was one stormwater wet pond designed and constructed for compliance with applicable stormwater regulations in effect in 2001. The Newport River is located approximately 1.25 miles from the site. The proposed modifications will add parking capacity to the site. Due to the proximity of the.existing parking lot to the existing BMP, the BMP will be moved to the north onto property currently occupied by an access drive. The entire project will remain within the existing site boundary. The revised plan will increase impervious area on site by approximately 0.5 acres. The revised BMP will be sized for 90% TSS removal per the current NC BMP manual. The outlet of the wet pond will be in the same location as the exiting pond outfall. As part of the scoping meeting, we request that DWQ research the existing stormwater permit as well as the status of the existing wetland conservation area to the north of the site. This permit expires on August 16, 2011. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application prior to February 16, 2011. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should be completed and submitted along with your renewal application. You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility without a valid permit, are, violations of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stortwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance rust occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping_ g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. &. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 4. A modification must be permitted prior to any construction. The following items will require a modification to the permit. The Director may determine that other revisions to the project should require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or drainage area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permitter, for which Sedimentation and Erosion Control Plan approval was sought. f. FiBing in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the pemitted amount, a modification to the permit must be submitted and approved prior to construction. 12. Prior to the sale of any portion of the property, an accesshnaintenance casement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 13. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame speci fled in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days. I11. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and a]I statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. As discussed with Mr. Sugg, prior to authorizing activities pursuant to Section 404 of the Clean Water Act, the activity must comply with the Section 404(b)(1) Guidelines. These guidelines provide for first, avoiding impacts to waters and wetlands through the selection of the ID least damaging, practicable alternative; second, taking appropriate and practicable steps to reduce impacts on waters and wetlands; and finally, compensation for remaining unavoidable impacts to the extent appropriate and practicable. During the review of the initial project design, it was demonstrated that the project avoided and minimized wetland impacts as much as practicable; and was in compliance with the 404(b)(1) guidelines. To enable us to determine if your current construction design complies with the guidelines, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including onsite upland alternatives, to the work for which you have constructed, and provide justification that your construction layout is the least damaging to water or wetland areas on the property. b. It was necessary for you to have taken all appropriate and practicable steps to minimize wetland losses. Please indicate all that your current construction has done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts to wetlands. c. The Guidelines require that appropriate and practicable mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practicable minimization has been employed. With our January 29, 1998 issued permit, a mitigation plan was agreed upon and implemented to compensate for the unavoidable loss of waters or wetlands in the initial permit design. As you have discussed with Mr. Sugg on several occasions, specifically in a March 4, 2002 telephone conversation, the mitigation monitoring reports are demonstrating that the Laurel Road mitigation site is failing to meet the hydrological and vegetative parameter. Without any guarantees that the site will succeed, it is our position that you should seek other mitigation options to fulfill this requirement. The aforementioned, requested information is essential in bringing your permit into compliance, and to determine if your current construction design is eligible for permit modifications. You should forward this information to us within two (2) weeks of your receipt of this letter. Upon receipt of your response, we will then determine further appropriate administrative or legal action.
