Dear Mr. Garrett:
The Wilmington Regional Office received a Stormwater Management Permit Application for Lowe's
Foods Pine Grove Drive Site on October 24, 2000. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater review:
Delineate all wetlands on site, disturbed or undisturbed, or note on the plans that none exist
2. Is Southport Trading Company an LLC? Please indicate what kind of company it is .on the
application.
3. :Since: two�supple,ments.have•be'en"pr'ovi'ded, there must beat least.two columns filled in.on the
-application, one for the trench and.one for,the'basin. There'is no symbol in -the legend and no
note-on.the plans to indicate that.a•trench is provided, anywhere.
4. Is the flat grade piping -supposed to be the proposed trench system? The current design seems
to use the flat grade perforated piping as the primary treatment, with any overflows going into
.the basin. You;cawhave both the treneb:and the•basin, but each one must -be a separate system,
.sized individually -to accommodate it's separate drainage area. The outlet and overflow must also
be.separate. ,The,trenchesshould.overflow.to.a�vegetated filter instead of the basinAf.you'keep
,the current:setup,"the basin will.need.tobe sized for the entire drainage:area,"as'if the,trenches
-weren't there, -just`like,two ponds in series. The last system7in line has to:be sized for.everything.
I cannot verify calculations until this'is resolved.
4. Please provide an infiltration basin detail on the plans. Include the 3:1 side slopes, and note the
bottom and storage elevations.
S. Please add.a detail of the.required vegetated filter to the plans.
6. A large portion of the perimeter collection piping is:laid at a flat grade. •How .will,this work in
regards to directing runoff into the'infiltration basin for treatment? Is -this piping part of the
unlabeled proposed trench? If -so, please.label. I-wi11 consult with Raleigh -regarding the flat
grade of the proposed collection system. If you separate the trench and basin systems, the flat
grade will be OK.

7. The intersection of Oleander Drive and South College needs to be added to the vicinity map. The
rules require the nearest major intersection be shown.
Please provide existing grades at Sycamore Hollow to demonstrate that no offsite runoff from
this site enters the proposed basin. There is no existing ditch between the two properties, so the
possibility of offsite runoff does exist.
9. Based on the grading shown at Sycamore Hollow, a low area will be formed behind Units 313
and 4A, with no proposed outlet for the runoff that will accumulate. Please address.
10. Please specify the stone to be used in the trench, and provide it's specification sheet. A void ratio
of 0.55 is definitely not normal, which is around 0.4.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to January 11, 2001, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the
application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must indicate
the date by which you expect to submit the required information. The Division is allowed 90 days from the
receipt of a,completed.appliication to issue the permit.
The -construction of any impervious: surfaces, other.than a construction entrance under:an.approved
Sedimentation Erosion •ControlTlan, is a violation ofNCGS 143-215.1 and.is subjectao enforcement action
pursuant to NCGS -143-21.5,6A.

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is -current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 001027 which has already expired on February
13, 2011, is now in effect until February 13, 2015. Please resubmit the renewal
application and fee. at least 180 days prior to February 13, 2015, which would be August
13, 2014. A copy of the Renewal Application can be obtained from the following

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 001027 to Lowe's
Foods — Pine Grove Drive for a High Density Project on February 13, 2001. This permit expires on February 13, 2011.
Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior
to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is
still an active project please complete and submit the enclosed renewal application prior to August 13, 2010. If this
project has not been constructed and a permit is no longer needed, please submit a request to have the permit
-escinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and
phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment
system, a certification of completion be submitted to the Division from an.appropriate designer for the type of system
installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved
plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal
request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new Operation and
Maintenance agreement that should be completed and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment
facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate
enforcement action including the assessment of civil penalties of up to $10,000 per day.

We are responding to your letter of December 11, 2000 and subsequent fax of January
3, 2001 as follows:
1. It has been noted on the plans that no wetlands exist on the site.
2. Southport Trading Company is a LLC.
3. As we discussed, the 1.5-inch storage will be provided entirely in the trench system.
The trench system has been classified on the plans.
4. As previously discussed, the trench system will contain the 1.5-inch storage
requirements.
4a. The infiltration basin is for City of Wilmington storage requirements only.
5. Due to the system capability to contain the 25-year, 24-hour storm, no vegetated
filter is required.
6. As previously discussed, the infiltration basin is not part of the state system.
7. The vicinity map has been modified per your request.

8. A swale has been added to eliminate the possibility of off -site water from entering
the basin.
9. The swale noted in item 8 above will allow drainage of this area.
10. The void ratio will be 0.4 for the stone. The total trench void ratio is now 51.7%.
As indicated in your memo of January 3 we have added another baffle wall in the outlet
structure to separate the trench system from the basin system.
We are enclosing 2 sets of revised plans and calculations for your review and approval.

In order to keep the runoff in the trench, another baffle needs to be added to the outlet structure between the
24"pipes that enter front the trench and the 15" pipe that leads to the basin. This will allow the trench system
to overflow into the basin, then overflow front the basin into the City street system. You can raise the top of the
baffle wall front elevation 20 to 20.1 and make the top of the new baffle wall 20. Please see the attached detail.
Please report the individual lengths of perforated piping provided for each pipe diameter on the supplement.
l f the basin will not be included as part of the State approved system, the basin supplement will need to be deleted
from the application package, and you call disregard the C0111n1ent to Split LIP Section 111, ])art 6 of the application
into two columns.
The 11I'll lmum required volume to provide storage I -or, based on 1.5"of rain, is 19,805 cubic feet, using the volume
calculation method in the 13MP document. The volume available in the trench system alone is 18,389 cubic feet.
At a minimum, the system must be able to store 19,805 cubic feet, even if you demonstrate that the 25 year storm
can be handled. The storage requirement is a separate issue from the bypass requirenlcnt. If the basin will not be
used, you will need to increase the storage volume in the trench system..
Comment Numbers 1, 2, 5, 7, 8, 9 and 10 from the December 11, 2000, request for additional information letter,
are still valid requests.
Ifyou demonstrate that the 25 year, 24 hour storm call be infiltrated without discharging, then the requirenlcnt for
a vegetated filter can be waived. I"or any other storin events, a vegetated filter is required for the overflow from all
infiltration basins. (See .1008 (c) (4))

NARRATIVE
STORMWATER MANAGEMENT
The project site is located in New Hanover County at the corner of Greenville
Loop Road and Pine Grove Road. Land disturbing on the site will exceed one acre,
which requires the site to comply with the Stake Regulations. The stormwater runoff
from the development will be directed to an infiltration stormwater system. The
stormwater system was designed to accommodate this site at 88.25% impervious area
lot coverage and a minimum of 1.5 inches infiltration as the site drains to SA waters.
The system is designed to allow no discharge in rainfall events up to the 25-year storm.
