The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 000905, issued to you on June 13, 2001. The project has been found in violation of Stormwater Permit Number SW8 000905 , issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: Section 11.16-Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Section 1, Part 2. The recorded statements must follow the form: a. "The maximum built -upon area per lot is: Lot 1=1,462 ft2; Lot 2= 1,515 ff2; Lot 3=1,451 ft2; Lot 4=1,528 e; Lot 5=1,810 ftz; Lot 6=1,809 ff2; Lot 7=1,914 ft2; Lot 8=2,508 ft2; Lot 9A=2,173 ft2; Lot 9B=2,312 ft2; and Lot 9C=2,387 e. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. " b. "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State. " C. "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." N. C. "Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. " e. "All runoff on the lot must drain into the permitted systems. This may be accomplished through providing roof drain gutters which drain to the . street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that naturally drain into the system are not required to provide these measures." The submitted recorded deed restriction document contains none of these statements. 2. Section H.17- A copy of the recorded deed restrictions most be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must bear the signature of the Permittee, the deed book number and page, and stamp/signature of the Register of Deeds. The deed restrictions were recorded on April 20, 2000, over a year before the permit was issued, and apparently have not been amended to comply with the permit requirements. To correct these violations you must: Provide a written "Plan of Action" which outlines the actions you will take to correct the violations and a time frame for completion of those actions, on or before December 3, 2003. 2. Record the required statements per Section 11.16 of your permit. 3. Submit a copy of the amended deed restrictions which contain all of the required statements (a-e) above within 30 days of recording. Each individual lot owner must sign the amendment in order to have it apply. Failure to provide the "Plan of Action" by December 3, 2003, or to correct the violations by the date designated in the "Plant of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A. By copy of this letter to the Pender County Building Inspector, this Office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of approximately 5.3 acres being conducted. It is our understanding that you and your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations that were found are: 1. Failure to conduct a land -disturbing activity in accordance with the provisions of an approved erosion and sedimentation control plan. G.S. 113A-61.1. The plan does not indicate current development activities. The current activity has not been approved. The erosion and sedimentation control plan approved by this office on November 8, 1999 must be immediately implemented on the site sufficient to restrain off -site sedimentation. 2. Failure to retain along a lake or natural watercourse a buffer zone of sufficient width to confine visible siltation by natural or artificial means within the 25 percent of that portion of the buffer zone nearest the land -disturbing activity. G.S. 1 13A-57(1). The visible siltation can be seen at the boat ramp. It is being discharged into the sound. 6. Failure to maintain on graded slopes and fills and angle which can be retained by vegetative . cover or other adequate erosion control devices or structures. G.S. 1 13A-57(2) and (if in HQW Zone) 15 NCAC 4B.0024(d), Gullies are forming as a result of inadequate drainage design. 7. Failure within 15 working days of 30 calendar days (whichever period is shamed of completion of any phase of grading to plant or otherwise provide exposed, graded slopes'or fills with ground cover, devices, or structures sufficient to restrain erosion. G.S. 113A_57(2). The graded area does not have groundcover devices, or structures sufficient to restrain erosion. To correct these violations, you must: 1. Please be advised that if you fail to respond to this notice or if these violations are not corrected within 30 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take appropriate legal action against you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty and the amount may be up to $5000 per day for each day of the violation. The penalty may be assessed from the date of the violation, NCGS 113A-61 (a) (1 ). If these violations are corrected within the time period specified for compliance, no further legal action will be pursued. N,C 28540 A5 discussed at the meeting on August 2, 2000 with you, Ms. Janet Paith and me, Sunset Cove Development, Inc. purchased eleven platted lots from Mr. Ronnie Bryant on March 10, 2000. The deeds to Sunset Cove was recorded in Deed Book 1563, Page 246 of the Pender County Registry. Prior to the purchase by Sunset Cove, I was unformed by Mr. Charles Riggs, surveyor for Mr. Bryant, that no environmental permit would be required if the only land disturbing activity would be construction of the drive, as shown on the recorded plat, and a bulkhead for the lots since less than one acre would be disturbed. Mr. Riggs informed me that the only Permit required for subdividing the approximately 2 acre tract of land was the utilities permit and any remaining permits required were in the possession of Mr. Bryant. I lowever, l was not informed, nor was I aware, that a sedimentation and erosion control plan for a 5.3 acre tract, including the adjacent watercourse, has been applied for by Mr, Bryant and approved. 1 only became aware of the Letter of Approval issued by your agency of the sedimentation and erosion control plan submitted by Mr. Bryant at our meeting on August 2, 2000. Sunset Cove never had any intention of undertaking the more extensive land disturbing activities for which the plan applied for by Mr. Bryant had been approved. In fact, the only land disturbing activity performed was the construction of the drive in the access easement area shown on the recorded plat and, after receipt of a CAMA permit, installation of the bulkhead on behalf of individuals and entities who owned seven (7) of LOTS. The total area of land -disturbance was less than thirty-nine thousand (39,000) square feet. PAGE 02 As you know, I am aware of the requirement for a sedimentation and erosion control plan approval in the event more than one acre --of land will be disturbed. Had I known of the plan submitted by and approved for Mr. Bryant, I would have contacted your office to rescind the plan prior to undertaking the minimal land disturbing activities performed by Sunset Cove_ Hopefully, this letter outlining the chronology 'of events and explanation of the actions taken will be sufficient to consider the plan approved for Mr. Bryant a moot issue since he no longer has any ownership interest in the land and the more extensive activities proposed therein will not be undertaken, If you need any additional information or have any questions, please contact me.
